The Corps of Engineers belie�es that there may be jurisdictional waters of the United States on the subject site, and the permit applicant or other affected party who requested this preliminary JD is hereby ad�ised of his or her option to request and abtain an approved jurisdictional determination {JD) for that site. Nevertheless, the permit applicant ar other person who requested this preliminary JD F�as declined ta exercise the option to obtain an approved JD in this instance and at this time. 2. ln any circumstanoe where a permit applicant obtains an indi�idual permit, or a Nationwide General Permit {NWP) or other general permit verificafion requiring "pre-consfructian not�icationp (PCN), or requests �erification for a non-reparting NWP or other general permit, and the permit applicant has not requested an appro�ed JD for the activity, fhe permit applicant is hereby made aware af the following: (1) the permit applicant has elected to seek a�ermit aut#�arization based on a preliminary JD, which does not make an official determination of jurisdictional waters; (2) tha# the applicant has the option to request an appro�ed JD before accepting the terms and conditians of the permit auihorization, and that basing a permit au#horization on an approved JD oould possibly result in less com�ensatory mitigation being �equired or different special conditions; (3) that the applicant has the right to re�uest an incfividual permit rather than accepting the terms and conditions of the NWP or other generai �ermit authorization; (4) that the applicant can accept a permit autharization a�d ti�ereby agree to comply with ail the terms and c�ondi�ions of that permit, including whatever mitigation requirements the Corps has determined ta be necessary; (5} that undertaking any activity in reliance upon the subject permit authorization without requesting an appro�ed JD constitutes the applicant's acce�tanoe of the use of the preliminary JD, but that either form af JD will be processed as soon as is practicable; (6} acceptir�g a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in relianoe on any form af Corps permit authorization based on a preliminary JD constitutes agreemen# that all wetlands and other water bodies on the site affected in any way by tha# acti�ity are jurisdictional waters of the United States, and precludes any challenge to such jurisdiction in any administrati�e or judicial oompliance ar enforcement action, or in any adrr�inistrative appeal or in any Federal court; and (7) whether the applEcant elects to use either an approved JD or a prefiminary JD, that JD will be processed as soon as is practicable. Fu�ther, an approved JD, a proffered individual permit (and all terms and conditions contained therein), ar �ndividual permit denial can be administrati�ely appealed pursuant to 33 C.F.R. Part 339, and that in any administrative appeal, jurisdictional issues car� be raised (see 33 C.F.R. 331.5(a)(2)}. If, during that administrative appeal, it becomes necessary to make an official deterrnination whether CWA jurisdictio�r exists aver a site, or to provide an official delineation of jurisdictional waters on the site, the Corps will provide an approved JD #o accamplish that result, as soon as is practicable.
