The purpose of this project is to prevent flooding and maintain the water quality benefit of the Waverly and Marlwood Ponds. Preliminary Jurisdictional Determination On April 5 and 10, and May 13 and 14, 2013, CWS scientists Thomas Blackwell, Professional Wetland Scientist (PWS), Gregg Antemann, PWS, and Kelly Thames, PWS delineated jurisdictional waters of the U.S. within the project area (Figure 4, attached). On -Site jurisdictional features were field -verified by Mr. Steve Kichefski of the USACE in 2014, and a Preliminary Jurisdictional Determination was issued on September 29, 2016 (SAW -2013-01583, attached). However, during a site visit in April 2017, CMSWS noted potential jurisdictional wetlands in Pond B and contacted Ms. Chrystal Amschler of the USAGE. Ms. Amschler visited site on June 20, 2017 and requested a re -delineation of the area previously labeled as Pond B. On July 20, 2017, CWS scientists Aliisa Harjuniemi, Wetland Professional in Training (WPIT) and Sean Martin, Senior Scientist, re -delineated jurisdictional waters of the U.S. within the feature labelled as Pond B in the previous delineation dated May 2013. Based on the re -delineation and reviewing the aerial imagery, approximately two thirds of the Pond B was reclassified as a wetland (extension to the Wetland BB). This General Permit application document has been revised according to the re -delineation of the aforementioned features and the amendment to the previous Preliminary Jurisdictional Determination Request is attached. This amendment includes a revised Jurisdictional Boundary Map with updated pictures and data forms of the revised feature and a revised Preliminary Jurisdictional Determination form (note: only the revised documents are included in this amendment). The on-site jurisdictional features are also depicted on Figure 4 (attached) and in Table 1 (next page). Agency Correspondence Cultural Resources A letter was forwarded to the North Carolina State Historic Preservation Office (SHPO) on October 5, 2016 to determine the presence of any areas of architectural, historic, or archaeological significance that would be affected by the project. In the response letter dated October 20, 2016, the SHPO states that they "are aware of no historic resources which would be affected by the project." A copy of the SHPO response letter is attached. CWS also consulted the North Carolina SHPO online GIS service' and Classifications of streams include Traditionally Navigable Waters (TNWs), Relatively Permanent Waters (RPWs), and Non -Relatively Permanent Waters (Non-RPWs). Subcategories of RPWs include perennial streams that typically have year-round flow, and seasonal streams that have continuous flow at least seasonally. Two classifications of jurisdictional wetlands are used to describe proximity and connection to TNWs. These classifications include either adjacent or directly abutting. Adjacent wetlands are defined as wetlands within floodplains or in close proximity to a TNW but without a direct visible connection. Page 3 of 10 Marlwood and Waverly Pond and Dam Improvement Project July 31, 2017 Regional General Permit # 163 CWS Project No. 2016-4094 Charlotte -Mecklenburg Historic Landmarks Commission4 database and found no historical structures, buildings, or historic districts within the project limits. Protected Species CWS performed a data review using the North Carolina Natural Heritage Program (NCNHP) Data Explorers on October 5, 2016 to determine the presence of any federally -listed, candidate species, endangered species, threatened species, or critical habitat within the project area. Based on the NCNHP review, there are no records of federally -protected species within the project limits or within a mile of the project site. A copy of the data review report is attached. Northern long-eared bat (Myotis septentrionalis) The Northern long-eared bat (NLEB) is one of the species of bats most impacted by the white -nose syndrome disease. Habitat for the NLEB includes forested areas of any age, rocky areas with boulders, and culverts greater than four feet wide. Due to recent population declines of almost 89% caused by white -nose syndrome (WNS) and continued spread of the disease, the NLEB now receives protection as a Threatened species under the Endangered Species Act. A Threatened species is defined as a taxon likely to become endangered within the foreseeable future throughout all or a significant portion of its range.b This project takes place within the Northern long-eared bat habitat range. However, there are no known mature roosting trees or hibernacula recorded in Mecklenburg County per The U.S. Fish and Wildlife Service (USFWS) published GIS data.' Therefore, per the Final 4(d) Rule the project is exempt. The USACE project manager will make the final determination if consultation is necessary under Section 7. Purpose and Need for the Project The current conditions of Waverly Pond (Pond A) and Marlwood Pond (Pond B) do not meet the current City of Charlotte design standards (Figure 4 and Photographs 1-3, attached). Waverly Pond and Marlwood Pond are impoundments of McAlpine Creek. Both ponds exhibit failing dams, failing outlet structures, undermined weirs and spillways, and voids are forming underneath the dams. These failures have resulted in the flooding of Albemarle Road and south Marlwood Circle due to structure failure and overtopping of the pond embankments. This has resulted in damage to the spillway areas, weakening of the