This letter serves as the initial evaluation for the proposed Cripple Creek Stream and Wetland
Mitigation Bank Prospectus and Mitigation Plan, which was received on June 20, 2008. The
proposed plans are to restore 6.9 acres of wetlands and 4,265 linear feet of stream channel and
enhance 1.9 acres of wetlands and 633 linear feet of stream channel. A public notice for the
proposed mitigation bank was issued on July 10, 2008 and the written comments from the
Interagency Review Team (IRT) members and one adjacent property owner were received and
forwarded to you via electronic mail dated August 27, 2008.
Based on our review of the prospectus and mitigation plan, our previous site visit to the
proposed bank and the written comments provided in response to the public notice, we have
determined that we will accept a draft instrument for the proposed Cripple Creek Stream and
Wetland Mitigation Bank. You provided a revised prospectus and draft mitigation banking
instrument for this project on September 30, 2008. We will review these documents and make a
determination regarding whether they are complete as described in 33 CFR Part 332.8 (d)(6). If
we determine the draft instrument is complete, we will forward the additional copies you
provided on September 30, 2008, to the IRT members.
