complete the loop around Fuquay-Varina, Wake County, Division 5. STIP No. U-
5317. WBS Element No. 45430.1.1 and Federal Aid Project No. STPDA-

Dear Mr. Lastinger and Mr. Ridings:
The Town of Fuquay-Varina, in coordination with the North Carolina Department of
Transpartation (NCDOT), proposes to extend Judd Parkway to complete the loop around Fuquay-
Varina, Wake County. The project begins at the intersection of NC 55 with Wilbon Road (SR
1110)/NE Judd Parkway (SR 5056) and ends at the intersection of NC 42 with Southwest Judd
Parkway (SR 2387). The project will be referred to as NW Judd Parkway. In addition to this cover
letter, the application package consists of an ENG Form 4345, NCDMS in-lieu fee (ILF) program
acceptance letter, Preliminary Jurisdictional Determination (Action ID # SAW-2013-00905),
Stormwater Management Plan, pernut impact drawings, and plan sheets.

The purpose of this project is to improve roadway linkage. NW Judd Parkway will link NC 55 (to
the north toward US 1/64) and NC 42 (to the southwest toward Sanford). It also will link to the
existing Judd Parkway, a two-lane road which connects to US 401 (to the northeast toward Raleigh
and to the south toward Lillington and Fayetteville), NC 42 (to the east toward I-40), and NC 55
(to the south toward I-95). It will complete the Judd Parkway loop around Fuquay-Varina.
Although the purpose of this project is not specifically to improve level of service on existing
facilities, the proposed improvements will reduce delay at most intersections along the corridor.
Several major roads go through Fuquay-Varina:
• US 401 leads to the northeast toward Raleigh, and to the south toward Lillington and
Fayetteville.
• NC 55 leads to the north toward Holly Springs, Apex, Cary, NC 540, and US 1/64. NC
55 leads to the south toward I-95.
• NC 421eads to the east toward I-40, and to the southwest toward Sanford.
However, all of these roads go through the center of town. Most of them make at least one 90-
degree turn and cross a railroad track at-grade. This results in a deficient transportation netwark
and poor mobility in this fast-growing area. This poor mobility is felt most in western and
southwestern Fuquay-Varina, where land uses are primarily residential.
According to the American Community Survey (2007-2011 Census data), 93% of adults commute
out of Fuquay-Varina to work, and the average travel time to work for drivers living in Fuquay-
Varina was 34.5 minutes. This is almost 50°/o greater than the average travel time for North
Carolina (24.7 minutes). Of the approximately 7,400 Fuquay-Varina residents who commute out
of town, 30% work in Raleigh, 12% in Cary, and 6°/o in Durham. Approximately 5,600 people
commute into Fuquay-Varina for work, living primarily in unincorporated Wake and Lee Counties,
with 10% living in Raleigh and 5% living in Cary.
NEPA DOCUMENT STATUS
An Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) for U-5317
was completed in April and May 2016 and has been provided to the appropriate agencies.
INDEPENDENT UTILITY
The subject project is in compliance with 23 CFR Part 771.111(�, which lists the Federal
Highway Administration (FHWA) characteristics of independent utility of a project:
(1) The project connects logical termini and is of sufficient length to address
environmental matters on a broad scope;
(2) The project is usable and a reasonable expenditure, even if no additional transportation
improvements are made in the area;
(3) The project does not restrict consideration of alternatives for other reasonably
foreseeable transportation improvements.
RESOURCE STATUS
Wetland delineations within the U-5317 project study area followed the feld delineation method
outlined in the 1987 Corps of Engineers Wetland Delineation Manual (LJSACE, 1987) and the
Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf
Coastal Plain Region (I�ersion 2.0) (USACE, 2010). Stream identification and classification
followed the Methodology for the Identification of Intermittent and Perennial Streams and Their
Origins (NC Division of Water Resources [NCDWR], 2010 and 2005).
Jurisdictional features identified in the project study area were verified by USACE Regulatory
Specialist James Lastinger on May 14, 2013, and a Preliminary Jurisdictional Determination (Pre-
JD), with Action ID: SAW-2013-00905, was issued for the project study area on May 16, 2013.
This project lies within the Coastal Plain Physiographic Province. The largest partion of the project
study area that is located south of Wilbon Road is situated within the Cape Fear River Basin
(Hydrologic Unit Code 03030004), and a small portion of the project study area that is situated
north of Wilbon Road is located within the Neuse River Basin (Hydrologic Unit Code 03020201).
Jurisdictional features within the project study area that will be impacted include one unnained
tributary (UT) to Kenneth Creek (NCDWR Classification C; NCDWR Index No. 18-16-1-(1)),
three riparian wetlands, and one jurisdictional pond.
There are no designated Outstanding Resource Waters (ORW), designated High Quality Waters
(HQW), Water Supply I(WS-I), Water Supply II(WS-II) waters, or waters listed on the 2014
303(d) Final List of Impaired Waters within the project study area or within 1.0 mile of the project
area.
IMPACTS TO WATERS OF THE UNITED STATES
Surface Waters
Total surface water impacts for the project study area are 250 linear feet of permanent stream
impacts, 23 linear feet of temporary stream impacts, 0.023 acres of temporary open water impacts,
and 0.022 acres of permanent open water impacts. The jurisdictional stream impacts are
summarized below in Table 1. There will be no impacts to surface waters from utilities for U-
5317.

