17. Erosion and sedimenc control practices must be in fuil compliance with all specifications goveming the
proper design, installation and operation and maintenance of such Best Managemert Practices in order to
protect surface waters standards [ISA NCAC 0'lH.U506(bx3) and (c)(3]):
a. The erosion and sediment control measures for the projec[ must be designed, installed, operated,
and maintained in accordance with the most recent version of the North Carolrna Sediment and
Erusion Contro/ Planning and Design bfanual.
b. The desi�, installation, oFzration, and maintenance of the sedinient and erosion control measw�es
must be such thaf they equal, or exceed, the requirements specified in the most recent version of the
.North Carolina Sedimeni and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased
borraw pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measwes must be designed installed,
operated, and maintained in accordance with the most recerd version of the Norlh Carolrna Surface
Mini��g Manual.
d. The reclamation measures and implementation must comply witti the reclamation in accordance
with the requirements of the Sedimentation Pollufion Conaol Act.

hearing. You may obtain the petition fortn from the office nf Administrative hearings. You must file the pedtion
with the office of Administrative Hearings within siaty (60) days of receipt of this notice. A petition is cansidered
