(CEC), on behalf of Mr. David Day regarding Scenic View terrace. The permit application requested written authorization for the After-the-Fact (ATF) impacts associated with development of a residential community. The DWQ determined that the application was incomplete and/or provided inaccurate information and requested four additional items for review. These items will be discussed below. 1. DWQ -Please resubmit your plans on full plan sheets at a scale of no smaller than I "=50' with topographic contours shown. Five full size plans at 1 "=50' scale are enclosed. 2. DWQ -Please provide a predevelopment detailed map including all stream features, topographic features and contour lines, on the subject property at a scale of no smaller than 1 "=50'. Five full size plans at I"=50' scale are enclosed showing the predevelopment topography. There were no delineations ever conducted on the property. So the predevelopment impact stream wetland map does not exist and those features are unknown at this point. DWQ -Please provide a detailed map delineating previously approved fill and additional fill areas. Plan sheet 7A identifies the approximate area of the previously authorized 150 linear feet of stream fill area. CEC was not able to locate a copy of the original permit application or impact map from the applicant or the Corps of Engineers. 4. DWQ - 400 linear feet of compensatory stream mitigation is required for this project. Please provide compensatory mitigation plan... Your mitigation plan proposes 469 linear feet of stream enhancement, however, this proposal would only generate 234 linear feet of stream mitigation credits. Please provide your complete mitigation plan. The applicant proposed to compensate for stream impacts by conducting Enhancement 1 mitigation activities at a 1.5:1. The applicant has proposed to construct step pools (profile) where necessary and stabilization of stream banks through sloping (dimension) and vegetation planting. Under this scenario the applicant would obtain 312 linear feet of credit towards the mitigation. Scenic View Terrace is proposing to mitigate the additional 88 linear feet of stream by payment into the EEP (letter attached). The information submitted in this package addresses all issues set forth in the "Request for More Information" letter. CEC believes the totality of this information allows DWQ to conclude that the applicant has addressed concerns and recommendations in the letter.
