We have thoroughly searched our records and files and have concluded that a Department of the Army permit issued to Mr. Hamer Ward was in 1969, authorized the construction of a private bulkhead, boat ramp and pier on the property in question. In addition, T have enclosed several General Permits that have authorized the maintenance and repair of these structures subsequent to the original permit. According to our records no other permits have been issued to Homer Ward at this Location. Ward: Reference is made to our recent telephone conversation concerning any permits that may have been issued to Homer Ward at 15 i2 I3urnett Road, adjacent to Myrtle Grove Sound, Wilmington, After a comprehensive search of our on-site permit files, as well as a search of our permit tracking database, the only pern~its Coastal Area Management Act (CAMA} and/or State Dredge and Fill Law permits that I can find that have been issued to Homer Ward were (1 } a general permit for a boat slip in 1992, and (2} a general permit for a bulkhead in 1993. Additionally, two general permits for bulkheads were issued to Mr. Tim Ward at the site in 2004. 1 would also like to let you know that Mr. Tim Ward is in the process of applying far a CAMA Major Permit to dredge a portion of the property in front of his property, and to construct a multi-slip docking facility. As an adjacent property owner, Mr. Ward will be required to notify you of his intentians to apply for this permit, and you may provide any specific comments you have on the proposed project at that time. As we have previously discussed, the fact that Mr. Ward is applying for a permit does not mean that a permit will be issued. A decision on whether or riot to grant a permit will only be made after coordinating with various state and federal environmental review agencies. I hope that the above information is useful. Ff. iaard - dated 1-12-71 While flying with Pilot Arthur Rose January 11, we observed a dredging operation in Myrtle Sound an the west side of the I~t appraximately 1/2 mile south of the Carolina Beach Inlet. Mr, Ward was having the dredging done by Harrelson & Thomas {co-owners of dredge DWAR ~lOQl}, I stopped and talked with the dredge owners and with Mr, Ward. No CAD permit had been applied for. A federal permit was obtained for construction of the bulkhead and to fill within the bulkhead, but not for excavation of fill materials from submerged bottoms. The federal permit is No, W-661 dated Becember 2, 1968, Z informed Mr, Ward that he must obtain a State permit for any dredge and fill work begun after January 1, 19~Q, in addition to his federal permit, and also that the federal permit obtained did not cover dredging which is presently being done, Z also mentioned to Mr. Ha.rrelsan that this is the second case in which his dredge had been involved in unauthorized dredging, Z assisted Mr, Ward in completing application forms, maps, etc, to apply for the State permit, These should reach your office at about the same time as this memorandum. From being on site, it was quite obuious that the dredging in progress was hav- ing little effect an fisheries resources of the area, and that all spoil materials were being adequately confined behind existing bulkhead. Had an application been filed, it is my opinion that there would have been no objections voiced against issuance of a permit, Since the operation was appraximately 2!3 completed, Mz'. Ward and the dredge owners were quite concerned about the stoppage of this project, Z informed them that Z had no authority to allow continuance, but I would relay the cir- cumstance to the Fisheries Commissioner for his consideration in allowing can- tinuation of the project, Jim Brawn March 30, 2006 Ms Cyndi Karoly Violet P. Raleigh, North Cazolina 27699-1650 Wilmington, N.C. 284Q9 Dear Ms Karoly, We are writing to you to make a comment about an application far a Major CAMA Permit that will allow the dredging of a primary nursery area at 1512 Burnett Road in Wilmington. The applicant for the permit is Tim Ward (Partner) Carolina Marina LLC. I do not know if you are familiar with this permit, and the history of this site, but I would like to give you a few details about the proposed site that Tim Ward, and Carolina Marina wish to build a marina upon. This property was owned by Homer Ward; Tim Wazd's dad from 1966 until his death in the year 2000. Homer Ward bought this property with a very small home on it, and he added onto that home until it became a large nice brick home. Homer Ward acquired a permit from the Army Corps Of Engineers in 1969 to build a bulkhead wall on his property, a private pier, and a boat ramp for private use. Homer built a small section of the bulkhead wall over a period of some 6 years, and he built the private pier in 1970. In January of 1971 Homer Wazd was caught illegally performing some type of dredging at this site. I will enclose the letter from the Marine Fisheries official that observed the illegal dredging, or we call it sand pumping. We have several homeowners in our neighborhood that are very familiar with this property, and they have submitted statements about this site stating that there has never been any type of dredging or marina operation in this neighborhood. We also have notarized statements from family members who were present when this violation occurred, and they do testify that this azea has never been dredged. The sand that was being pumped in 1971 behind the bulkhead wall for Homer Ward was pumped from the deep part of the navigation channel past the end of the pier owned by Homer Ward. The work was performed to acquire sand to back- fill the bulkhead wall that was being built, and not for the purpose of dredging a channel or to moor boats to the pier. Homer Ward had a permit to build the bulkhead wall, but no permit to perform any type of dredging was issued to Mr. Ward. In the letter from Jim Brown with N.C Marine Fisheries dated 1971 you will see that he helped Homer Ward to file an application to perform dredging at his property, but the application was never followed up to acquire a permit. In June of 1971 Homer Wazd acquired a Special Use Permit to build a very small marina from New Hanover County. I have submitted the permit with this letter, and a copy of the site plan from 1971. After Homer Ward received his Special Use Permit he waited until 1976, and then installed two fuel tanks on his property, and two fuel dispensers on his pier. One tank was a 2000 gallon diesel tank, and the other one was a 4000 gallon gasoline tank. The tanks were installed personally by Hamer Wazd, and the fuel dispensers. We cannot find any permits to allow the fuel tanks, and according to the Army Corps Of Engineers there was no permit acquired to place fuel dispensers on the pier. In 1979 the fuel dispensers were removed from the pier, and placed on dry land to be used for Homer Ward's personal use. The fuel tanks were reported to have been removed in 1989, and a letter was sent to the N.C. Department Of Under Ground Tanks by Homer that stated he had been out of business for over 10 years. This letter was dated March 1990, and this letter states that any type of activity that Homer Ward had on his property had been prior to 1980. We believe that one of the fuel tanks is still on this property. Some of the neighbors have seen Tim Ward, and his brother dumping the holding tanks from their Motor homes in this tank. We reported this to the New Hanover County Department of Environment, and they know of no septic tank on this part of this property. The official with New Hanover County said that unless he personally saw this activity, or photographs were taken of this activity they could do nothing about it. It would be terrible if one of these fuel tanks does still remain on this site, and if it should leak. These tanks were some 75 feet from the water, and this area is open to shellfish harvesting, and is a vital habitat for the marine life in this area. This property over the years was illegally filled into the waterway with truck loads of dirt by Homer Ward. In 1992 Homer Ward was caught pulling sand from out of the waterway with his tractor to fill his property by Terry Barrett with the N.C. DENR. After this violation Homer Ward in 1993 acquired a permit to build the remainder of his bulkhead wall from the N.C. DENR. It was after the completion of his bulkhead wall in 1993 that Mr. Ward had a concrete boat ramp built on his praperty. This was long after the 1969 Army Corps Of Engineers permit to build a boat ramp had expired. Homer Ward never rented boat slips to the public, and as you can see the boat ramp was never used except for private use. Homer Ward had a Special Use Permit to build a small marina, but he never built what was on his permit, except to place fuel dispensers on his pier. The fuel dispensers were built without a state or federal permit. What we are trying to make clear is that this site has only been used for residential use. There was a large beautiful home on this property until Tim Ward had it demolished in December 2004. We found out in December of 2002 that a Special Use Permit existed with this property to build a small marina. Tim Ward went to the New Hanover County Planning Board in December of 2002 to ask for an addition to the permit to include a 112 boat dry stack storage building, a restaurant, and a boat, and boat motor repair shop on this property. The Planning Board unanimously turned it down. Since December of 2002 the neighborhood has hired several attorneys to try to stop this marina from coming into the neighborhood, and ruining the environment where we live. Tim Ward has made many false statements to New Hanover County to keep this old Special Use Permit alive, and has tried on three different occasions to acquire dredging permits for this site. Unfortunately for us the county bought into these false statements before we could supply the evidence to sway them differently. The Special Use Permit is so old that it has no time limit for it to run out, and it can be a hundred years from now according to the county, and this permit will still be valid. In the applications for the dredging permits Tim Ward has stated that this site had a dredging permit from the Army Corps Of Engineers, and that maintenance dredging had been performed at this site. This is absolutely false, and this latest attempt to try to acquire a dredging permit by using a violation letter from 1971 is beyond any reason. Carolina Marina LLC has been issued a permit from the NCDWQ for the storm water retention on this site. This property is at approximately 7 ft. above sea level in elevation, and it has ground water at a high level where the drain fields are planned to be located. This site will have two ten thousand gallon fuel tanks above ground placed near the bulkhead wall, and we are almost directly across from the Carolina Beach Inlet. Actually we are just a little south of the inlet, but we are looking into the ocean. Whenever we have a hurricane the tide surge comes through the inlet at a counter clockwise movement, and the surge hits us directly without any land mass to stop it. We believe these fuel tanks will be toppled over in the event of another storm as large as Fran, and we will have fuel in the waterway to ruin the environment here for many years. The storm water retention plan shows that there will be 4 ft. tall concrete pipes installed for several hundred feet to collect the storm water, and that they will be placed at a level elevation. These pipes will hold hundreds of gallons of water, and pollutants from the boats in dry storage for days on end until they are filled with enough water to force the level high enough that the water will be pumped to a drain field at the front of this property. These drain fields are in a close proximity to several water wells that supply drinking water to other homes adjacent to this site. We fear that benzene may end up in the water that we drink as well as other pollutants that will drain from the dry stack boats leaking, and being washed down into this retention system. Tim Ward has stated that the owners of the boats will be able to wash the boats at this facility. There is a pipe that allows the over flow from this system once it fills up, and it will drain into the marshlands behind this site. The owner of this property has plans now he has submitted to the County Commissioners here in New Hanover County to build a 220 boat Dry Stack storage facility. These boats along with the repair shop, a restaurant, and bait shop on 2.8 acres of land is far too much for this property to handle. The storm water retention system is approved for a much smaller marina facility plan that was submitted, but now the amount of impervious area has greatly multiplied. Cyndi I do hope that we haven't bored you to death with this long letter, and I hope that you can see the point that we are trying to make clear to everyone. This property has only been used for a residence, and the pier, and boat ramp that is on this property has been used only by the owners of this site. No marina has ever existed at this site before, or after the 1971 Special Use Permit was issued. It would be a true shame to allow this area to now be forever changed with a 35 year old permit, and ruin the primary nursery area directly behind this site. The N.C. Games and Fisheries have tested this site, and found it to be abundant with clams, and an essential fish habitat. We are directly across the waterway from a Sea Turtle nesting area, and many other endangered species do inhabit this area This area is used by the public to swim and to relax in a safe, and quiet atmosphere. Many people enjoy fishing, and enjoy the clams, and other shellfish that do thrive behind the proposed site of this marina. North Carolina General statute 113-118.1 (e) states that DENR may deny a dredging permit if (1) that there will be significant ~° adverse effect of the proposed dredging and filling on the use of the water by the public; or (2) that there will be significant adverse effect on the value and enjoyment of the property of any riparian owners; or (3) that there will be significant adverse effect on public health, safety, and welfare; or (4) that there will be significant adverse effect on the conservation of public and private water supplies; or (5) that there will be significant adverse effect on wildlife or fresh water, estuarine or marine fisheries. This dredging permit as we have demonstrated by this letter will violate all five of these conditions. If it is not your opinion that all five conditions will be violated; then if even one condition is violated then it is within your power to deny this permit. We hope that you may be able to help us to save this natural habitat so that our family, and future generations living, and visiting this area will be able to enjoy it. Carolina. I have lived in Wilmington far aver 54 years, and was a carpenter contractor by trade. I did remodel and build pauses, and perform various types of work an residential., and commercial buildings_ I was a contractor for over 45 years. I did witness the building of the pier at Hamer Ward's residence in 1969 through 1971. I did perform work at Homer Ward's home many times over the years. I built the pier house on his pier, and the wooden ramp along the side of the pier. I built the concrete block walls on both sides of Homer Ward's property. I have personal knowledge, and have witnessed teat Hamer used his pier house for storage, and for a place to relax in the cool breeze while drinking beer. He did not use the pier house for a stare during. the times I have worked or visited at his residence. When I was building the pier house I observed a man with a small Name made wooden barge pumping sand for Homer Ward. Hamer hired this man to backfili his bulkhead that had. recently been built. The satxl was Bumped from out of the channel past the farthest end of the pier. No sand was pumped fmm around the pier. I remember this because I walked around. the pier at law tide while I was working an the pier. I assisted in placing the timbers behind the bulkhead wall during the filling of the bulkhead. The person pumping the sand did not pump very much sand before an official with the state came by, and stopped him from pumping. the sand. I recall that he was there far about two days. I performed tpe work on tpe pier house in the winter of 1974, and worked there through the fall of 1971.It was about the beginning of the year in 1471 when Hamer had the sand pumped behind his bullchead~ I worked on the pier, the concrete block walls, and T built the lower wooden ramp an the side of the pier during this time. There were only three pilings that were on the south side of the Bier. I da not recall seeing mare than three pilings over the years. Homer had his personal boats tied to the pier wpen I was building the pier house and no ether boats were moored there. I have only seen Homer Ward's personal boats tied to the pier over the years that I have visited his hams. I asked Hamer if he was going. to get a permit after the state a#~cial stopped him from pumping sand, and pe replied no. I was worried that the state official would stop the work I was doing on the pier. Homer did not pave a permit for the pier house, ar the wooden ramp T built. The man with the home made barge left the day that the state official came by, and did not return while I was there. I did not see him pump but a few loads of dirt from out of the navigation part of the water way. Homer hired. a man to pump sand from out of the deep part of the waterway to fill behind the bulkhead wall he had built near the beginning of 1971.The sand was pumped from out past the pier, and not from around the pier. I remember talking to Homer about the sand pumping, and he informed me that he did not have a permit to do this work. Hamer stated he would not get a permit even after he was caught pumping the sand. I have never witnessed any type of marina operation at this site. Homer was a very private person, and would not allow anyone except for his family on his property. Homer never had any boats moored to his pier except for his, or his son's boat. Homer never operated a store to sell goods from on his pier.. There could not have been any dredging performed from around the pier, because there was no water at low tide to float the boats tied to the pier.
