The above project qualifies for a Nationwide Permit 3 and 12 authorization. NCDOT is
authorized to replace the existing 100ft by 26 ft Bridge #3 over Deep Creek with a 150 ft
by 30 ft bridge and to replace associated utilities. The project is located on US Highway
264 approximately 2.2 miles from the Dare County/Hyde County line southwest of
Stumpy Point, Dare County, North Carolina. The project will impact 0.107 acres of
jurisdictional wetlands, which were designated Coastal Wetlands by NCDCM. All terms
and conditions for NWP #3 and 12 apply. The following Special Conditions apply:
1. In order to avoid adverse impacts to the West Indian Manatee , NCDOT must comply
with Guidelines for Avoiding Impacts to the West Indian Manatee: Precautionary
Measures for Construction Activities in North Carolina Waters.
2. All utilities must be installed a minimum of 40 feet below the canal bottom, as shown
on the project plans.
3. In order to protect fishery resources, no in-water work may occur between April1
and September 30 of any year.
4. Permit must be obtained from NCDCM prior to initiation of construction.
