All,
Here is a list of problem areas on the site. First, the site is in violation of
the Construction Stormwater General Permit NCGO10000 and the 401 Water Quality
Certification. Second, there are Wetlands Standards and Stream Standards violations
as well. All will be addressed in the Notice of Violation to follow. Also, the
site cannot be in non-compliance with the DWQ until it becomes compliant with the
items mentioned in the Notice of Violation sent out on June 27, 2008 by Nick Mills
of the Division of Land Resources.
Some items needing attention:
1. Fill needs to be removed from the feature south of the isolated wetland at the
end of Pecan Place, or it will need to be permitted under the "After the Fact"
process. Check with Kim on this.
2. Fill (> than 2 inches in depth) downstream of #1 needs to be removed from the
stream and taken to uplands and stabilized. The stream channel should be restored
to original grade and any areas disturbed need to be replanted.
3. The isolated wetland adjacent to 'Pond B' has sediment in it that needs to be
removed, again > than 2 inches in depth. Vegetation will need to be replanted with
an approved wetland seed mix.
4. The isolated wetland adjacent to 'Pond A' appeared to have lost some of it's
hydrology to the pond. It was dry at the time of my inspection.
5. At 'Roadway Crossing #11, there is sediment in the wetlands all of the way down
to 'Pond D'. It needs to be removed the same as above.
6. There is an unauthorized wetland crossing in the approximate area of lots A79 &
A80 that needs to be permitted or restored.
7. At 'Roadway Crossing #21, there is sediment in the wetlands all of the way down
past 'Utility Crossing #U11.
8. At 'Roadway Crossing #31, there is sediment in the wetlands as well.
9. There appears to be an unauthorized impact to the immediate west of 'Roadway
Crossing #3' for a storm water line that feeds into 'Pond F' that needs to be
permitted or restored.
10. Any sediment from the development that has left the site and is now in the
roadside drainage ditches needs to be removed from those areas. There is evidence
of highly turbid water leaving the site and carrying sediment onto the adjacent

landowners properties. This water also flows into downstream waters of the State.
During the inspection, it appeared that this sediment had not been removed
previously, but instead, mulch had been placed upon the sediment in the ditches.
11. As a side note, the small isolated wetland just north of 'Pond A' has been
completely filled. This wetland is listed as 0.06 acres.
