On behalf of the property developer, Hart & Hickman, PC (H&H) is submitting the attached Pre -
Construction Notification (PCN) for the proposed construction of a solar development facility in
Jamesville, Martin County, North Carolina (Site or subject Site). The Site consists of an
approximate 121 -acre parcel of primarily agricultural land located northeast of the intersection of
Pulp Mill Road and Elwood Holliday Road (Parcel # 0100322). H&H is submitting the PCN
application to the U.S. Army Corps of Engineers (USACE) and requesting impacts to a stream
under Nationwide Permit (NWP) #14. H&H is also seeking concurrence from the North
Carolina Department of Environmental Quality (DEQ) Division of Water Resources (DWR) to
impact an on -Site stream under the corresponding Water Quality Certificate (WQC) #4088.
H&H previously submitted a Preliminary Jurisdictional Determination (PJD) Request to Mr.
Kyle Barnes of the USACE Washington Regulatory Field Office for approval and Mr. J.C.
Weaver of H&H met with Mr. Barnes on December 16, 2015 to review the stream and wetland

boundaries. After implementing recommended adjustments to stream and wetland boundaries,
Mr. Barnes verbally approved H&H's flagged boundaries for two streams and one wetland
discussed below. Mr. Barnes has yet to issue written approval for the PJD request pending
review of a completed survey plat for the on -Site streams and wetlands. A complete PJD request
with a survey plat is included in Appendix E.
2.0 Stream and Wetland Delineation
Streams
As mentioned above, H&H conducted a stream and wetland delineation of the subject Site in
October 2015. During the survey, H&H identified the following two (2) streams on the Site that
convey Site drainage, and which appear to maintain characteristics consistent with those of a
jurisdictional stream:
• Stream `A' (SCA) - an approximate 1,057 linear ft (LF) intermittent stream located in
the northwestern portion of the Site that originates at Wetland `A'; and
• Stream `B' (SCB) — an approximate 63 LF intermittent stream located in the northeastern
portion of the Site.
Wetland
During the survey, H&H identified the following area on the Site, which appears to maintain
characteristics consistent with those of a jurisdictional wetland:
• Wetland `A' — approximate 0.606 -acre wetland area located in the west -central portion of
the Site. Drainage from Wetland `A' is conveyed in northerly direction towards SCA and
then continues off -Site in a northwesterly direction. Wetland `A' consists primarily of
forested vegetation.

Surface Water Feature
There is also a jurisdictional surface water feature (SWA) located in the north -central portion of
the Site that encompasses approximately 0.282 acre.
3.0 Proposed Impacts to Jurisdictional Features
Permanent Impacts
To facilitate the development of an access roadway in the west -central portion of the Site, the
developer is proposing the following:
• Impact 1 - consists of filling approximately 116 LF of intermittent stream SCA in the
western portion of Site.
The stream impact is associated with the proposed development of a 20 -foot wide access
roadway across to the western portion of the Site. The proposed stream impact includes
installation of a 48 -inch reinforced concrete pipe (RCP) culvert to cross the stream and to
provide vehicular access to the northwestern portion of the Site. Impact 1 also includes the
installation of a rip rap outlet protection on the downgradient side of the proposed 48 -inch RCP
culvert. Site developers have decided to completely avoid Wetland `A', SCB, and SWA to
minimize impacts to on -Site wetlands, streams, and surface water.

Mitigation is typically required by the USACE Wilmington District Final Regional Conditions
for Nationwide Permits for impacts greater than 150 LF of stream bed. Due to proposed stream
impacts of 116 LF to SCA, compensatory mitigation is not currently proposed for this project.
H&H is seeking a Nationwide Permit #14 verification for this development. A copy of the PCN
submittal package has also been forwarded to DEQ DWR to request a corresponding WQC
#4088.

Carolina. The Site consists primarily of agricultural land and undeveloped wooded land. Industrial use is to the north, vacant undeveloped land is to
the east, and single-family residential and agricultural land is to the west and south.

