Aimy Corps of Engineers 151 Patton Avenue, Room 208 Asheville, NC 28801-2714 Subject: Nationwide 18 Permit Application Construct River Access on Tuckasegee River off Island Street Swain County Dear Mr. Brown: Coinmunity Services of Swain, Inc. is proposing to construct a river access on the Tuckasegee River off Island Street in the Town of Bryson City. Vaughn and Melton has been retained to design and permit the project. The proposed project entails the installation of a gravel pad, concrete stairway, and concrete pad on the bank of the river to provide access far small boats, canoes, kayalcs and tubes. The purpose of the project is to promote recreational activities on the river. I have enclosed a PCN application, Preliminary Jurisdictional Determination Form, a No-Rise Certification, SHPO and THPO forms, plan sheets showing the proposed work, a USGS topob aphical map, and photographs. Threatened and Endangered Species The US Fish and Wildlife Service lists 52 species for Swain County that have federal status that are knowri from current records or were known to occur in the County historically. Additionally, the bald eagle (Hccliaeetus leucocephalus) retains special protection under the Bald and Golden Eagle Protection Act. Thirteen species, Carolina northern flying squinel (Glcrucon�ys sabrinus colo�^atus), gray bat (Myotis g�isescens), Indiana bat (Myotis sodalis), Northern long-eared bat (Myotis septentrionalis), spotfin chub (E�in�onax inonachus), Appalachian elktoe (Alasfnidonta raveneliana), littlewing pearlymussel (Pegias fabula), rusty-patched bumble bee (Bof�2bus affinis) spruce-fir moss spider (Microhexura montivaga), noonday globe snail (Pane�a cic��ki nantczhala), Virginia spiraea (Spi��aea vii�ginir�na) and rock gnome lichen (Gymnodern�a linea��e), are listed as either endangered or threatened and are known from cunent records. The sickle fin redhorse (Moxostomc� sp. 1} is designated as a candidate species for listing. The North Carolina Natural Heritage Program Database lists the Appalachian elktoe and sicklefin redhorse as occurring in or near the project area. Species descriptions are below. Your Praject. Our Promise. raughn b� Melfon Consulting Engineers Appalachian Elktoe (Alc�s�nidonta raveneliana) Status: Endangered Hccbitcct Description: The Appalachian elktoe is known to occur in the Tuckasegee River watershed in North Carolina. The Appalachian elktoe has been observed in moderate- to fast-flowing water, in gravelly substrates often mixed with cobble and boulders, in cracks of bedrock and in relatively silt-fi•ee, coarse, sandy substrates. Apparently, stability of the substrate is critical to this species, as it is seldom found in streain reaches with accumulations of silt or shifting sand, gravel, or cobble. Critical Habitat for the Appalachian elktoe has been designated in the mainstem of the Tuckasegee River in Swain County. The Critical Habitat designation ends approximately 2.0 miles upstream of the project area at the US 19 Bridge in the Governors Island community northeast of Bryson City. Recommencled Biological Coszclusion: No Effect Habitat for the elktoe is lacking at the project site. The substrate is basically cobble with heavy sand/silt in the project area (streambank) and lacks a flow regime preferred by the species. An onsite investigation was conducted on June 13, 2017 and no elktoe were observed in or near the project area. Sicklefin redhorse (Moxostomcz sp. 1) Status: Candidate for Listing Habitrct Description: The sicklefin redhorse is known to occur in the Tuckasegee River. It lives in cool to warm, moderate gradient creeks and rivers and, during at least parts of its early life, large reseivoirs. In streams, adults are typically found in areas with moderate to fast currents, though young show a preference for slow currents and large rocks providing cover. Adults feed and reproduce over gravel, cobble, boulder, and bedrock stream bottoms with no, or very little, silt. Adults live year-round in rivers and large creeks while young are largely found in lower stream reaches of creeks and rivers and appear to have even adapted to nearshore portions of certain reservoirs. Adults will migrate upstream to spawn, then downstream to forage, and finally to deeper water for winter, returning to the same spawning and wintering sites year after year. Recomrnended Biological Conclusion: Not Required for Candidate Species The habitat at the project site is not characteristic of the remaining 11 listed species except the mature sycamore trees remaining along the streambank, which may provide some potential roostinb habitat for Indiana and northern long-eared bats. No trees will be cut for the construction of the project. All instream work will be conducted in a "dry" work area to minimize impacts to downstream aquatic resources. There were no threatened and endangered species observed during the onsite investigation conducted on June 13, 2017. In addition, the lack of records and habitat in the project area, and the mitigation measures discussed above, we believe there is a very low probability that the project will affect listed species. Therefore, we recommend a finding of "no effect" for the above listed species. Your Project. It was determined that there would be "no effect" on historic architecture or archaeological resources and no survey was required (see attached forms). Impacts to Waters of the United States The Tuckasegee River (DWR Class: B) is shown on the USGS topographic map as a perennial stream. The channel is well defined with a substrate of boulders, cobble, gravel and sand/silt and is approximately 150 feet in width. The stream has sufficient flow to support fish and other aquatic life. The Tuckasegee River meets the definition of a Traditional Navigable Water and is under the jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessary to impact waters of the United States in the Little Tennessee River Basin (HUC 06010203). Listed below is a summary of the proposed impacts. Landscape is primarily commercial development on the north side of Island Street with some scattered residential housing. A new fishing pier lies approximately 200 feet east of the project site, which was constructed by the NCWRC in 2015. 3b. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The steps were designed to minimize impacts below the ordinary high water mark (OHWM). A monolithic footing for the three lower steps will be cast in place at the edge of the river. The footing will be approximately 2-feet below the OHWM. This was done to accomplish the objective of the project to provide access for small boats off the river bank. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Appropriate BMP's will be installed on the project prior to start of construction. All instream work will be performed in a "dry" work area using an impervious dike (sand bags) to divert the water around the project site. Pumps may be used to keep the foundation below the OHWM dry. Water will be pumped to an area of settlement or a silt bag will be utilized to prevent concrete contaminated water from entering the stream to avoid impacts to downstream aquatic resources.
