WBS # 17BP.1.R.82 Dear Mr. Barnes, The North Carolina Department of "I'ransportation is requesting the issuance of a NW 3 permit, conesponding 401 Cei�tification and Buffer Authoriza�tion for the replacement of Bridge # 14 over Rattlesnake Canal on SR ll 08 White Plains Road in Hyde County. The bridge is located over a inan-made canal that di•ains south, flowing into the Pamlico Sound approximately 1 mile downstream. Rattlesnake Canal does not have a designated water classification, but carries the designation of the receiving water in the Pamlico Sound, which is SA, HQW. The Pamlico Sound within this area is considered a productive primaiy nursery area for• juvenile species, which extends up into the lower reach of Rattlesnake CanaL Therefore, the NCDMF has requested an in-water work moratorium extending froin April 1— September 30t�'. This region of Hyde County is within the Tar-Pamlico River Basin. �Fhe Division of Water Resources considers Rattlesnake Canal, subject to the DWR buffer rules, up to and at the location of the bridge structui•e. The bridge design has aecounted for avoidance and minimization efforts for buffer impacts, which are illustrated in the provided permit drawings. Bridge # 14 was built in 1960, and consists of a 35' long X 26' wide, 2-span wood structure and deck with asphalt wearing surface and wood bridge rails. This structure will be entirely removed using NCDOT's BMP's and guidelines for bridge removal. The proposed bridge will be replaced along its existing aligninent. The new bridge will be a 1-span structure totaling, 55' in length by 30' wide. It will be comprised of a precast concrete deck and substructure. Jurisdictional wetland and surface water impacts have been avoided and minimized to the maximum extent practicable. All wetland iinpacts have been avoided on this project. Tar-Pamlico Buffer Impacts are primarily associated with the unavoidable shift in aligrllnent to SR 1111, which currently ulter•sects SR 1108 (White Plains Rd) at the westeril bridge abutment. This intersection needs to be slightly shifted west to allow for the replacement of Bridge # 14 with a single span concrete structure. SR 1111 is a secondary gravel t•oad that parallels Rattlesnake Canal. There will be no deck drains located on the bridge. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Land use within the project vicinity consist of primarily row crop agriculture and rural residential home sites. There is some property in the vicinity that is in a private conservation easement Wysocking Bay Sanctuary. Rattlesnake Canal, which bridge # 14 crosses is a man-made drainage canal that was built for agricultural lands and farm production. There is some public boat usage of the canal from the bridge south towards the Pamlico Sound. Navigation upstream of the bridge, is not passable do to the low clearances of bridge # 14. SR 1108 White Plains road is a NCDOT secondary 2 lane paved road that serves citizens along the eastern side of Hyde County. 3b. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property: 60' (along main canal) at the bridge. The adjacent roadside canal/ditch on SR 1108 is approximately 150' on the west, and 300' to the east. 3d. Explain the purpose of the proposed project: The purpose of this project is to replace an aging bridge structure that has received deficiency ratings, qualifying it for replacement. NCDOT wants to maintain SR 1108 as a safe and reliable travel route for the public. The replacement of this aging structure will insure highway connectivity and long term use of SR 1108 in Hyde County. 3e. Describe the overall project in detail, including the type of equipment to be used: NCDOT proposes to replace an existing 2 span at 35 ft. by 26 ft. wood bridge structure, with a new 1 span 55 ft. long by 30 ft. wide cored slab concrete bridge. This will be done with top down construction and utilizing and off-site traffic detour. There will be no deck drains located on the new bridge. The existing bridge will be removed in its entirety, by following NCDOT BMPs and guidelines for bridge removal. The bridge approach roadway sections will have to be slightly widened and increased in elevation to match the new bridge structure design. fn conjunction with the bridge replacement, a slight shift west in the SR 111 intersection needs to be made. This will require the replacement of an existing drainage pipe that ties the roadside canal/ditch into Rattlesnake Canal. The new proposed pipe will be 2— 30" aluminum corrugated pipes. There is also an 18" corrugated aluminum driveway pipe on the east side of the bridge which will be replaced to restore proper drainage function. The proposed work is illustrated on the provided permit drawings. The new bridge will be built using cranes, excavators, backhoes, dump trucks, and small equipment associated with bridge construction. 4. Jurisdictional Determinations 4a. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. NCDOT minimized the roadway width by narrowing the shoulders and bridge width to the minimal amount allowable with the design speed and roadway geometry. There are no deck drains located on the bridge. The existing bridge demolition will follow NCDOT BMP's for bridge demolition work Erosion and Sediment control plans have been designed and will be followed to retain any runoff from construction activities. An off-site detour is being utilized to eliminate an additional wetland and surtace water impacts. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Utilizing BMPs for bridge demolition will capture all components of the old structure. Erosion and Control measures will be placed along the entire project area to reduce soil runoff. A turbidity curtain can be utilized along the banks of Rattlesnake Canal to capture any siltation that may occur during project construction. NCDOT will follow an in-water work moratorium from April 1- Sept 30"' to prevent any detrimental effect on juvenile fish that may be in the project area waters. The utilization of precast concrete materials, reduces the potential for uncured concrete entering the adjacent waters. 2. There is habitat for the West Indian Manatee, however the project has an in-water moratorium from April 1— September 30"', which eliminate the possibility of any in-water interaction with a Manatee. With regards to the Northern Long Eared Bat: he US Fish and Wildlife Service has developed a programmatic biological opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), the US Army Corps of Engineers (USACE), and NCDOT for the northern long-eared bat (NLEB) (Myotis eptentrionalis) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO provides incidentai take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Hyde County, where Bridge # 14 is located. 6.
