Please see the attached requests to modify the DA Permit (Action ID No. SAW -2015-01887) and corresponding
Section 401 Water Quality Certification (DWR# 16-0682) for the Ocean Isle Beach Marketplace Project.
The developer seeks authorization for a minor revision to the permitted site plan to relocate the outlet of the
stormwater bypass pipe. The proposed revision does not result in any increase to the amount of authorized
wetland impacts. Updated drawings (Exhibit A and Exhibit B) are enclosed for reference.

Reference the Department of the Army (DA) permit issued on April 24, 2017, for the
discharge of fill material into wetlands adjacent to Kilbart Slough, in Ocean Isle Beach
Brunswick County, North Carolina. Reference is also made to your permit modification dated
June 30, 2017 with revised Exhibit A dated June 27, 2017, approved exhibits attached. The
requested revision moves a storm water entry point from NW corner of the remaining wetlands
to the NE corner of the same wetland feature.
I have determined that the proposed project modifications described above are not
contrary to the public interest and consistent with the 404 (13)(1) and therefore, the DA permit is
hereby modified.
The original wetland impact in the NW corner for storm water must be avoided. All
original conditions in the April 24, 2017 standard permit remain enforceable.
This modification approval will be utilized for future compliance of the project. If you
