Protection at the South Fork Catawba River - NCDWR 17-0585 - Update
Dear Mr. Johnson:
This letter and updated supporting information are being submitted on behalf of our client, Kinder
Morgan, to provide additional information about the proposed pipeline protection in the South Fork
Catawba River, Gaston County, North Carolina. The proposed pipeline protection design remains the
same but the project access is being shifted from the east side to the west side of South Fork Catwaba
River. Kinder Morgan has reached an agreement with the west bank property owner to use an existing
paved parking area outside the Kinder Morgan right-of-way (ROW) as the staging area for vehicles and
the grout pump.
The access for the proposed project area will be from the ROW on the west bank of the South Fork
Catawba River. The parcel that will be used to access the ROW includes a former yarn manufacturing
facility and the property owners are Selkirk Reality, Inc. (see attached parcel map). The parking lot and
road associated with the former manufacturing facility would be utilized as the primary staging area and
would be the location for the diving trailer and the grout pump. Use of this existing impervious area will
reduce the potential for erosion in the ROW and will provide for greater secondary containment of the
grout pump. The ROW would be utilized as a secondary staging area, primarily for the divers. There is
an existing path from the parking area to the ROW and no vegetation clearing would be required for use
of the parking area for staging.
The temporary work space will extend across the river to accommodate the hose that would extend
from the grout pump and would be used to fill the Ercoform E-80 mat. Kinder Morgan woud place a
Rock Shield around the pipeline and the grout mat would be installed over an area approximately 35
feet wide and 85 feet long. This would result in the placement of 49 yd 3 of fill below the ordinary high
water mark in South Fork Catawba River.The permanent impact area remains the same as show in the
design drawings submitted with the initial application.
Additionally, the USACE has indicated that the USACE Nationwide Permit 3 may be used in lieu of
Nationwide Permit 12 to authorize this work under the Clean Water Act. Kinder Morgan also has
provided this updated information to Ms. Catherine Janiczak of the U.S. Army Corps of Engineers
(USACE), Wilmington District, Asheville Office, for inclusion in the review of the Nationwide Permit
Application.