Avoidance
The proposed development is located northeast of the intersection of Pulp Mill Road and Elwood
Holliday Road in Jamesville, Martin County, North Carolina (Site or subject Site). The Site
consists of one tax parcel (Parcel # 0100322) that totals approximately 121 acres.
H&H reviewed State and Federal Threatened and Endangered Species databases for the Site and
conducted a screening survey of the Site and surrounding area for Federal Threatened and
Endangered Species, and none were identified. H&H also reviewed the National Registry of
Historic Places (NRHP) for Sites located in Martin County, North Carolina; the North Carolina
State Historic Preservation Office (NC SHPO) GIS viewer; and the Site and surrounding area via
visual reconnaissance for the presence of historic, cultural, and/or archeological sites. No
recorded sites were noted on or adjacent to the Site. A single-family residential dwelling is
present in the southwestern portion of the Site, and an additional single-family residential
dwelling, a storage barn, and a prefab steel building are present in the south-central portion of the
Site. According to review of Martin County tax records, these structures were built in 1900,
1980, and 2000, respectively, and did not appear to be of significant historic, cultural, and/or
archeological value. H&H requested comment on the Site from the NC SHPO and a response
dated September 29, 2014 indicates that the NC SHPO does not have comment regarding the
Site. H&H also requested comment on the Site from NC Wildlife Resources Commission
(WRC) and the United States Fish and Wildlife Service (FWS). WRC and FWS responses are
pending. Request letters and the response from NC SHPO are included in Appendix E.
In regards to Site alternatives, the prospective developer has considered and evaluated other
potential properties in the area for development of the proposed solar development. However,
the Site is within close proximity and viability to interconnect with a three-phase electrical
distribution line. The Site is ideally positioned north -south; and therefore, the solar panels can
be installed in a north -south orientation, which allows the panels to track the sun as it rises in the

east and sets to the west. Furthermore, by designing the solar panels to occupy upland areas, the
solar development completely avoids Wetland `A' and SCB.
M;n;mi-zatinn
To minimize Site impacts, the proposed Site plan was designed to avoid stream impacts to the
maximum extent practicable. Solar panels have been designed to fully occupy upland areas.
Furthermore, the areas of proposed solar panel installation have been designed to occupy the
agricultural areas on -Site; and therefore, little to no tree clearing is required for the development
of the solar panel areas.
The Site plan has been designed to develop a 20 -foot wide roadway for vehicular access to the
northwestern portion of the Site from Pulp Mill Road. The proposed roadway crossed SCA in
the western portion of the Site at a location slightly north of Wetland W. The developer is
proposing to install a 48 -inch RCP culvert that has adequate size to handle the flow volumes of
SCA. Stream impacts are limited to the areas of the proposed culvert installation and roadway
construction.
H&H evaluated an existing roadway crossing on -Site that is located at the northern tip of
Wetland `A'. However, H&H determined that the re -use of the existing road crossing was not
practical for the following reasons:
• due to lack of maintenance, the existing roadway crossing is in poor condition and can no
longer be used as a safe roadway crossing;
• a culvert replacement and roadway widening would be required to utilize the existing
crossing for large vehicle traffic;
• a culvert replacement and roadway widening would likely result in stream and wetland
impacts due to the location of the existing crossing; and
• utilizing the existing crossing would create a sharp turn for large vehicle traffic and is the
least preferred option due to safety hazards.
Please note that the developer originally designed the proposed roadway to cross SCA slightly
north of the currently proposed crossing at an angled portion of the stream. Due to the angled

position of SCA, the culvert installation and roadway development required 140 LF of stream
impact. However, the developer decided to shift the crossing south of the angled portion of the
stream to minimize impacts to SCA. The current design plan reduced the impact to SCA from
140 LF to 116 LF of stream impact. The original design plan is included in Appendix D.
To further minimize Site impacts, the proposed Site plan was designed to avoid wetland impacts
to Wetland `A'. Of the 1,120 LF of on -Site streams, the developer proposes impact to only 10%
of on -Site streams. Impacts to SCA have been designed to keep the majority of the stream bed
intact. In addition, the developer will implement best erosion and sediment control practices
during Site development. Extensive silt fencing will be used on the construction site perimeter
and along wetland and stream boundaries to prevent sediments from inadvertently filling the on -
Site wetland and stream areas during construction.
Mitigation
Mitigation is typically required by the USACE Wilmington District Final Regional Conditions
for Nationwide Permits for impacts greater than 150 LF of stream bed. Due to the planned
impacts of 116 LF to SCA, compensatory mitigation is not currently proposed.

