The purpose of this project is to install a gravity sewer main, consisting of 6,865-feet of 30-inch sewer, 478-feet of
16-inch sewer, 1,203-feet of 12-inch sewer, 88-feet of 10-inch sewer, and 53-feet of 8-inch sewer.

permanent impacts to 0.29 acres of forested wetlands, and 222 linear feet ofterrrporarv stream impacts during the
' construction of a sanitary sewer line and pump station. :Mitigation, at a 2:1 ratio is reuuired for the permanent
impacts to wetlands (see below).

' Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans ma) subject the
pennittee to a stop work order. a restoration order and/or appropriate legal action.
' This verification is valid until the NWP is modified, reissued, or revoked. All of the existing NWI's are scheduled to be modified,
reissued, or revoked prior to March 18, 2007. It is incumbent upon you to remain inibrmed of changes to the NWPs. We will issue a
public notice when the NWPs are reissued. Furthermore. if you commence or are under contract to commence this activity before the
date that the relevant nationwide pennit is modified or revoked, you will have twelve (12) months from the date of the modification or
' revocation of the NWP to complete the activity tinder the present terms and conditions of this nationwide permit. If, prior to the
expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid
until the expiration date identified below, provided it complies with all new and or modified teens and conditions. The District
' Engineer may. at anv time, exercise his discretionary authority to modify, suspend, or revoke a case specific activity's authorization
under any NWP.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
' For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (LAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management .
This Department of the Army verification does not relieve the pennittee of the responsibility to obtain any other required Federal,
State or local approvals/permits.

' Permit Condition: In order to compensate for impacts to 0.29-acre of permanent wetlands, the purnittec shall make payment to the
North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined by the NC ia:P, sufficient to perform the
restoration of 0.5-acre riparian wetlands in the Cape Fear River Basin, Cataloging Unit 030 30002.
Construction within jurisdictional areas on the property shall begin only after the permittee has made full payment to the NC LEI) and
provided a copy of the payment documentation to the Corps, and the NC EEP has provided written

confirmation to the Corps that it agrees to accept responsibility for the mitigation work required, in compliance with the MOU
between the North Carolina Department of Environment and Natural Resources and the United States Army Corps of Engineers,
Wilmington District, dated November d, 1995.

' This office has reviewed the subject erosion and sedimentation control plan. We find the plan to be
acceptable and hereby issue this Letter of Approval. The enclosed Certificate of Approval must be
posted at the job site. This plan approval shall expire three (3) years following the date of approval,
if no land-disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129.
Title 15A NCAC 4B .0118(a) requires that a copy of the approved erosion control plan be on file at
the job site. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic
' inspection to insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance-oriented, requiring protection
' of existing natural resources and adjoining properties. If, following the commencement of this
project, the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66),

' FINDING OF NO SIGNIFICANT IMPACT
ENVIRONMENTAL ASSESSMENT FOR THE TOWN OF CARVS WEST CARY
' REGIONAL PUMP STATION AND FORCE 1N1LAIN .
' Pursuant to the requirements of the North Carolina Environmental Policy Act (N.C.G.S. § 113A-
1, et seq.), an environmental assessment (EA) has been prepared for the Town of Cary's
proposed construction of Phase I of the West Cary Regional Pump Station in the Green Level
' area seven miles west of downtown Cary, and approximately 38,887 feet of related gravity
sewerlines and force main. The project is proposed as result of growth in the Jordan Lake basin
and will reduce interbasin transfer out of that basin.
' The facilities will serve Cary wastewater sub-basis W7 and W8 as illustrated on figures within
the EA and which comprise 6.82 square miles. The capacity of the proposed pump station is
2500 gallons per minute. The sewer line alignments are described and illustrated within the EA.
Three project alternatives were analyzed for the EA including: private on-site collection and
treatment, and taking no action. The preferred alternative was selected as it was determined to
be the best solution to accommodate the development types and' density indicated in Cary's
growth management plan and as indicated above due to interbasin transfer issues. Alternative
site locations for the pump station and various sewer line alignments were also analyzed.
' Direct impacts have been avoided and minimized to the extent practical during project planning
and design. The proposed pump station will be on previously disturbed land and the proposed
sewerline has been routed to minimize impacts. Unavoidable permanent direct impacts have
' been reduced to 18 acres if forest impact, 2.30 acres of wetland impact, and 18 stream crossings.
Further mitigation may be warranted during the 404/401 permitting process as may be required
by the appropriate permitting agency. A comprehensive plan for mitigating the project's
' secondary and cumulative impacts is included within the EA's appendix and describes various
Town of Cary regulations.
' Based on the findings of the EA and on the impact avoidance/mitigation measures contained
therein, the Division of Water Quality has concluded that the proposed project will not result in
significant impacts to the environment. This EA and Finding of No Significant Impact are
' prerequisites for the issuance of Division of Water Quality permits necessary for the project's
construction. An Environmental Impact Statement will not be prepared for this project. This
FONSI completes the environmental review record, which is available for inspection at the State
' Clearinghouse.