pond embankments, and weakening of road integrity. Moreover, the flooding of Albemarle Road and south Marlwood Circle results in hazardous road conditions that pose safety concerns for neighborhood citizens. Therefore, the purpose of this project is to prevent flooding and maintain the water quality benefit of the Waverly and Marlwood Ponds. Additionally, improvements must be made in such a way that the downstream Federal Emergency Management Act (FEMA) floodplain of McAlpine Creek will not be impacted. The project proposes to replace the weirs of both ponds in the footprints of the original structures. The upgraded, proposed weirs will be keyed down to the dam in order to better secure the structures in place. The voids in the dam embankments will be filled and stabilized. The spillways are required to dissipate flow velocities and prevent erosional forces from undermining the dams during large storm events when the weirs are utilized. Additionally, the removal of accumulated sediments in both ponds is necessary in order to increase the the capacity of the ponds. This will allow for the necessary water storage and constant release of flow from the pond, thereby helping to eliminate `flashy' flows during high-flow events. The proposed dam improvements and the associated sediment removal will not change the surface water area of either pond. Marlwood Circle is a circular road that crosses Marlwood Pond twice. Therefore, for the purposes of this permit, north Marlwood Circle and south Marlwood Circle are utilized to distinguish between the two crossings. Avoidance and Minimization The project was originally designed to avoid all impacts to wetlands; however, over the long life of the project in the design phase, some area of previously delineated open water is now wetlands. At this point in time, it is not feasible to abandon the project (safety hazards, easement acquisitions, costs, etc.) and as such, impacts to the newly delineated wetland areas are unavoidable. Impacts to on-site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable. Proper sediment and erosion control measures will be used to minimize disturbances to downstream waters. Construction activities and impacts to on-site jurisdictional waters of the U.S. will comply with all conditions of RGP 163/GC4100. All work will be constructed in the dry. Permanent impacts have been limited to 129 linear feet of jurisdictional stream channel. No Action Alternative In an attempt to minimize impacts to jurisdictional waters while still meeting the goals of the project, a "No Build" alternative was considered. The goal of this project is to prevent flooding and maintain the water quality benefit of these ponds.. A "No Action" option would not meet the project goals to meet the the current design standards for the City of Charlotte and would continue to pose threats to the current pond embankments, roads, and citizens as the embankments and spillways are currently in a state of failure. Therefore, the No Action Alternative was eliminated from further consideration. Page 5 of 10 Marlwood and Waverly Pond and Dam Improvement Project July 31, 2017 Regional General Permit # 163 CWS Project No. 2016-4094 Alternative Designs Alternative Design I Alternative Design 1 proposed piping the entire stream reach between Waverly Pond and the existing culvert beneath Albemarle Road (Figure 5, attached). This would result in 138 linear feet of impact to jurisdictional stream. This design also proposed eliminating the weir and spillway at Marlwood Pond and piping the pond outlet to the existing culvert beneath south Marlwood Circle (Figure 5, attached). This would result in 184 linear feet of impact to jurisdictional stream, totaling 322 linear feet for Alternative Design 1 (Table 2, below). It was determined that there were other options with fewer impacts to WOTUS and therefore, this alternative design was rejected. Alternative Design 2 Alternative Design 2 proposed elevating the dam embankment of Waverly Pond to allow for an additional foot of freeboard during storm events and to pipe the outlet of Marlwood Pond to the existing culvert beneath south Marlwood Circle (Figure 6, attached). The elevated dam at Waverly Pond allows for additional impoundment of waters during normal flow events that could potentially flood approximately two acres of wetlands upstream of Waverly Pond (Figure 6, attached). This design would also cause potential flooding impacts to adjacent residences and roads during large flood events. The proposed pipe at Marlwood Pond would impact 184 linear feet of impact to jurisdictional stream (Figure 6, attached). The proposed impacts associated with Alternative Design 2 totals approximately two acres of wetland impacts and 184 linear feet of stream impacts (Table 2, below). As a result of the potential to flood roads and residences, and the number of impacts to wetlands, this option was eliminated from further consideration. Proposed Design The proposed plan has been thoughtfully designed to avoid impacts to jurisdictional waters of the U.S. wherever practicable while still meeting the goals of the project to reduce flooding and maintain the existing water quality benefits of the ponds. The proposed dam improvements proposed are depicted in Figure 7 (attached). Dam, weir, and spillway improvements at Waverly Pond consist of replacing the failing weir and upgrading the existing rip rap spillway, resulting in 94 linear feet of impacts to jurisdictional stream (Figure 