on or near the above -referenced site (hereafter referred to as the "Site"). This request is
submitted to satisfy corporate environmental stewardship and Federal/State wetland permitting
action. This request is not being submitted due to the use of Federal funds.
The Site consists of one tax parcel totaling approximately 121 acres of land (Martin County
Parcel #0100322) located northeast of the intersection of Pulp Mill Road and Elwood Holliday
Road in Jamesville, Martin County, North Carolina (Site or subject Site; see Figure 1). The Site
consists primarily of agricultural land and undeveloped wooded land. Surrounding properties
include industrial facilities to the north, vacant undeveloped land to the east, and single-family
residential and agricultural land to the west and south. Representative Site photos are attached to

In order to investigate the potential presence of protected flora and fauna on the Site, H&H
completed the following activities:
• contacted the NC Wildlife Resources Commission (WRC) by a similar letter;
• reviewed the Federal Threatened and Endangered Species List for Martin County in
North Carolina on the U.S. Fish and Wildlife Service (US FWS) website
http://www.fws.gov/endangered/;
• reviewed the North Carolina Department of Environmental Quality (DEQ) Natural
Heritage Program on-line database for records of Federal Threatened and Endangered
species occurrences for Martin County and the Plymouth West quadrangle on the DEQ
website http://portal.ncdenr.org/web/nhp/database-search;
• reviewed the Federal Registry and the US FWS information pertaining to Federally -
Designated Critical Habitats at the US FWS website http://crithab.fws.gov; and
• conducted an on-site visual survey in order to field screen the Site and peripheral areas
for federally protected species.

H&H reviewed the North Carolina NHP on-line database for records of Federal Threatened and
Endangered species for Martin County, North Carolina which includes the following protected
species:
• Atlantic sturgeon (Acipenser oxyrinchus) — Endangered
H&H also reviewed the North Carolina NHP on-line database for records of Federal Threatened
and Endangered species for the Plymouth West Quadrangle, North Carolina. The database
identified the Atlantic sturgeon (Acipenser oxyrinchus) as being present within the Site
quadrangle. Additional federally endangered species were not identified in the NHP Database.
Critical Habitats
H&H reviewed federal registry information pertaining to Federally -Designated Threatened and
Endangered Species Critical Habitats for the aforementioned species on-line at the US FWS
critical habitats on-line mapper. No Federally -Designated Critical Habitats were identified in the
Site area.
Visual Survey
In October 2015, H&H conducted a visual survey of the Site. Areas of potential habitat for
federally protected species were investigated within the wooded portions of the Site.
The wooded portion of the Site is a fragmented patch of forested land located in the west -central
portion of the Site. The forested area consists primarily of young growth immature trees within a
highly fragmented portion of wooded land. Due to the lack of dead and dying mature trees with
a high amount of exfoliating bark and cavities and because the forested area is highly
fragmented, H&H determined suitable habitat does not exist for the Northern long-eared bat,
(Myotis septentrionalis). Furthermore, caves were not identified on -Site and therefore,

hibernaculum does not exist on -Site. Due to the lack of a well-defined, clean, deep, and swiftly
moving river system, H&H determined suitable habitat does not exist for the Atlantic sturgeon
(Acipenser oxyrinchus).
During the survey, H&H did not observe evidence of federally listed species or their suitable
habitats on the Site.
Please review the above information and provide a written response as to the potential for this
project to affect protected species. If possible, please respond to this request within 30 days.

Hart & Hickman, PC (H&H) is requesting information concerning protected species and habitats
on or near the above -referenced site (hereafter referred to as the "Site"). This request is
submitted to satisfy corporate environmental stewardship and Federal/State wetland permitting
action. This request is not being submitted due to the use of Federal funds.
The Site consists of one tax parcel totaling approximately 121 acres of land (Martin County
Parcel #0100322) located northeast of the intersection of Pulp Mill Road and Elwood Holliday
Road in Jamesville, Martin County, North Carolina (Site or subject Site; see Figure 1). The Site
consists primarily of agricultural land and undeveloped wooded land. Surrounding properties
include industrial facilities to the north, vacant undeveloped land to the east, and single-family
residential and agricultural land to the west and south. Representative Site photos are attached to
this letter.