Wetlands
There will be a total of 1.559 acres of permanent riparian wetland impacts and 0.253 acres of
temporary riparian wetland impacis associated with the proposed project. The permanent riparian
wetland impacts will result from road construction and includes impacts due to both fill (1.529
acres) and excavation (0.030 acres) in wetland WB. The temporary riparian wetland impacts will
result from mechanized clearing within wetland WB (0.248 acre) and from temporary fill within

the wetland WA (0.005 acre) associated with the placement of a temporary sediment basin.
Permanent and temporary wetland impacts are summarized below in Table 2.

The USACE has adopted, through the Council on Environmental Quality (CEQ), a wetland
mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. The
purpose of this policy is to restore and maintain the chemical, biological, and physical integrity of
the waters of the United States. CEQ has defined mitigation of wetland and surface water impacts
to include: avoiding impacts, minimizing impacts, rectifying impacis, reducing impacts over time,
and compensating for impacts (40 CFR 1508.20).
The NCDOT is committed to incorporating all reasonable and practicable design features to avoid
and minimize jurisdictional impacts, and to provide full compensatory mitigation of all remaining,
unavoidable jurisdictional impacts. Avoidance measures were taken during the planning phase and
minimization measures were incorporated as part of the project design. Miniinization includes the
examination of appropriate and practicable steps to reduce the adverse impacts.
Avoidance and Minimization
Avoidance and minimization has been employed in the project area to the maximum extent
practicable. The following minimization measures were implemented for the proposed project:
• NCDOT's Best Management Practices (BMPs) far the Protection of Surface Waters will be
enforced;
• Impacts to wetlands, streams, and open waters were avoided and/or minimized by adjusting
alignments and slopes;
• 2:1 slopes or less are used in most wetland areas;
• All storm drainage will be diffused and designed for non-erosive velocities before entering
stream and wetland areas to the maximum extent practicable;
• Rip rap stabilization on banks of jurisdictional streams will be implemented to prevent erosion;
Proposed stream impacts (273 linear feet) for U-5317 decreased from the impacts calculated for
the FONSI (293 linear feet). This decrease is due to the preliminary nature of the FONSI and the
assumption of 25 linear feet of impact beyond the slope stakes which have been reduced during
final design. In addition, grades were optimized during design to reduce the impacts to Stream SE
(UT to Kenneth Creek) to 273 linear feet as opposed to the 293 linear feet estimated in the FONSI.
The final proposed wetland impacts (1.812 acres total for combined temporary and permanent
wetland impacts) decreased from the impacts calculated for the FONSI (2.000 acres). This
decrease is due to the preliminary nature of the FONSI and the assumption of 25 linear feet of
impact beyond the slope stakes which have been reduced during fmal design. In addition, the
avoidance of Wetland WF (temporary impacts only) in the final design of the project has reduced
proposed wetland impacts.
Compensatorv Mitigation
Compensatory mitigation requirements for U-5317 are surninarized below in Table 4. This project
will permanently impact 273 feet of warm water streams. Of these 273 feet, there is 23 feet of bank
stabilization that does not require mitigation by the USACE. The remaining 250 feet of perennial
siream impacts requires mitigation. The project will also permanently impaci 1.559 acres of
riparian wetland.
The USACE is requiring 2:1 mitigation for 250 feet of permanent perennial stream impacts and for
1.559 acres of permanent riparian wetland impacts. The mitigation requirements of 500 feet of
permanent warm water stream impacts will be provided by the NCDMS for U-5317 (Table 4).
This project will also permanently impact 1.559 acres of wetlands for which the USACE will
require a 2:1 mitigation ratio. The mitigation requirement of 3.25* acres of permanent wetland
impacts will be provided by the NCDMS for U-5317. In addition, the USACE does not require
mitigation for open water/pond impacts.

