The US Army Corps of Engineers determined that the proposed shellfish lease project does not require the submittal of a PCN to the Corps prior to construction as long as the proposed species of shellfish has been previously cultivated in the waterbody. As such, the proposed project does not require written concurrence from the NCDWR. Attached are the following documents to assist with the review: review questions, original application and a map of the proposed lease location. To more fully evaluate other factors which may affect the possible issuance of this lease, it is requested that Marine Patrol, Fisheries Management and Shellfish Sanitation complete the attached review form. Under the Core Sound Lease Moratorium passed by the NCGA in 2003, only areas that were active when the moratorium passed are eligible for leasing. Because this lease was active at that time it also does not require a permit under the Nationwide Permit 48. North Carolina General Statute 113-202 requires comments to be evaluated by the DMF director and if approved to post two legal notices and hold a public hearing during at the end of a 30 -day public comment period.
