The applicant, Mr. Mark Bolton, wishes to install 40 linear feet of 60 -inch HDPE culvert pipe in an
unnamed tributary of cane creek to gain access to his 33.26 -acre tract of land in Fairview, North
Carolina. The pipe will be filled with 12 -inches of streambed material to allow aquatic passage.
Erosion control measures will be installed to control sedimentation. The attached plan, PCN
application, and letter from the Army Corps of Engineers should provide the necessary information

and forest land. The small stream the applicant wishes to install a culvert on flows through the fields near the road frontage of the property.

The impacts are necessary to gain access to the property. The unnamed tributary of Cane Creek flows along the frontage of the property and must be
crossed to access the remainder of the property. The work will take. place outside of the trout moratorium from October 15 - April 15. Erosion control
measures will be included in the plan to minimize siltation and the plan will call for the site will be stabilized as soon as possible.

The work will take place outside of the trout moratorium from October 15 - April 15. Erosion control measures will be installed to minimize siltation and
the site will be stabilized as soon as possible. Matting will be installed on all slopes 3:1 or steeper and all disturbed areas will have silt fence at the
downstream to of the slope. Heavy equipment will not be used in the stream except to prepare the culvert bedding and to install the culvert. Heavy
equipment will not cross the stream before the culvert is installed.

AFTER INSTALLING THE CONSTRUCTION ENTRANCE, AND PRIOR TO ANY OTHER CONSTRLKTION OR
CLEARING, INSTALL ALL PERIMETER EROSION CONTROL DEVICES INCLUDING SILT FENCE
INSTALL SEDIMENT TRAPS SEDIMENT &IONS TEMPORARY DIVERSION DITCHES AND CRIT -ET
PROTECTIONS AS SHOWN ON THE PIANS.
INITIATE THE CLEARING AND GRADING OPERATION MAINTAIN ALL SEDIMENT CONTROL DEVICES
THROUGHOUT THE CONSTRUCTION PHASE AND UNTIL ALL DISTURBED AREAS NAVE BEEN STABILIZED.
INSTALL PRINCIPAL STORM DRAINAGE, INCLUDING INLET AND OUTLET PROTECTION DIRECT TEMPORARY
DITCHING TO YARD INLETS WITH STONE INLET PROTECTION IN PLACE GRADE PERMANENT DIVERSION
DITCHES TO DIRECT UPSLOPE RUNOFF TO BYPASS THE DISTURBED AREAS WITHIN THE CONSTRUCTION
AREAS, THESE PERMANENT DIVERSION DITCHES SHALL INCORPORATE STONE CHECK DAMS AS INDICATED
ON PLAN. THE DITCHES ARE TO BE SEEDED OR OTHERWISE STABILIZED WITHIN 14 CALENDAR DAYS OF
GRADING.
AFTER CONSTRICTION AND ALL DISTURBED AREA HAVE BEEN STABILIZED, CONTRACTOR SHALL REMOVE
ALL TEMPORARY SEDIMENT CONTROL MEASURES

Subject: No Army Corps of Engineers Notification Required for Use of NWP 14
Thank you for speaking with me about using a Nationwide Permit XX (NWP 14), which
authorizes activities in waters of the U.S. (WoUS) associated with NWP 14. The work you
described includes culvert installation on Old Fort Road near Fairview in Buncombe County,
North Carolina. As described, the proposed project would involve approximately 25 linear feet
of permanent impacts to streams.
On March 19, 2017, the regional conditions of NWP X14 pertaining to notification
requirements changed. These changes affect the requirements for submittal of pre -
construction notification for work conducted in the western counties of North Carolina. Based
upon details provided for your project, you are not required to submit pre -construction
notification to our office. You may proceed with your work as proposed provided it is
accomplished in accordance with all the conditions of the attached NWP 14.
Your project is located in a North Carolina Wildlife Resources Commission designated trout
watershed. Per regional condition 1.2, no work in streams at this location can be conducted
between October 15 and April 15 during the trout waters moratorium. Also, your project must
meet the requirements of regional condition 3.6 for installation of culverts. These
requirements define measures which promote the safe passage of fish and other aquatic
organisms and are to be included in the construction/installation of culverts.

This statement does not preclude the need to obtain other applicable federal, state, or local
authorizations for your project. The changes to NWP XX may not affect the pre -construction
notification requirements to receive the required corresponding Clean Water Act Section 401
Water Quality Certification from North Carolina Division of Water Resources (DWR). Please
contact the county project manager at 828-296-4500, to determine the required pre -
construction notification/permit application submittal process for DWR.
