Dear Ms. Higgins,
On behalf of Spectrum Properties we are requesting a Buffer Authorization from the NCDWR for
1,212 sq ft of permanent buffer impacts for construction Regency Woods II project. Please note
that there are no proposed impacts to wetlands or streams, and therefore 404/401 permits are not
required.
The project area is located northwest of Ederlee Drive and Regency Woods Place intersection, in
Cary (35.692511°N; -78.796163°W). The project is located in the Neuse River basin and onsite
waters drain to Regency Park Lake. The Water Quality Classification for Regency Park Lake is WS -
111; NSW and the Stream Index Number is 27-43-2.5. The cataloging unit for the site is 03020201.
Proposed Proeect
The overall proposed project consists of the construction of an office building and associated
infrastructure (i.e. driveways, parking, utilities, stormwater control measures, etc.). The purpose of
the proposed project is to construct a high flow bypass for the constructed wetland stormwater
BMP that will provide water quality treatment for the proposed parking lot for the Regency Woods
Office Complex and installation of a 6" sanitary sewer main crossing with easement to service the
Regency Woods Office Complex.
Project History
Mr. James Graham with NCDWR issued a Buffer Determination letter NBRRO#15-325 for the
project site on 07/31/2015. A copy of the Buffer Determination has been provided as an Appendix.
A wetland delineation for the project area was performed by Withers Ravenel (WR) on 05/26/2015.
David Shaeffer with the Corps of Engineers desktop reviewed WR's Jurisdictional Determination
Request (SAW -2015-01786) and concurred with the delineation. A copy of the concurrence email
has been provided as an Appendix.
Proposed Impacts
The proposed impacts consist of 617 sq ft of permanent impacts to riparian buffers (Zone 1: 374 sq
ft; Zone 2: 243 sq ft) for the construction of a high flow bypass for the constructed wetland

stormwater BMP that will provide water quality treatment for the proposed parking lot for the
Regency Woods Office Complex. Additionally, 595 sq ft of permanent impacts to riparian buffers
(Zone 1: 184 sq ft; Zone 2: 411 sq ft) are necessary for the installation of a 6" sanitary sewer main
crossing with a 20' easement to service the Regency Woods Office Complex, which will tie to an
existing Town of Cary sewer line within the Regency Lake's buffers.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a wetland and riparian buffer determination
be conducted in order to minimize impacts. All impacts to wetlands and streams have been avoided.
The proposed high flow bypass for the constructed wetland stormwater BMP resulting in Impact
#1 has been designed to cross UT to Regency Lake's riparian buffers at a perpendicular angle to
minimize impacts to buffers.
The onsite sewer must tie to an existing Town of Cary sewer line located within the riparian buffers
associated with Regency Lake, and therefore impacts at this location could not be avoided. The
sewer line crossing (Impact #2) has been designed to cross Regency Lake's riparian buffers at a
perpendicular angle to minimize impacts to buffers.
Mitigation
The buffer impacts are considered "Allowable" based on the Neuse River Basin Table of Uses and
do not require mitigation.
The current request is for 1,212 sq ft of permanent impacts to riparian buffers (see the attached
maps and PCN for details).
