Enclosed are the revised Pre-Construction Notification and copies of other required documents. We believe these documents address the concerns specified in Joanne Steenhuis' review letter of September 12, 2008. We provided the permit application fee of $240.00 with our submittal dated August 11, 2008. Please recall that we previously notified you of unauthorized work that has occurred in wetland areas located on the project site. As shown on project plans, the location of the wetlands prevents access to the rear of the property. Due to our client's inexperience with subdivision development and related wetland issues, fill was inadvertently placed in wetlands to create a stream crossing to access the rear portions of the site. The placement of fill occurred following receipt of the state stormwater permit for the subdivision, which Mr. Davis believed to be authorization for this work. As we stated previously, Mr. Davis is now aware of the regulatory requirements and has stopped all work in the area of the wetlands. He is eager to obtain all required permits and authorizations. Copies of this package are being concurrently sent to Brad Shaver with the US Army Corps of Engineers and Joanne Steenhuis in the Wilmington Regional Office. Vinson, AICP Enclosures Shadowcreek Estates, LLC Shadow Creek Estates Subdivision Onslow County October 15, 2008 Shadowcreek Estates, LLC proposes to construct roads, utilities, stormwater management facilities, and other infrastructure to serve a 54-lot low-density subdivision to be known as Shadow Creek Estates. The project is located on a 32.87-acre tract on NCSR 1509 (Queens Creek Road) approximately 2.0 miles south of its intersection with NC 24 in Swansboro Township, Onslow County. The site is within the White Oak River basin and drains into Parrot Swamp. The subdivision has received preliminary approval from the Town of Swansboro and state stormwater and erosion control permits have been issued. A wetland delineation was approved by the US Army Corps of Engineers in June 2008. Clearing, grading, and installation of utilities have begun; otherwise the site is undeveloped. Shadow Creek Estates subdivision will consist of one phase. The current submittal covers the full project. No future development is planned that would result in additional impacts to nearby downstream water quality. The project is located on a former timber tract. The stream and wetlands on the site are thought to have been previously modified. Long-time residents of the area state that logging paths located throughout the property crossed the stream and other wetlands. Although the site has been partially cleared, there is some evidence remaining of these paths crossing wetland areas. Additionally, sections of the stream appear to have been previously straightened. The site contains 5.73 acres of wetlands. Proposed impacts include one road crossing at the stream (Impact 1) that includes utility crossings, sidewalks, and a culvert pipe with one riprap scour pad (Impact 1-A). Additionally one shared driveway to serve lots 41 and 42 will cross a narrow "finger" of wetlands to the north of the stream impact (Impact 2). Wetland impacts will total 0.105 acre; stream impacts will affect 68 linear feet. Pittman Soil Consulting examined the project site and determined that while the proposed road will cross a perennial stream, the shared driveway impacts will be to an ephemeral channel. Staff of the NC Division of Water Quality (DWQ) subsequently inspected the site on September 4, 2008 and concurred with the findings of the soil scientist regarding the two wetland features. The subdivision was designed to minimize the number and impact of wetland/stream crossings needed to access the rear portions of the property and make the site buildable. The proposed road (Impact 1) was designed to cross the stream at a single location (between lots 24, 25 and 42, 43), and at a relatively narrow portion of wetland. A 48" pipe will be partially buried under the road to assure continued flow of the perennial stream and continued movement of any aquatic life in the stream. Shadowcreek Estates, LLC October 15, 2008 Page Two The size of the rock riprap scour pad at the road crossing has been limited to 8' to reduce impacts as much as possible while still preventing erosive velocities at the outlet. The proposed sidewalks on either side of the road have been pulled in close to the road (2' off the back of curb) in the area of the crossing. Utility crossings at this location will be placed under the road and sidewalks. Retaining walls are proposed here as well, rather than sloped earthen embankments, to further reduce the impact area. There are no proposed utility crossings outside the shoulder of the roadway. Although a bridged crossing was considered as an alternative to the road crossing, this option was determined to be financially prohibitive due to the limited number of lots (18) beyond the crossing and its location over a narrow section of the stream (f 2' in width). Additionally, since the road will be turned over to the Town of Swansboro, it must be built to standards contained in the Town of Swansboro Unified Development Ordinance. The local ordinance contains no provisions for bridges. A representative of the NC Division of Marine Fisheries (DMF) inspected the site on September 