In order to investigate the potential presence of protected flora and fauna on the subject site,
H&H recently conducted the following activities:
• contacted the US Fish & Wildlife Service (FWS) office by a similar letter;
• reviewed the Federal Threatened and Endangered Species List for Martin County in
North Carolina on the U.S. Fish and Wildlife Service (US FWS) website
http://www.fws.gov/endangered ;
• reviewed the North Carolina Department of Environmental Quality (DEQ) Natural
Heritage Program on-line database for records of Federal Threatened and Endangered
species occurrences for Martin County and the Plymouth West quadrangle on the DEQ
website http://portal.ncdenr.org/web/nhp/database-search;
• reviewed the Federal Registry and the US FWS information pertaining to Federally -
Designated Critical Habitats at the US FWS website http://crithab.fws.gov; and
• conducted an on-site visual survey in order to field screen the Site and peripheral areas
for federally protected species.

H&H requested comment on the potential presence of protected flora and fauna on the Site from
the US FWS by a similar letter. A response from US FWS is pending.

H&H reviewed the US FWS Federal Threatened and Endangered Species List for Martin
County, NC, which includes the following:

North Carolina Department of Environmental Quality Natural Heritage Program (NHP)
H&H reviewed the North Carolina NHP on-line database for records of Federal Threatened and
Endangered species for Martin County, North Carolina which includes the following protected
species:
• Atlantic sturgeon (Acipenser oxyrinchus) — Endangered
H&H also reviewed the North Carolina NHP on-line database for records of Federal Threatened
and Endangered species for the Plymouth West Quadrangle, North Carolina. The database
identified the Atlantic sturgeon (Acipenser oxyrinchus) as being present within the Site
quadrangle. Additional federally endangered species were not identified in the NHP Database.
Critical Habitats
H&H reviewed federal registry information pertaining to Federally -Designated Threatened and
Endangered Species Critical Habitats for the above listed species online at the FWS critical
habitats online mapper. No Federally -Designated Critical Habitats were identified in this area.
Visual Survey
In October 2015, H&H conducted a visual survey of the Site. Areas of potential habitat for
federally protected species were investigated within the wooded portions of the Site.
The wooded portion of the Site is a fragmented patch of forested land located in the west -central
portion of the Site. The forested area consists primarily of young growth immature trees within a
highly fragmented portion of wooded land. Due to the lack of dead and dying mature trees with
a high amount of exfoliating bark and cavities and because the forested area is highly
fragmented, H&H determined suitable habitat does not exist for the Northern long-eared bat,
(Myotis septentrionalis). Furthermore, caves were not identified on -Site and therefore,
hibernaculum does not exist on -Site. Due to the lack of a well-defined, clean, deep, and swiftly

moving river system, H&H determined suitable habitat does not exist for the Atlantic sturgeon
(Acipenser oxyrinchus).
During the survey, H&H did not observe evidence of federally listed species or their suitable
habitats on the Site.

project to affect protected species. If possible, please respond to this request within 30 days.

Preservation Office (NC SHPO) geographic information system (GIS) viewer for sites located in
Martin County, North Carolina;
• conducted a visual survey of the Site and the surrounding area; and
• reviewed the Martin County property record for the Site.
National Registry of Historical Places & North Carolina State Historic Preservation Office
H&H reviewed the NRHP website (http://nationalregisterofhistoricplaces.com/NC/martin/state.htmD and
the NC SHPO GIS viewer (http://gis.ncdcr.gov/hpoweb/) to obtain information and locations of historic,
cultural, and/or archeological sites on or adjacent to the subject Site.
Based upon our review of these websites, H&H did not identify historic, cultural, and/or archeological
sites on or adjacent to the Site.
Visual Survey
H&H conducted a visual survey of the Site and nearby properties while conducting wetland survey
activities. H&H identified a single-family residential dwelling in the southwestern portion of the Site, and
an additional single-family residential dwelling and several structures located in the south-central portion
of the Site that appeared to be associated with the agricultural use. H&H did not observe structures or
ruins on the property that appear to be historically, culturally, and/or archeologically significant.
Martin County Property Record
According to the Martin County GIS website, a two-story residential dwelling, a storage barn, and a prefab

paying client or your agency, please note the specific submittal requirements in Part G.
NOTE ON PART D — PROPERTY OWNER AUTHORIZATION: Please be aware that all JD
requests must include the current property owner authorization for the Corps to proceed with the
determination, which may include inspection of the property when necessary. This form must be
signed by the current property owner to be considered a complete request.
NOTE ON PART D - NCDOT REQUESTS: Property owner authorization/notification for JD
requests associated with North Carolina Department of Transportation (NCDOT) projects will be
conducted according to the current NCDOT/USACE protocols.
NOTE TO USDA PROGRAM PARTICIPANTS: A Corps approved or preliminary JD may not
be valid for the wetland conservation provisions of the Food Security Act of 1985. If you or
your tenant are USDA Program participants, or anticipate participation in USDA programs, you
should also request a certified wetland determination from the local office of the Natural
Resources Conservation Service, prior to starting work.

