Box 1922 Kill Devil Hills, NC, 27948 Authorizing development in Dare County at Blounts Bay and Dog Point Creek, 1608 Colington Rd. , as requested in the permittee's letter dated 5/17/08. including the attached work plan drawings (2), both dated 5/12/08. This permit, issued on October 13. 2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Access Pier 1) Unless specifically altered herein, this minor modification authorizes the extension of authorized access pier and gazebo all as expressly and specifically set forth in the attached workplan drawings. No other additional structures, whether floating or stationary, or any additional boat slips, shall become a permanent part of this access pier without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 3) The roof of the covered gazebo shall not be designed for second story use. (See attached Sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2008 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ff James regson, Director Division of Coastal Management This permit and its conditions are hereby accepted. No boats shall be moored along the authorized pier at anytime. 5) This minor modification shall be attached to the original Permit No. 137-05, which was issued on 10/4/08, and the minor modifications issued on 3/20/08 and 1/14/08, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 6) All conditions and stipulations of the active permit remain in force under this minor modification unless specifically altered herein. This correspondence concerns the Colington Point CAMA Major Permit #137-05. As we discussed, the permittee wishes to replace the existing 50 ft pier with an 88 ft by 6 ft pier with a 20 ft by 16 ft gazebo on the end. I have attached Figures 1 & 2 which show plan & cross sectional views of the proposed replacement. I have also enclosed a check for $100.00 from Mr. Saunders (Colington Point, LLC) for the required minor modification permit filing fee, as required by the rules, for permit modifications.
