I have some good news regarding Belmont Lake Preserve (formerly Ford's Colony). As of yesterday,
Halle now owns the Ford's properties with BLP! They worked out a deal with the Ford's and have
purchased all remaining properties owned by them within BLIP. This means that Belmont Lake Drive
can now stay in the same previously permitted location. That said, they are looking into alignments
that further minimize and avoid impacts. They are also going through the entire development plan and
reducing or avoiding previously permitted impacts wherever possible. I should have a preliminary
development plan / impact exhibit soon. From that S&EC will go back out and re -delineate the impact
areas, our updated delineation will be surveyed and updated designs and impact maps prepared.
This will take a few months to work out. I would anticipate us submitting the modified IP application
later this year (late Fall most likely).

Quick update - The meeting with the Ford's and Halle Companies went great yesterday. It looks like
they have come to an agreement for Mr. Halle to purchase the Ford's property within Belmont Lake
Preserve. This should allow them to leave Belmont Lake Drive in the current location with minimal
changes to the previously permitted impacts, and to apply for a single new permit. They still have
some details to work out, but I hope to be back on track with the new IP application in the next few

I just heard from the owners that negotiations with the Fords have once again failed. They are looking
into other options at this point to provide acc- between - northern and southern portions of
BLP. They hope to be in touch soon with their proposed solution and intended permit

I just got off the phone with James. I understand that the Corps intends to send out a letter to the
Fords and another to Belmont Lake Preserve e • • the compliance issues and resolution
options. Obviously, Belmont Lake Preserve understand what they need to do are progressively
moving forward with revised plans and the after -the -fact permit application. James needs
• clearly understand who owns the property at each •act location.explained already has
surveys underway to accurate locate the property boundaries at each •act location.

I provide you with a quick update on our progress. Please see attached email from the project
engineer, Nils Joyner.

I am sorry it has taken this long to get back to with the information needed for the impacts at
Belmont Lake Preserve (aka Ford's Colony). Providing the impacts that Belmont want to keep got
complicated when the Ford's decided that they wanted to swap their land for other land in NC
that Mr. Halle owns. We made several counter suggestions to the Ford's including jointly doing
the restoration and pipe removal (between the two properties). After we told the Ford's that we
had no interest in the land swap, the Ford's have been unresponsive.
Since there is no possible joint application, we want to proceed with the permit application. We
need some extra time to submit the revised alignment to the City of Rocky Mount. Belmont is a
"Plan Unit Development (PUD)" zoning. The City of Rocky Mount Zoning requires that the
revised PUB Development Plan be submitted to Planning Board and Council. 1 think we need to
get the re -alignment approved before finalizing the impact permit. USACE have been very
gracious to us and we want this issue to be resolved. As you know we have been waiting almost
30 days for the Fords to respond with no response more recently. We willfully cooperate with
USACE but we need a few more weeks to get the PUD approved. Please let me know if you
believe this will be a problem.

I think it's obvious from the emails below, that the two owners just aren't going to come to an
agreement.
As a follow up to our site meeting on May 24, 2016 at Belmont Lake Preserve (BLP), you requested
that we provide notice within 30 days (being this Friday, June 24th) as to our intentions to request
wetland permits for the development.
Unfortunately, the owners of BLP were unable to come to an agreement with the Ford's to allow for
the submittal of a joint application, to include the stream and wetland impacts associated with the
existing alignment of Belmont Lake Drive (BLD). As such, BLP intends to proceed with a revised site
plan that avoids the need for this section of BLD on the Ford's property.
We understand that any existing impacts for this section of BLD will need to be removed and the
stream and wetlands restored. This work will be the responsibility of the owner for which the impacts
exist.
In the coming weeks, we intend to provide the Corps and DWR with the revised BLP site plan,
preliminary impact exhibits and a conceptual plan for the removal and restoration of any existing
impacts no longer needed. We then intend to submit an after -the -fact Individual Permit application for
this revised site plan, once we have received your preliminary review comments and guidance.
Please feel free to contact me if you have any questions regarding the BLP project. Otherwise, expect
to see our preliminary plans sometime before August 1St

I have the same question for you how do you plan on accessing your property ,you bought the property this is your doing.
We would be willing to grant access but there would be land dedication ,shared expense of improvements and joining the
HOA for future repairs. Or you could check with the other landowners and see if an easement can be purchased from
them it's your choice. I will check on the mulch piles if they're on your land we will remove them. We will grant access for
you to repair all of your impacts under our supervision iany and all damages would need to be repaired 100% so we would
want a irrevocable letter of credit for an amount to be determined in the future to ensure we are protected from your
subcontractors

Our agenda can be somewhat fluid, but for the most part we have representatives from