8, attached). Dam, weir, and spillway improvements at Marlwood Pond at south Marlwood Circle consist of replacing the failed weir and adding additional rip rap to the existing spillway, resulting in 35 linear feet of impact to jurisdictional stream. The spillway improvements at Marlwood Pond will avoid impacts below the ordinary high water mark for the majority of the existing spillway (Figure 9, attached). An existing culvert at north Marlwood Circle will be replaced linear foot for linear foot between the north and south parts of Marlwood Pond (Figure 10, attached). The replaced culvert will be buried one foot below the existing stream bed to maintain aquatic life passage and low flows. This culvert replacement will not result in any impacts to jurisdictional waters of the U.S. Table 2 (below) summarizes the impacts associated with the alternatives analysis. Table 2. Page 6 of 10 Marlwood and Waverly Pond and Dam Improvement Project July 31, 2017 Regional General Permit # 163 CWS Project No. 2016-4094 The maintenance of the proper weirs and spillways will better regulate storm flows and will result in less flashiness of the flow in the system. These improvements will also help reduce erosion, and therefore, reduce sediment input to downstream waters. Both ponds will be temporarily dewatered as needed in order to perform the dam repair, weir replacements, and minor sediment removal. The temporary dewatering will occur at a slow rate that will not cause erosive degradation of downstream waters. All removed sediment will be disposed of in an appropriate upland location off-site and will comply with all conditions of GC 4100. The purpose of this project is to conduct maintenance and repair of existing ponds in order to meet the project objectives with minimal impacts to jurisdictional waters of the U.S. As the channels where the proposed repair and maintenance impacts will occur are currently rip rapped, this project will have minimal, temporary negative impacts to the on-site jurisdictional waters. Additionally, this project is designed to prevent and avoid impacts to the downstream FEMA floodplain of McAlpine Creek to the greatest extent practicable. Proposed wetland impacts consists of removing the accumulated sediment from the portion of the Wetland BB that was previously classified as a pond. We believe that the current proposed plan is the best possible plan that meets the project goals while minimizing impacts to jurisdictional waters of the U.S. to the greatest extent practicable. Proposed Impacts to Jurisdictional Waters Under RGP163 unavoidable permanent impacts to jurisdictional waters associated with this project are limited to a total of 129 linear feet of jurisdictional stream channel as needed to perform repairs on currently failing spillways and dam embankments and 0.62 acre of wetland due removal of accumulated sediment. Impacts to RPW Stream (McAlpine Creek) are the result of the replacement and addition of rip rip for spillways at both Waverly and Marlwood Ponds. These spillways are necessary in order to dissipate flow velocities exiting the ponds in large storm events, protect the weirs, and to stabilize pond embankments. Figures 8-10 (attached) depicts the proposed plan views and the proposed impacts are summarized in Table 3 (below). The ponds will be partially dewatered temporarily to reconstruct the dams and replace the weirs. During this process, some minor accumulation of sediment will be removed from the pond beds to restore the original capacity of the ponds. The removal of sediments within the ponds will not result in any impact to the surface water acreage of either pond. Table 3. Page 7 of 10 Marlwood and Waverly Pond and Dam Improvement Project July 31, 2017 Regional General Permit # 163 CWS Project No. 2016-4094 Permanent Impacts to McAlpine Creek: S 1 - Waverly Dam at Albemarle Road The proposed weir at Waverly Pond will be installed in the existing footprint of the original weir, resulting in no impacts to jurisdictional waters of the U.S. The proposed weir replacement will necessitate upgrades to the spillway in order to prevent a failure. The proposed rip rap apron replacement for the spillway associated with the weir replacement at Waverly Pond will result in 94 linear feet of permanent impact to McAlpine Creek (Figure 8, attached). The existing rip rap spillway is in disrepair and requires removal and regrading and will be re -rip rapped. This rip rap spillway replacement, associated with the weir replacement, at Waverly Pond dam is necessary to dissipate the flow velocities and prevent erosional forces from undermining the weir and downstream channel. Additional rip rap will be added beneath the spillway in non jurisdictional areas as well. The weir and channel improvements are necessary to repair the existing infrastructure currently failing and prevent catastrophic dam embankment failure resulting in loss of life and property and significant environmental impacts and damages. Permanent Impacts to McAlpine Creek: S2 - Marlwood Dam at south Marlwood Circle The proposed weir at Marlwood Pond will be installed in the existing footprint of the original weir, resulting in no impacts to jurisdictional waters of the U.S. The proposed weir replacement will necessitate upgrades to the spillway in order to prevent failure. Rip rap will be added to the existing spillway at Marlwood Pond and will result in 35 linear feet of permanent impact to the jurisdictional stream channel (McAlpine Creek; Figure 