I. REQUESTS FOR CORPS APPROVAL OF SURVEY PLAT
Prior to final production of a Plat, the Wilmington District recommends that the Land
Surveyor electronically submit a draft of a Survey Plat to the Corps project manager for
review.
Due to storage limitations of our administrative records, the Corps requires that all hard-
copy submittals include at least one original Plat (to scale) that is no larger than 11 "x 17"
(the use of match lines for larger tracts acceptable). Additional copies of a plat, including
those larger than 11 "x 17", may also be submitted for Corps signature as needed. The
Corps also accepts electronic submittals of plats, such as those transmitted as a Portable
Document Format (PDF) file. Upon verification, the Corps can electronically sign these
plats and return them via e-mail to the requestor.
(1) PLATS SUBMITTED FOR APPROVAL
Must be sealed and signed by a licensed professional land surveyor

Must include a North Arrow, Scale(s), Title, Property Information
Must include a legible WoUS Delineation Table of distances and bearings/metes
and bounds/GPS coordinates of all surveyed delineation points

• Must include either a surveyed, approximate centerline of tributary with
approximate width of tributary OR surveyed Ordinary High Water Marks
(OHWM) of tributary
• Must identify each tributary using an alphanumeric system
• Must include linear footage of tributaries and calculated area (using approximate
widths or surveyed OHWM)
• Must include name of tributary (based on the most recent USGS topographic
map) or, when no USGS name exists, identify as `unnamed tributary"
all depicted WoUS (wetland polygons and tributary lines) must intersect or tie -to
surveyed project/property boundaries
Must include the location of wetland data points and/or tributary assessment
reaches
Must include, label accordingly, and depict acreage of all waters not currently_
subject to the requirements of the CWA (e.g. "isolated wetlands", "non -
jurisdictional waters"). NOTE: An approved JD must be conducted in order to
snake an official Corps determination that a particular waterbody or wetland is not
jurisdictional.

When the entire actual Jurisdictional Boundary is depicted:
include the following Corps Certification language:
"This certifies that this copy of this plat accurately depicts the boundary of the jurisdiction
of Section 404 of the Clean Water Act as determined by the undersigned on this date.
Unless there is a change in the law or our published regulations, the determination of
Section 404 jurisdiction may be relied upon for a period not to exceed five (5) years from
this date. The undersigned completed this determination utilizing the appropriate Regional
Supplement to the 1987 U.S. Army Corps of Engineers Wetlands Delineation Manual."

1. The Corps of Engineers believes that there may be jurisdictional waters of the United States on the subject site, and the permit
applicant or other affected party who requested this preliminary JD is hereby advised of his or her option to request and obtain an
approved jurisdictional determination (JD) for that site. Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other
general permit verification requiring "pre -construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an approved JD for the activity, the permit applicant is hereby
made aware of the following: (1) the permit applicant has elected to seek a permit authorization based on a preliminary JD, which
does not make an official determination of jurisdictional waters; (2) that the applicant has the option to request an approved JD
before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an approved JD
could possibly result in less compensatory mitigation being required or different special conditions; (3) that the applicant has the
right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit
authorization; (4) that the applicant can accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) that
undertaking any activity in reliance upon the subject permit authorization without requesting an approved JD constitutes the
applicant's acceptance of the use of the preliminary JD, but that either form of JD will be processed as soon as is practicable;
(6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any
form of Corps permit authorization based on a preliminary JD constitutes agreement that all wetlands and other water bodies on
the site affected in any way by that activity are jurisdictional waters of the United States, and precludes any challenge to such
jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal
court; and (7) whether the applicant elects to use either an approved JD or a preliminary JD, that JD will be processed as soon as
is practicable. Further, an approved JD, a proffered individual permit (and all terms and conditions contained therein), or
individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal,
jurisdictional issues can be raised (see 33 C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary to make
an official determination whether CWA jurisdiction exists over a site, or to provide an official delineation of jurisdictional waters
on the site, the Corps will provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the subject project site, and identifies all aquatic
features on the site that could be affected by the proposed activity, based on the following information:
