Sullins, Director Division of Water Quality September 30, 2008 DWQ# 08-0793 Ashe County CERTIFIED MAIL: 7008 0150 0002 7876 7556 RETURN RECEIPT REQUESTED Mr. Glen Grubb Blue Ridge Electric Membership Corporation PO Box 112 Lenoir, NC 28645 Re: Section 401 Water Quality Certification application Dear Mr. Grubb: On May 19, 2008, the North Carolina Division of Water Quality (Division) received your application for a 401 General Water Quality Certification to impact 142 linear feet of stream in order to develop property in West Jefferson in Ashe County. Additional information was provided to the Division on August 12, 2008 and September 4, 2008. Additional information is still required in order that we may determine your project's compliance with 15A NCAC 2H.0500. The DWQ will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may continue to review your project. 1. The Division is aware that the Army Corps of Engineers is currently reviewing a pre-existing pipe on your property and how it relates to the current permit application. Please note that this issue must be resolved in order for the Division ensure issuance of the appropriate corresponding 401 permit. 2. Please note that the cross-section of the Wet Pond that was provided shows that the vegetated shelf is designed as a level surface. Per the Division BMP manual, the vegetated shelf should be on a 10:1 slope. This deficiency was noted in our previous letter and appears to have been corrected only on the plan sheet, not the cross-section. The plan view and profile view of the BMP must be in agreement. Please note that the plans show that the permanent pool elevation is now designed above the vegetated shelf. Per the Division BMP manual, the permanent pool elevation should be 6" above the inside edge of the shelf. This deficiency was noted in our last letter. Please note that changes to the permanent pool elevation will require review of other major design elements to ensure that the Wet Detention Pond still meets all required design elements. A corrected/modified BMP Supplement Form should be submitted showing all changes. 4. The SA/DA ratio provided is insufficient to meet the ratio required per Table 10-1 of the BMP Manual. Please submit the Wet Detention Pond BMP Supplement Form - Required Items Checklist. Please note that this form was requested in our previous letter, item #2. This form is page 2 of the BMP Supplement Form. Be sure that all items identified on the Required Items Checklist are clearly evident on the plans that were submitted, or submit modified or additional plan sheets. 6. Per the DWQ - Stormwater BMP Manual, Wet Detention Pond Major Design Elements, please provide a BMP design that provides for vegetation stabilization above the permanent pool elevation. This grassed vegetation should clearly be shown on the plans. 7. The sediment cleanout elevation is noted as 965.00 ft on the BMP Supplement Form and the plans provided, however the O&M agreement provided notes this elevation as 964.00. Please ensure that the O&M agreement is accurate after changes are made to the design of the Wet Detention Pond per the items noted above. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to Sue Homewood at the address on this letterhead, and a copy to Ian McMillan N. C. Division of Water Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
