REQUEST FOR MORE INFORMATION
Dear Mr. Ward:
On January 25, 2006, the Division of Water Quality (DWQ) received your application dated November
11, 2005 to dredge 33,600 square feet (0.77 acres) of open water that is designated as a Primary Nursery
Area, to fi11900 square feet of open water to construct a new boat ramp, and fill 570 square feet of open
water to construct a new bulkhead for the proposed 10 slip marina. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive the additional information requested below,
we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will
place this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
State agencies have determined that the proposed dredging is not maintenance dredging, and the
NC Division of Marine Fisheries designates the area where the dredging is proposed as Primary
Nursery Area. In addition, a significant shellfish resource has been identified in the subject area.
DWQ has determined that the proposed dredging has the potential to remove or degrade
significant existing uses of these waters. Please remove the proposed dredging of the Primary
Nursery Area from the project.
2. Although the application states that only 10 boat slips are proposed because the other docking
areas are for temporary use only, the Shellfish Sanitation Section of the Division of
Environmental Health has determined that the project as proposed will result in a closure of
shellfishing waters. DWQ has determined that the proposed dock configuration, and the size
and/or number of boat slips have the potential to remove or degrade significant existing uses of
these waters. Please make the necessary changes to the dock configuration in a manner that will
not result in the recommendation of Shellfish Sanitation to close the waters to shellfishing.

and Cyndi Karoly of the DWQ 401 Oversight Unit. If we do not hear from you within three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
