Mr. Willis,
Thank you for your rapid attention to resolution of the deficiency I noted during our site inspection last week. As your email
noted, the 401 Water Quality Certification approval that was issued for the Quality Drive Extension required a pre -construction
meeting that did not occur. The survey information you submitted indicates that the impacts from the culvert are within the
approved impact amount.
Please note that even though DEMLR is taking the lead regarding the sediment loss into the stream and wetland from this project,
the impacts to the stream and wetland are also violations of water quality standards and of the 401 certification. Failure to
comply with DEMLR's required actions may result in a Notice of Violation from DWR in the future.
Lastly, while on site we discussed that the project is required to comply with the Stormwater Management Plan (SMP) that was
approved under the 401 certification. If it is determined that the approved SMP cannot be achieved then you may request a
modification to the SMP. I will conduct a compliance investigation of the SMP when the site is closed out under the DEMLR
approval.

Thank you for your time on Monday. I met with our contractor on Tuesday and he has begun addressing the deficiencies
tabulated in the email below. We anticipate the work will be completed next week and I will contact Ryan for a follow-up
inspection.
One of the items we discussed on Monday was verifying the actual length of creek disturbance. We should have done this with
you in the field prior to construction and I apologize for not following the proper procedure. On Tuesday we commissioned a field
survey of the new culvert and overlaid it on our original survey. The length of disturbance is approximately 147 feet as
demonstrated on the attached figure. I hope this is sufficient to confirm compliance with the permit.

During todays E&SC inspection the following needed corrective actions were found:
1. Stabilize ditchlines above both Type II grasslined ditches.
2. Remove hardened concrete slurry from the above referenced ditches.
3. Repair the eroded Type II grasslined ditches and remove the excess sediment that has accumulated below both of them
and stabilize.
4. Reinstall adequate temporary erosion control measures above and below the Type II grasslined ditches and surrounding
points of sediment laden stormwater like the headwalls and the like.
5. Remove the excess sediment from the stream below the outlet side of the newly installed road culvert. This was
approximately 150' downstream of the culvert and needs to be removed to a depth of no greater than 2". In addition,
the removal process must be completed with bucket and shovel with no heavy equipment allowed in the removal area or
within 30' top of the stream bank. No live tree cutting can take place inside the buffer with only vines or other like
vegetation removed for access but not to exceed 1' from ground level and only as necessary for access and is to be
minimized. Mass removal of instream debris is to be avoided and all removed sediment must be taken back inside the
limits of disturbance and adequately stabilized.
6. Repair the eroded rill that has formed within sewer line right of way that occurs directly above the SW most stream
crossing. This area will need to be reshaped, seeded, straw mulched/matted and have appropriate sized straw wattles
installed. In addition, the silt fence receiving the stormwater flow will need to be reinstalled were damaged and a stone
outlet added to outlet this storm water as discussed in field.
7. Repair and stabilize the the eroded area directly above the stone outlet that occurs above the first stream crossing (SW
side). In addition, remove the excess sediment that has accumulated below this same area and stabilize with appropriate
seeding, straw mulch, matting.