FEDERALLY PROTECTED SPECIES
Plants and animals with a Federal classification of Endangered (E) or Threatened (T) are protected
under provisions of Section 7 and Section 9 of the Endangered Species Act (ESA) of 1973, as
amended. As of April 2, 2015, the U.S. Fish and Wildlife Service (USFWS) lists four federally
protected species for Wake County: red-cockaded woodpecker (Picoides borealis), dwarf
wedgemussel (Alasmidonta heterodon), Michaux's sumac (Rhus michauxii), and northern long-
eared bat (Myotis septentrionalis).
No habitat exists within the project study area for red-cockaded woodpecker and dwarf
wedgemussel. Kimley-Horn staff biologists conducted surveys for Michaux's sumac on July 2,
2013. No individuals of Michaux's sumac were observed in the project study area. The biological
conclusion of "No Effect" remains valid for the red-cockaded woodpecker, dwarf wedgemussel,
and Michaux's sumac.
The US Fish and Wildlife Service has developed a programmatic biological opinion (PBO) in
conjunction with the Federal Highway Adininistration (FHWA), the US Army Corps of Engineers
(USACE), and NCDOT for the northern long-eared bat (NFLEB) in eastern North Carolina. The
PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and
activities. The programmatic determination for NLEB for the NCDOT program is "May Affect,
Likely to Adversely AffecY'. The PBO provides incidental take coverage for NLEB and will ensure
compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects
with a federal nexus in Divisions 1-8, which includes Wake County, where U-5317 is located.
CULTURAL RESOURCES
An architectural survey was performed in January 2014, which concluded that two resources (both
part of the Tobacco Growers' warehouses near NC 42) were recommended for intensive study to
deternune if they are eligible for the National Register of Histaric Places (NRHP). In a letter dated
February 6, 2014, the State Historic Preservation Office (SHPO) requested a Historic Structures
Survey Report to evaluate the two sites, which was completed and approved on May 23, 2014.
Based on the findings of that report, SHPO concurred that the Brown Tobacco Redrying and
Storage Facility in the northwest quadrant of Bridge Street and the railroad is eligible far listing on
the NRHP, and that all of the detailed study alternatives, to include the proposed preferred
alternative, have "no effect" on this property. The second site was determined not to be eligible for
listing on the NRHP.
A memo from SHPO (April 16, 2013) noted that there are no recorded archaeological sites located
within the project study area, but that there is a moderate probability for the presence of both
Native American and histaric period archaeological resources. The letter recommended that when a
preferred alternative has been selected, information be forwarded to the SHPO office for their
evaluation of potential effects. No NRHP archaeological sites were identified in the Area of
Potential Effect (APE) during the July 2015 survey, and SHPO concurred via their September 25,
2015 letter that no additional investigations are required for this project.

