REQUEST FOR MORE INFORMATION
Dear Mr. Fuller,
The Division of Water Quality (DWQ) received your application for a 401 Water Quality Certification for
the subject project on August 25, 2008. Barry Love of this office has reviewed the application and met with
Jeffrey Swartz of WK Dickson on site on September 9, 2008. Based on this review, the following
information/comments are needed:
o The submitted application does not adequately address avoidance and minimization. Efforts should
be taken to reduce the length of impact such as the use of headwalls, reduced riprap length, and
other such measures.
o Any riprap in the stream must be embedded with no matting used in the streambed.
o During the site visit, the stream was found to be perennial. Please modify the impacts page of the
application to reflect this.
Ms. Annette Lucas of the 401 Oversight/Express Review Permitting Unit has also reviewed the application
in regard to stormwater requirements. Based on her review, the following information is needed:
o DWQ considers the first phase of this project, construction of the access road, to be high density.
Per the requirements of GC 3705, this phase must comply with Stormwater Management Plan
(SMP) Requirements for Applicants Other Than the North Carolina Department of Transportation,

pdf. Please include an SMP that removes a minimum of 85 percent TSS from the stormwater
generated by this project. For each proposed BMP, please provide a completed BMP Supplement
Form, with all the required items. The BMP Supplement Forms are available at the following web
site: hqp://h2o.enr.state.nc.us/su/bmp forms.htm.
o For the remainder of the project, please provide a conceptual stormwater management plan for the
project that includes the following:
a. A depiction of the drainage areas on the site.
b. An estimation of the percentage imperviousness associated with each of the drainage areas.
c. A calculation of the water quality volume associated with each drainage area.
d. A depiction of a proposed BMP (state the type of BMP you plan to use) on the site plan that is
correctly sized based on the water quality volume.
Pursuant to 15A NCAC 2H.0507(h) this project will be put on hold until such time as the requested
information has been received. Please respond in writing within 30 calendar days of the date of this letter by
sending five copies of the required information to the Division of Water Quality, 401/Wetlands Unit, 1650 Mail
Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within
that timeframe, please provide written confirmation that you intend to provide the requested information, and
include a specific timetable delineating when the requested materials will be provided. If we do not hear from
you in 30 calendar days, we will assume that you no longer want to pursue this project, and we will consider the
project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested in your application are not authorized at this time
