REQUEST FOR MORE INFORMATION
Dear Mr. Cox,
The Division of Water Quality (DWQ) received your application for a 401 Water Quality Certification for
the subject project on September 8, 2008. Barry Love of this office has reviewed the application and inspected
site on October 1, 2008. Based on this review, 5 copies of the following information/comments are needed:
o A vicinity map showing area roads, streams and any other topographically significant identifiers to
allow someone to locate the anticipated impacts site, preferably shown on a USGS 1:24,000
topographic quad.
o A cross-section and profile of the stream crossing showing that the culvert is properly buried in the
streambed to allow passage of aquatic life and maintenance of a low flow stream channel. One
culvert should be lower than the other to maintain the low flow stream channel through one while
the higher can be accessed during higher storm flows.
o In measuring the linear feet of stream impact on the plans, approximately 180 linear feet of impact
is shown (including the riprap dissipater) while only 111 linear feet is being applied for. Note that
stream impact is measured along the centerline of the stream and not the length of culvert and
riprap. Please address this discrepancy. Also, note that a higher permit fee is required if 150 or
more linear feet is impacted.
o The submitted application does not adequately address avoidance and minimization. Efforts should
be taken to reduce the length of impact such as the use of headwalls, reduced riprap length, moving
the crossing to a straighter section of stream and other such measures.
o During the site visit, the stream was found to be perennial. Please modify the impacts page of the
application to reflect this. Note that if 150 or more linear feet of perennial stream is impacted, then
mitigation must also be addressed. Minimizing impacts should help to avoid this. one

Ms. Annette Lucas of the 401 Oversight/Express Review Permitting Unit has also reviewed the application
in regard to stormwater requirements. Based on her review, the following information is needed:
1. Please clarify if the undisturbed areas in the eastern and western portions within the project
boundary shall be developed or not in the future.
2. Explain why you will need a stormwater wet pond after the Bioretention cell. In addition, wet
ponds are generally not suitable for small drainage areas.
3. Please clearly delineate the pretreatment device (forebay) area for each of the two bioretention cells.
If a riprap lined entrance is used as a forebay, it shall be clearly shown with contours and elevations
(depressed section for sediment accumulation) to separate it from the main cell.
4. Please check the elevations of the concrete weirs in the outlet structures of the Bioretention cells.
The weir elevations shall be set at the ponded water elevation to allow the water quality runoff to
infiltrate through the soil media while the volume in excess of the water quality volume overflows
the weir and bypasses the BMP.
5. Please submit three (3) copies of all supporting information pertaining to this project
including:
a. Design calculations for the proposed BMPs sized for both on-site and off-site
drainage;
b. BMP supplement for each of the proposed BMPs and Required Items
Checklist (available at http://h2o.enr.state.nc.us/su/bmp forms.htm) along
with all required items;
c. A signed and notarized Operation & Maintenance Agreement for each of the
stormwater management devices and associated appurtenances.
Pursuant to 15A NCAC 2H .0507(h) this project will be put on hold until such time as the requested
information has been received. Please respond in writing within 30 calendar days of the date of this letter by
sending the required information to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail Service
Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that
timeframe, please provide written confirmation that you intend to provide the requested information, and
include a specific timetable delineating when the requested materials will be provided. If we do not hear from
you in 30 calendar days, we will assume that you no longer want to pursue this project, and we will consider the
project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested in your application are not authorized at this time
