Generally speaking, clean-up of sediment and erosion control -related releases into waters of the US including streams and wetlands would be under the purview of the NC Division of Water Resources. In circumstances where these sediment and erosion control releases are associated with projects permitted by the Corps, we would generally expect the following: All sediment, 57 -stone, etc. should be removed from jurisdictional areas and relocated to (and stabilized in) uplands. Care should be taken not to over excavate in the cases of wetlands/riparian area and err on the side of caution (i.e. leaving a skim layer of less than %" is preferable to removing the top layer of soil in these areas). Appropriate seed mixes should be cast over these areas (i.e. riparian mix for areas adjacent to streams, wetland mix in wetland areas - rather than the typical seed mixes intended for use in the upland areas/shoulder/slope stabilization). Then a layer of straw mulch should be scattered to insure the seed remains in place. In the case of stream clean up, hay bales (if appropriate for stream size) should be used at 30 to 50 ft intervals within the stream and the crew should work their way downstream. The hay bales will catch any sediment that gets disturbed during the cleanup. Again, care should be taken not to OVER excavate within the stream channel. In the case of areas where the channel is too wide or too deep, we recommend the use of turbidity curtains OR sheet piling and pumping down the area to remove the sediment (as appropriate). All removed material should be removed to an upland area. Please make sure that all devices are repaired and functional per S&EC agency requirements. During inspection of E&SC measures after a 0.81" rain event which occurred within one hour, Dana Newcomb discovered sediment loss from the E&SC measures behind the Warehouse (ROCKI- 2014-008 Addendum (Final Grading - Approved 5/3/2017). I have attached photos for your review. The BMPs installed included silt fence and rock check dam as per the approved E&SC plan to prevent sediment loss during installation of the sediment basin. The rain event caused enough velocity that the sediment undermined the check dam and entered the downstream intermittent stream. The intermittent stream flows to a perineal stream. The sediment appears to have settled along the intermittent stream with a small amount of sediment at the perineal stream edge (photos Sed -1, Sed -2 & Sed - 3). The length of the intermittent stream was estimated to be 0.1 mile in length with an average of 0.5" of sediment deposited. Duke Energy estimates the volume of sediment loss at 1.5 cubic yards. Corrective measures include installation of fabric behind the refreshed 57 stone to help prevent undermining of the rock check in the future. Additional rock checks with larger riprap, fabric, and 57 stone have been installed. Areas have been dugout deeper to create stilling basins prior to the rock checks. Additional energy dissipaters have been installed around the perimeter of the basin structure to collect sediment until the basin construction can be completed.