9, attached). This rip rap apron addition associated with the weir replacement at Marlwood Pond darn is necessary to tie in the weir replacement to the existing spillway, to dissipate the flow velocities and prevent erosional forces from undermining the weir, and prevent compromising the integrity of the embankment. The weir and channel improvements are necessary to repair the existing infrastructure currently failing and prevent catastrophic dam embankment failure resulting in loss of life and property and significant environmental impacts and damages. The existing channel will be preserved to the extent possible including maintaining the existing large pool area near the downstream culverts. Additionally, an existing submerged culvert between the north and south parts of Marlwood Pond at north Marlwood Circle will be replaced utilizing the footprint of the existing culvert (Figure 10, attached). The existing 40 -foot long, double barrel 36 -inch corrugated plastic pipe (CPP) will be replaced linear foot for linear foot with a 40 -foot long, 12 -foot wide and 5 -foot high reinforced concrete box culvert (RCBC). The replaced culvert will be buried one -foot below the existing bed to maintain aquatic life passage and flow between the north and south parts of Marlwood Pond (Figure 10, attached). This culvert is being replaced to provide additional culvert capacity and prevent overtopping of the road in frequent storm events and causing a dangerous condition. Permanent Impacts to Wetland BB: W 1 The proposed sediment removal via excavation within Wetland BB will result in approximately 0.62 acre of permanent wetland impact. This area was previously classified as a pond in the original delineation dated 2013 (Pond B), but due to sediment accumulation, this portion of Pond B now exhibits wetland characteristics. The removal of the sediment would convert the wetland back to its original open waters state. Due to the sediment accumulation, flooding, and edge effect to the adjoining open maintained area, this portion of Wetland BB scored LOW as assessed with North Carolina Wetland Assessment Methodology (NC WAM, attached). Page 8 of 10 Marlwood and Waverly Pond and Dam Improvement Project July 31, 2017 Regional General Permit # 163 CWS Project No. 2016-4094 Compensatory Mitigation Permanent impacts to the jurisdictional stream channels have been reduced to less than 150 linear feet. Therefore no mitigation for the proposed stream impacts is not required. As permanent impacts to jurisdictional Wetland BB total 0.62 acre, compensatory mitigation is required. The City of Charlotte Umbrella Stream and Wetland Mitigation Bank (Umbrella Bank) is a municipal mitigation bank in which the City of Charlotte and Mecklenburg County municipalities can purchase credits from in order to offset unavoidable impacts associated with infrastructure projects. This project is located within the Lower Catawba watershed (HUC 03050103). Proposed impacts requiring mitigation total 0.62 acre of permanent wetland impacts, which CMSWS proposes to mitigate for at a 1:1 ratio. The proposed ratio is based on the fact that the portion of Wetland BB proposed to be excavated is a low -quality feature as assessed with NC WAM due to extensive sedimentation, edge effect, and flooding (NC WAM Form, attached). CMSWS proposes to purchase credits from the Umbrella Bank in order to offset the impacts associated with this project. Please see the attached Mitigation Credit Reservation Letter. CWS performed a data review using the North Carolina Natural Heritage Program (NCNHP) Data Explorer on October 5, 2016 to determine the presence of any federally -listed, candidate species, endangered species, threatened species, or critical habitat within the project area. Based on the NCNHP review, there are no records of federally -protected species within the project limits or within a mile of the project site. A copy of the data review report is attached. Northern long-eared bat (Myotis septentrionalis) The Northern long-eared bat (NLEB) is one of the species of bats most impacted by the white -nose syndrome disease. Habitat for the NLEB includes forested areas of any age, rocky areas with boulders, and culverts greater than four feet wide. Due to recent population declines of almost 89% caused by white -nose syndrome (WNS) and continued spread of the disease, the NLEB now receives protection as a Threatened species under the Endangered Species Act. A Threatened species is defined as a taxon likely to become endangered within the foreseeable future throughout all or a significant portion of its range. This project takes place within the Northern long-eared bat habitat range. However, there are no known mature roosting trees or hibernacula recorded in Mecklenburg County per The U.S. Fish and Wildlife Service (USFWS) published GIS data. Therefore, per the Final 4(d) Rule the project is exempt. The USACE project manager will make the final determination if consultation is necessary under Section 7. 6. Due to storage limitations of our administrative records, the Corps requires that all hard- copy submittals include at least one original Plat (to scale) that is no larger than 11"x17" (the use of match lines for larger tracts acceptable). Additional copies of a plat, including those larger than I I "x] 7", may also be submitted for Corps signature as needed. The Corps also accepts electronic submittals of plats, such as those transmitted as a Portable Document Format (PDF) file.