19, 2008. The representative indicated to the project consultants that installation of the culvert and riprap scour pad, and other components of the proposed road crossing design, would be acceptable to the agency. She agreed that due to the narrow stream width, and the proposed design of the road crossing, no bridge would be necessary or required by DMF at the site. Driveway access over the wetlands is required to develop lots 41 and 42. The shared driveway (Impact 2) will affect a smaller area of wetlands than would two separate driveway crossings. A culvert pipe is to be placed within the channel under the proposed shared driveway to allow continued flow of any runoff within the channel. The location of the shared driveway and associated drain pipe will be established in the field by the surveyor to assure its proper location. As previously noted, the wetland area to be crossed by the shared driveway has been determined to be an ephemeral channel by the soil scientists and DWQ. Elevated pedestrian footbridges, constructed to USACE standards, are proposed for access to rear portions of lots 42, 43, 46, and 47. The locations of the footbridges are shown on the enclosed plat to be recorded with the restrictive covenants for the subdivision. Wetlands are found on the rear portion of other lots in the subdivision; however, the locations of wetlands on other subdivision lots do not create accessibility issues. Therefore, no footbridges are proposed for the other lots containing wetlands. Shadowcreek Estates, LLC October 15, 2008 Page Three The mitigation plan for this project consists of preservation of the remaining (non- impacted) wetlands on the site and compensatory mitigation for the wetlands and stream losses resulting from the development. Restrictive covenants acceptable to the USACE for the purpose of preserving the remaining wetlands will be prepared by an attorney and recorded prior to the sell or conveyance of any lots or property in the subdivision. A sample of the restrictive covenant language to be recorded is included with this submittal, along with maps of conservation areas (with proposed wetland and stream impacts designated) to be recorded with the covenants. All wetland areas, with the exception of permitted crossings, are to be conserved. Permitted crossings are anticipated to be Shadowcreek Drive, a shared driveway for lots 41 and 42, and pedestrian footbridges for lots 42, 43, 46, and 47, per this submittal. Purchase of wetland credits from the Hofrnann Forest wetland mitigation bank (North Carolina State University) and stream credits from the NC Environmental Enhancement Program (EEP) have been approved for this project. Copies of acceptance letters from both mitigation banks are attached. Mitigation is proposed at a 1:1 ratio; however, both programs have offered additional credits. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately- 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. C. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, piping, and the flow spreader mechanism. g. Maintenance of level spreaders. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area or to the drainage area. e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, piping, or altering any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. Once the lot transfer is complete, the built-upon area may not be revised without approval from the Division of Water Quality, and responsibility for meeting the built-upon area limit is transferred to the individual property owner. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 8. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 9. Each lot in the subdivision covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 10. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the Register of Deeds prior to the sale of any lot. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. A 48' pipe will be buried (depressed) two feet in the stream bed to allow for continued movement of the stream. To further limit impacts to the stream the rip-rap scour pad associated with the road crossing has been reduced to extend only 8 linear feet (originally designed for 321.f) Proposed sidewalks have been pulled in close to the road in the area of the crossing. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). Updated 11/1/2005 n _ 1A rig Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. The mitigation plan for this project consists of preservation of the remaining _(non- impacted) wetlands on the site and compensatory mitigation for the wetlands and stream losses resulting from the development. Restrictive covenants acceptable to the Corps of Engineers for the purpose of maintaining the remaining wetland areas as conservation areas in their natural state in perpetuity shall be recorded prior to the sell or conveyance of any lots or property in the subdivision. Sample restrictive covenants and accompanying maps of conservation areas to be recorded are attached. Compensatory mitigation at a 1:1 ratio through payment into the NC Ecosytem Enhancement Program (for 68 feet of stream mitigation ) and the Hoffinan Forest wetland mitigation bank (0.105 acre) is also proposed. Copies of acceptance letters from both mitigation banks are included with this submittal. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form.
