Dear Mr. Colwell,
Thank you for your response to the Notice of Violation NOV-2008-PC-0228 issued by the
Division of Water Quality on May 8, 2008. On June 3, 2008, DWQ received a letter from you
describing the Requested Response on behalf of Mr. Chuck Lewis of MAC Development, LLC.
Response item #1 is satisfactory to this office. At Crossing I /Impact 2 you proposed, "The
dissipater pool below the stream crossing will be re-installed per the approved design shown on
Sheet 3 of 5 Crossing 1 Dissipater Detail."
For Response item #2, you proposed "...installing two or three step pools below the pipe in order
to raise the water level back up to the pipe invert and then step the stream flow down to the
existing channel." Please submit a modification request for your Approved 401 Water Quality
Certification (#2005-1890) to request design changes for this step pool concept within 30 days of
receipt of this letter. In addition, please send a copy of the paperwork to my attention at the
DWQ Raleigh Regional Office, 3800 Barrett Drive, Raleigh, NC 27609.
