We will not require a formal permit modification application or fee. You should send a cover letter requesting approval for the modification directly to Annette Lucas, she will review the proposal and once she is satisfied, will issue a letter of approval for everyone's files. The proposed stormwater management plan will need to meet 2007 Stormwater BMP manual, and you must submit the DWQ stormwater supplement forms with your plan. The supplement forms can be found on our website at: http://h2o.enr.state.nc.us/ncwetlands/stormwater managment plans.html Please copy me when you submit your plan to Annette. The fax contained a copy of the US Army Corps of Engineers "No Department of the Army Autborization Required" tear sheet. Daryl stated that since the Corps will not be issuing a 404 Permit on this project, the 401 that was issued by NC DENR - Division of Water Quality is void.. Without a. 404 from the Corps, there is n.o need .for. the 401 Permit. Daryl reminded me that we are still obligated to comply with erosion and sedimentation control requirements as well as NPDES requirements on the project. The Division of Water Quality has already issued a 401 water. Quality Certification for this project based on the assumption that the Corps would issue and Individual permit for the project. Now that the Corps will not be issuing a 404 Permit, what happens with. the DWQ 401. Water. Quality Certification?
