Bridge No. 790236 on SR 1221 (Bostian Road) over To�vn Branch (Tributary to Cold Water
Creek), Class WS-IV, Rowan County, NC, WBS Project No.: 17BP.9.R.62
Dear Mr. Lastinger,
This is a request for a Nationwide 14 permit for the replacement of Bridge No. 790236 with a
double barrel box culvert (2@ 11'x 9' RCBC) ov SR 1221 (Bostian Road) over Town Branch a
hibutary to Cold�vater Creek (Class WS-IV) in Rowan Coimty. Attached are the pre-construction
notification application, vicinity map, soils map, topographical map, and pe�mit drawings with the
project study area called out. Other attachments include the mitigation acceptance letter from
Division of Mitigation Services (DMS), the stormwater managemeut plan, the culvert survey
report, the'No Survey Required form for Historic Architecture', and the `No Archaeological sites
are present or Affected' for Archeology.
The project will permanently impact 144 linear feet (48'-culvert, 73'-bank stabilization) and
temporarily impact 23 linear feet (de�vatering) of Town Branch. Low stream flow wil] be isolated
into one barrel, with P sills, and the culvert will be buried P below the stream bed to ensure
aquatic passage. The high flow barrel will have 2' sills and floodplain benches constructed at the
inlet and outlet of the culvert. The low flow and high flow barrels will be backfilled with material
fliat is excavated from the stream or floodplain and may be supplemented with rip rap if needed.
The cubert site will be dewatered during construction in accordance with NCDOT's Best
Management Practices. An overhead power line will be installed approximately 20' do�mstream
of the inlet. No impacts to Waters of the US are proposed as a result of the utility installation.

The USFWS lists Schweinitz's sunflower (Helianthus schtiveinilzii) as endangered and Northern
Long-Eared bat (NLEB-Myotis septenh•ionalis) as threatened for Rowan County. Habitat is
present in the project area for Schweinitz's Sunflower, however, September 25, 2014 and
November 12, 2014 surveys revealed no presence of Schweinitz's sunflowec Consequently, it was
determined that the proposed project will have `No EffecY on Schweinitz's sunflowec A
November 12, 2014 survey of the project area revealed ao Georgia aster. Summer roosting habitat
exists in the project area for the NLEB. Anticipated tree clearing impacts for the project are
estimated ro be 0.02 acres. An August 4, 2014 survey of the existing bridge revealed no preseuce
of the NLEB. The project area falls within the range of the NLEB and there is likely tree cutting
aud/or percussive activities associated with the project. ConsequenUy, the biological conclusion
for the NLEB is `May Affect, not ]ikely to adversely affect'. Thus, for the proposed action,
NCDOT has committed to the conservation measures listed belo�v:
L No alterations of a known hibernaculum's entrance or interior enviromnent if it impairs an
essential behavioral pattern, including sheltering Northern long-eared bats (January 1
through December 31);
2. No tree removal within a 0.25-mile radius of a known hibernacula (January 1 through
December 31); and
3. No cutting or destroying a known, occupied maternity roost tree, or any other trees within a
150-foot radius from the known, occupied matemity tree during the period from June 1
through and including July 31.
The final determination regarding the NLEB biological conclusion will be determined by the
USF WS in consultation with the USACE in accordance with Standard Local Operating Procedures
for Endangered Species Act Compliance for the Northern Long-Eared Bat in North Carolina,
December 2016.
Bald Eagles are protected under the Migratory Bird Treaty Act and the Bald and Golden Eagle
Protection Act. A field survey of the project sttidy area was conducted on January 14, 2015. No
species or nests were observed. Therefore, this species will not be impacted as a result of project
construction.
By copy of this letter, we also request 401 review and approval from the NC Division of Water
Resources with one copy of the application package provided to Amy Chapman, Transportation
Permitti�g Unit Supervisor, and Dave Wanucha, DOT Project Coordinator. Please charge the
application fee of $270 to WBS Project No. 17BP.9.R.62.
