Division of Water Quality (DWQ) Request for More Information letter dated September 23, 2008. This additional information is an amendment to our existing Individual Permit application under review by both the US Army Corps of Engineers (USACE) (Action ID No. 200801712) and DWQ (Project No. 06-1804, Ver. 3) for the proposed "The Village at Flowers Plantation" project. DWQ September 23, 2008 Letter (see attached): Please note that many of the concerns within this letter were discussed and resolved at the July 16, 2008 meeting held at the River Dell Company, Inc. office. Please provide building envelopes for all lots with wetlands, streams or buffers on the site plans. At the July 16, 2008 office meeting referenced above, one of the questions discussed was within the June 16t DWQ letter (Questions 4.a), which requested a more specific, detailed mechanism to assure DWQ that all lots will be buildable without additional wetland, stream or buffer impacts. As discussed in our July 16th meeting with the DWQ and as addressed within the last response letter to the DWQ, the applicant is willing to place deed notifications on any lots necessary to ensure avoidance of additional impacts to wetlands, streams or buffers. This approach was suggested and agreed upon in the July 16th meeting because this project is only proposing road infrastructure, it is anticipated that each development phase will be sold to individual developers who will then determine lot size and the WWI footprints for each lot. Therefore, as discussed and agreed upon in our July 16t meeting, it is unfeasible at this time to create a map showing building envelopes for all lots that have wetlands, streams or buffers on them. However, the applicant will make every effort possible to ensure that the development of future lots will not include additional wetland, stream or buffer impacts. 2. Please indicate proposed lot layout as an overlay on the site plan. As discussed and agreed upon in the July 16th meeting with the DWQ, because this project is only proposing road infrastructure, it is anticipated that each development phase will be sold to individual developers who will then determine lot size/dimensions. Therefore, as discussed and agreed upon in our July 16th meeting, it is unfeasible at this time to create a map showing lot layouts on the site plan. 3. Your proposed stream crossings Nos. 5, 11, 18 and 19 do not appear to be aligned at an approximately perpendicular angle. Please re-configure your proposed stream crossing to show it aligned approximately perpendicular (between 75 ° and 105). As requested, the engineer has reviewed impact areas 5, 11, 18 & 19. Impact area #11 has been modified and the crossing is aligned to be more perpendicular, please see revised impact tables below, attached revised impact exhibit and revised overall site plan. It is also important to note however that although a road crossing that is aligned at a more perpendicular angle often times results in less impacts, the alignment of a road crossing between 75° and 105° is not a specific requirement of the Neuse Buffer Rules for road crossings (NCAB 213 .0233) or within the 401 Water Quality Certification Rules (NCAC 2H .0500). Your proposed stream crossings nos. 5, 11, 18, and 19 do not appear to be aligned at an approximate perpendicular angle. Please re-configure your proposed stream crossing to show it aligned approximately perpendicular (between 75 degrees and 105 degrees). Response: • Crossing No. 11 has been revised as requested. (See attached plan sheets). Crossings Nos. 5, 18, and 19 cannot be realigned as requested. A closer look at the existing topography shows that the alignment of the proposed road is within a confined corridor created on the northeast by the creek and on the southwest by existing development (Walker Woods). Walker Woods consists of single family residential lots that are not owned by the applicant. As such, the alignment of the proposed roadway cannot be shifted to the southwest which is the only practical way to make the crossings more perpendicular that they currently are. If the roadway is shifted to the northeast, the angle of crossing #5 does not change, and the angles of crossings #18 and #19 become less perpendicular that it currently is designed. Also, the impact associated with crossing #19 increases substantially because of the section of creek between crossings #18 and #19 parallels the roadway alignment.
