Johnston County
The Division of Water Resources (Division) recently reviewed the proposed stormwater management plan
(SMP) for the subject project as required by Individual 401 Water Quality Certification #3766 issued by the
Division on March 15, 2010. Submittal of the SMP satisfies Condition No. 9 of the 401 Certification for this
Phase of the project and is subject to the requirements below.
1. The Division approves this phase as a low density development with impervious surface area of less
than 24% and a stormwater drainage system that consists primarily of vegetated conveyances. The
following conditions also apply [15A NCAC 02H .0506(b)(5)1:
a. A deed restriction shall be placed on the tract in order to limit the amount of impervious
surface area to less than 24%. [15A NCAC 02H .0506(b)(5)]
b. This tract shall be held, transferred, sold, conveyed, developed and occupied subject to the
requirement that upon development of this tract, the then owner shall develop a stormwater
management plan approved by the Division if the total impervious area resulting from
development of the Property is 24% or more of the total area of the Property. [15A NCAC 02H
.0506(b)(5)]
c. This restriction contained herein shall be binding upon the owner's successors and assigns,
and shall be perpetual and run with the land until released or amended by a release or
amendment approved by the Division. [15A NCAC 02H .0506(b)(5)]
d. These two documents shall be filed with the Register of Deeds, Johnston County, North
Carolina. [15A NCAC 02H .0506(b)(5)]]

e. If a compliance inspection reveals an impervious surface area of 24% or greater, then you will
be in violation of this Condition and required to comply with the requirements of General
Certification 3890. [15A NCAC 02H .0506(b)(5)]
Maintenance activities shall be performed as necessary to ensure that all vegetated
conveyances remain adequately vegetated. [15A NCAC 02H .0506(b)(5)]
g. The Division approves the grading and drainage patterns depicted on plan sheets submitted
August 2, 2017 as meeting state requirements for diffuse flow. The plans are incorporated by
reference and are enforceable by the Division. Additional drainage swales that are not shown
on the plans may not be added in the future without appropriate diffuse flow devices and
approval from the Division. [15A NCAC 02B.0233(5)]
