Mr. Sugg,
I left you a voice mail this afternoon and wanted to follow up via email.
In reviewing your 401 application for Hawthorne at Mills Gap, I realized that you have not submitted a copy of the
approved Stormwater Management Plan with proof of City of Asheville's approval to DWR. This is a requirement before
any impacts can occur. The Stormwater Management Plan must include details on full-sized plan sheets and should be
submitted to the DWR 401 & Buffer Permitting Unit (1617 Mail Service Center, Raleigh, NC 27699-1617).
I visited the site today with our hydrogeologist to observe the stream. We did observe a film on the stream but
determined that it was due to bacteria. If you have any questions regarding ground water incident 5229 located on the
adjacent property, owned by Amcor Flexibles, please be in touch with Brett Laverty at 828-296-4681. As I have stated in
previous emails, concentrations of the contaminant 1,2-dichloropropane have been detected in the stream in prior years
due to ground water contamination.
