Please see the attached requests to modify the DA Permit (Action ID No. SAW -2015-01887) and corresponding Section
401 Water Quality Certification (DWR# 16-0682) for the Ocean Isle Beach Marketplace Project.
The developer seeks authorization for a minor revision to the permitted site plan to relocate the outlet of the stormwater
bypass pipe. The proposed revision does not result in any increase to the amount of authorized wetland
impacts. Updated drawings (Exhibit A and Exhibit B) are enclosed for reference.

Ocean Isle Beach Marketplace (Brunswick County, NC)
Dear Brad:
Per your recent correspondence with Scott Cooke of UB, Inc. (Development Project Manager),
Land Management Group, Inc. (LMG) is submitting the following request to modify the
Department of Army (DA) Permit issued to Halpern Development Company, LLC on April 24,
2017 (Action ID No. SAW -2015-01887) for the Ocean Isle Beach Marketplace Project located
near the intersection of Causeway Drive (NC Highway 904) and of Beach Drive (NC Highway
179) in Ocean Isle Beach, North Carolina.
In order to minimize utility and grade conflicts, the developer will need to relocate the outlet
for a stormwater bypass pipe. Under the current authorized site plan, the rip -rap lined outlet
for the bypass pipe is located on the northwest corner of the wetland. The proposed
modification is to relocate the outlet to the northeast corner of the wetland. The square
footage of authorized wetland disturbance will remain unchanged, and we believe that the
proposed modification meets the intent of the existing authorization. Refer to the attached
updated drawings (Exhibit A and Exhibit B) reflecting the proposed modification for reference.
Site construction has been initiated on the property and is currently on hold until such time
concurrence is received from your office. Any assistance in expediting the approval of this
permit modification would be appreciated.
