The previously approved design called for two (2) side-by-side 8 ft. x 8 ft. box culverts. This would have over -widened the existing +/- 10 ft. wide stream by more than 6 ft. (accounting for the adjoining culvert walls), potentially resulting in stream instability. The new design calls for a single (1) 12 ft. high x 8 ft. wide box culvert embedded 1 ft. below the existing stream bed elevation. This design more closely matches the actual base flow width and cross sectional area of the stream and should ensure better stream stability. Also, we believe the significant amount of natural stream bedload (gravel and cobble, most of which is quartz) should be more than adequate to quickly back fill the culvert and allow for natural stream bed material within the culvert, promoting aquatic life passage. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The permittee had a wetland delineation completed for the entire property in order to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable As stated in the previous application, lots were designed with property lines along drainageways. Utilities will run within the road right of way. At Impact W1 (Inset A), the road alignment was determined to both minimize wetland impacts, but also suitable soil areas needed for septic systems and the requirement to be a collector road by Harnett County. It was aligned to cross at the narrowest section of the wetland in this area. Shoulder slopes at the road crossings were made steeper to reduce wetland impacts by approximately 2,200 sf from a previous plan. Since the original permit, the culvert at Stream Impact S1, S2 & S3 (Inset B) was redesigned to avoid overwidening the stream and provide for better aquatic life passage and stream stability (as stated in section C.3i. above). 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. A sediment and erosion control plan will be approved for the project that will include all appropriate BMP measures (silt fencing, etc.). We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in-fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Andrews Chapel project is a residential development. Additionally, the project is located within Harnett County jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post-construction stormwater management requirements; and 2) WS-I V,-HQW DWR water supply and high quality water classification regulations. We anticipate that the DWR will advise us if any additional information is needed. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility.