FEMA COMPLIANCE
There are no Federal Emergency Management Agency (FEMA)-designated 100-year floodplains or
regulatory floodways within the proposed project limits. Therefore, no change to a FEMA-
designated 100-year floodplain or regulatory floodway is anticipated as a result of this project.
INDIRECT AND CUMULATIVE EFFECTS
An Indirect and Cumulative Effect (ICE) screening was completed in January 2014. Indirect and
cumulative effects were considered for the time period between now and 2030, which is the horizon
date of the Fuquay-Varina Community Transportation Plan (September 2006). In addition, the
CAMPO Long Range Transportation Plan has a horizon date of 2035, and the Research Triangle
Region 2040 Metropolitan Transportation Plan (Apri12013) has a horizon date of 2040.
Indirect Effects: Indirect effects are characterized by those changes in land use related to the
proposed project but not directly caused by the project. Construction of this project is expected to
have a minor indirect effect on land use decisions in the vicinity.
This project will change access to several roads, including creating new intersections on NW Judd
Parkway at Coley Farm Road, Washington Street, and Wilbon Road. Bridge Street will be
realigned to intersect with NW Judd Parkway at the same location as Three Meadows Road. These
changes, which are part of all three detailed study alternatives. This project is anticipated to reduce
travel time approximately 25%, from 5.5 minutes to 4 minutes between NC 42 and NC 55.
Growth in the vicinity is anticipated regardless of construction of NW Judd Parkway, although
development along the corridor itself may occur more quickly if the road is built. Continued gowth
is expected in the rest of the vicinity with or without the project. Water and sewer services are
generally available within the vicinity, although the edge of the Town's sewer service area is just
west of the study area, and local staff expect that the lack of sewer facilities will likely limit
development further to the west.
Cumulative Effects: Cumulative effects represent the total anticipated direct and indirect effects
resulting from the project, in addition to those effects by other projects in the vicinity.
Three other transpartation projects in the area are listed on funded transportation plans. NCDOT is
studying Project R-2609, the US 401 Corridor Study, a proposed regional connector on new and
existing location. The Complete 540 project (Projects R-2721, R-2828, R-2829) would extend the
Triangle Expressway from the NC 55 Bypass in Apex to the US 64/iJS 264 Bypass in Knightdale.
Right-of-way acquisition and construction are not currently scheduled for either project.
The CAMPO 2040 Long Range Transportation Plan lists the Western Bypass (Project A511),
which will widen existing Piney Grove-Wilbon Road west of the U-5317 study area to four lanes.
It is listed in air quality confornuty year 2040.
In the project vicinity, several residential developments are under construction or have recently
been completed. Most developments are in southwest Fuquay-Varina, many of which are along the
SW Judd Parkway corridor. Gray's Creek, a new subdivision with 298 approved units, is under

construction immediately west of the proposed NW Judd Parkway, but the new subdivision will not
connect directly with NW Judd Parkway.
Conclusion. Cumulatively, this project and other planned transportation improvements are
expected to enhance mobility and improve travel time locally and regionally. Local planners expect
that the proposed project will have only a slight impact on the level or pace of development.
Recent and current development in the vicinity has primarily been concentrated near the southern
and northern project termini. If the NW Judd Parkway is built, some additional development may
occur along the corridor between those areas. However, growth in the area is expected with or
without the project.
Water and sewer are generally available within the vicinity of the project. The western boundary of
the Town's extraterritorial jurisdiction is approximately the edge of the Town's sewer capacity.
Local staff expects that lack of sewer facilities will likely limit development further west, but the
Town does not have current plans to expand services within the remaining areas.
Direct natural environmental impacts by NCDOT projects will be addressed by avoidance,
minimization, or mitigation, consistent with programmatic agreements with the natural resource
agencies during the Merger and Pernutting processes. All developments will be required to follow
local, state, and federal guidelines and permitting regulations
WILD AND SCENIC RIVERS
This project will not impact any designated Wild and Scenic Rivers ar any rivers included in the
list of study rivers (Public Law 90-542, as amended) or North Carolina Natural and Scenic Rivers.
ESSENTIAL FISH HABITAT
The project will not impact any essential fish habitat afforded protection under the
Magnuson-Stevens Act of 1996 (16 U.S.0 1801 et seq.).
REGULATORY APPROVALS
Application is hereby made for a Department of the Arxny Section 404 Individual Permit as
required for the above-described activities for the proposed T.I.P. Project U-5317. We are also
hereby requesting a Section 401 Water Quality Certification from NCDWR. In compliance with
Section 143-215.3D (e) of the NCAC, we will provide $570.00 to act as payxnent for processing
the Section 401 permit. We are providing two copies of this application to NCDWR for their
review and approval.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the
table below. Please nate that this decision does nat assure that participation in the DMS in-lieu fee mitigation
program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility
of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must
also comply with all other state, federal or local government permits, regulations or authorizations associated with
the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this
acceptance will expire. It is the applicanYs responsibility to send copies of the permits to DMS. Once DMS
receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in-lieu fee to be paid by an
applicant is calculated based upon the Fee Schedule and policies lis#ed on the DMS website.
Based on the information supplied by you in your request to use the DMS, #he impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the impact
amounts shown below.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
