Information
Thank you for your PCN and attached information, dated 7/19/2017 (received 7/21/2017 via email), for the
above referenced project. I have reviewed the information and need clarification before proceeding with
verifying the use of Nationwide Permit 39 (http://saw-reg.usace.army.mil/NWP2017/2017NWP39.pdf). Please
submit the requested information below (via e - mail is fine) within 30 days of receipt of this Notification,
otherwise we may deny verification of the use of the Nationwide Permit or consider your application
withdrawn and close the file:
1) Please update the plan sheet to clearly show streams A and B as they occur within and outside of
wetland areas in the vicinity of the proposed road crossings. Perhaps a different type of stream line
symbol could be used to show the streams at a smaller scale.
2) Please include and itemize any stream impacts proposed due to rip rap dissipater pads and
temporary impacts required for construction access/dewatering, along with permanent impacts
proposed in the culvert footprint. Please update the PCN and plans to clearly distinguish these
impact footprints/lengths. Please also ensure that stream impacts reported do not include the
portions of streams currently within culverts, as these areas would not be considered impacts to
waters of the US;
3) Please provide zoomed -in detail plan view sheets of each road crossing, clearly showing the
following:
a. stream and wetland boundaries;
b. different hatching for the footprint of wetland and stream impacts, including impacts due to fill
(in wetlands), impacts due to culverts, impacts due to rip rap pads, and temporary impacts
outside of the permanent impact areas needed for construction access/dewatering;
c. footprint of the existing culverts;
d. footprint of the proposed culverts;
4) Note that all impact amounts in the PCN and shown on the plans should be for linear feet of stream
(centerline) rather than culvert length. Please update the plansheet and PCN accordingly;
5) Note that, per NWP 39 Regional Condition 3.6, inverts of culvert pipes >48" in diameter must be
buried 1' below the stream bed grade. Inverts of culvert pipes 48" or smaller should be placed flush
with the existing stream bed grade to allow for continued aquatic life passage. The Profile view
included on the Plansheet does not show that the culvert is designed consistent with this Regional
Condition; i.e. the pipe invert appears perched above the stream bed. Please provide a profile view
along the culvert to show consistency with this Regional Condition. If any rip rap is required at the
inlet or outlet of the culvert, please include the rip rap footprint in this profile view. Note that, unless
otherwise required, rip rap pads should be installed such that the top of the rip rap is no higher than
the stream bed grade (see NWP 39 Regional Condition 4.1.6). Otherwise, rip rap placed above grade
in the stream bed will be considered a loss of waters of the US. Please update the plans heet/profile
and PCN accordingly.
6) Please describe/show the dewatering method proposed for use during culvert installation;
