Transportation (NCDOT) has scheduled to clear, grade, drain, base and pave SR-2196, in Harnett County Total project length is 1 183 miles The roadway will be widened from 16 feet to 20 feet and -Telephone (910) 437-0207- Fax (910) 486-1959 r Construction of SR 2196 will require stream and wetland impacts within the Cape Fear River Basin The permit sites convey drainage to UT's of Gum Swamp (Class C) This project is located within the 03030004 Hydrologic Unit SR 2196 was partially improved during the NC 87 widening project (R-2238) At that time approximately 0 21 miles of SR 2196 was relocated and paved in order to provide access for residents to NC 87 The remaining 1 183 miles is a dirt road The NCDOT assumed SR 2196 into the state roadway system in 2005 The Department has rough graded the road in order to make it passable Permit site #1 is located at (Sta 1+85) Jurisdictional wetlands have been identified both up and down stream of the roadway Minor impacts will occur due to the placement of fill necessary for a safe road section The UT to Gum Swamp currently is conveyed under SR 2196 by a 40 LF 24" CP The pipe will be removed and replaced with a 56 LF 24" RCP The existing pipe is perched so it will be buried 5 inches below the invert of the UT to Gum Swamp Permit site #2 located at (Sta 8+0) impacts a small (0 006 ac) wetland dust upstream of the culvert crossing The existing 63 LF 24" CP conveys intermittent flow under SR 2196 and discharges into an excavated pond The pond will be filled with 0 022 acres to provide a safe roadway cross-section A 64 LF 24" RCP will be installed at an identical elevation and grade The pipe will be replaced only because of questionable materials used in private developments It is unsure if the pipe is actually reinforced concrete Permit site #3 is located at (Sta 21+50) Wetlands were identified both up and down stream of SR 2196 The wetlands have been disturbed by logging activities The road improvement project will impact upon 0 044 acres of wetlands The existing 33 LF 24" CP will be removed and replaced with a 56 LF 24" RCP Permit site #4 is located at (Sta 38+40) Once again, wetlands were identified up and down stream of SR 2196 Wetland impacts total 0 081 acres due to fill material The existing 36 LF 24" CP will be removed and replaced with a 56 LF 24" RCP Permit site #5 is located at (Sta 45+30) A 0 032 acre area of wetlands will be filled This area has also been disturbed due to land clearing activities The existing 24 LF 15" CP will be removed and replaced with a 56 LF 18" RCP RESOURCE STATUS In general, there will be minor impacts proposed as a result of the replacement of the culverts along SR-2196 (Bullard Rd ) in Harnett County Ninety two (92) linear feet of stream impacts are expected, along with 0 207 acres of Wetlands and 0 022 acres of open water impacts Each culvert site has undergone human manipulation A Nationwide Permit #14 / NCDENR 401 WQC 3704 is required for the project Endangered Species: Plants and animals with Federal classification of Endangered (E) or Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended As of January 29, 2004, the U S Fish and Wildlife Service lists six federally protected species for Robeson County Federally Protected Species for Harnett Protection These species are not biologically endangered or threatened and Are not subject to Section 7 consultation A biological conclusion of "No Effect" was reached for all species during the July 23, 2007 survey for protected species Protected species were not identified, nor, was the general habitat for each species identified REGULATORY APPROVALS Application is hereby made for a Department of the Army Nationwide Permit 14 / NCDENR 401 WQC 3704 as required by the above-described activities The National Register was reviewed in addition to conducting a field view of the project for significant historic features The project impacts are minor in nature and should not remove or degrade existing water quality uses Pipe sizes proposed are the minimum necessary to create a safe highway while accommodating the 25-year design storm There is no record within the NCDOT District 2 Office (Harnett County) that the road experiences flood overtopping By utilizing erosion control measures, downstream water quality standards will be protected All appropriate BMP's will be utilized during construction Attached is a Preconstruction Notification Form, plan sheets, marked county Mitigation DWQ - In accordance with 15A NCAC 2H 0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed Examples of mitigation that may be appropriate and practicable include, but are not limited to reducing the size of the project, establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams, and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version ) 1 Provide a brief description of the proposed mitigation plan The description should provide as much information as possible, including, but not limited to site location (attach directions and/or map, if offsrte), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e g , deed restrictions, conservation easement, etc), and a description of the current site conditions and proposed method of construction Please attach a separate sheet if more space is needed Mitigation will be provided by EEP via quarterly reports 2 Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP) Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form For additional information regarding the application process for the NCEEP, check the NCEEP Updated 11/1/2005 Page 10 of 13 website at http //www nceep net/pages/inlieureplace litm If use of the NCEEP is proposed, please check the appropriate box on page five and provide the following information Amount of stream mitigation requested (linear feet) 0 LF Amount of buffer mitigation requested (square feet) 0 Ft' Amount of Riparian wetland mitigation requested (acres) 0 Acres Amount of Non-riparian wetland mitigation requested (acres) 0 Acres Amount of Coastal wetland mitigation requested (acres) 0 Acres IX.
