Fourth Street Charlotte, NC 28202 Fax 704.3 53.0473 To report pollution or drainage problems, call: 311 http://stormwater.charmeck.org June 13, 2017 Ms. Crystal Amschler U.S. Army Corps of Engineers 151 Patton Avenue, Room 208 Asheville, North Carolina 28801 Subject: University Point Blvd. Extension after-the-fact permit modification (SAW #: 2012-00145/ DWR #: 15-0646) Dear Ms. Amschler, On behalf of Mr. Dan Leaver (City of Charlotte- Engineering and Property Management Department), I am submitting an after-the-fact permit modification for the University Pointe Boulevard Extension project (USACE Action ID: 2012-00145/ DWR #: 15-0646). In March of 2017, I was asked to inspect the aforementioned project for 401/404 permit compliance on behalf of Mr. Dan Leaver (project manager). At that time, it was determined that 2 bottomless culverts were potentially out of compliance with the conditions of the approved permit. At that time, I sought concurrence from both the USACE and NCDWR on the matter and scheduled field walks with the appropriate personnel. On March 28, 2017, Crystal Amschler walked the site with Erin Shanaberger and requested additional time to review the previous submittal prior to providing feedback. On April 13, 2017, Crystal provided a follow up email summarizing her thoughts. On May 10, 2017, Erin Shanaberger met Alan Johnson (NCDWR) on site to discuss the issue. It was determined that additional mitigation should be proposed to cover impacts that were not accurately represented in the pre-construction notification provided to both agencies on June 29, 2015. As a result of rock placed along the stream banks through both bottomless culverts (School Access Road and University Pointe Blvd), the City of Charlotte is proposing additional mitigation for 189 linear feet (LF) of impacts at a 0.5:1 ratio for a total of 95 SMUs. The revised total mitigation needed for the project is 274 SMUs. On June 9, 2016, Mr. Leaver made a payment to the City of Charlotte Umbrella Mitigation Bank (City Bank) for 311 SMUs. This was the original proposed mitigation amount (June 29, 2015); however, it was determined that one stream within the project area was non-jurisdictional and thus did not require mitigation (see attached permit approvals). As a result of over-payment to the City Bank, the City Bank will be refunding Mr. Leaver in the amount of 37 SMUs and the mitigation requirement for the University Pointe Blvd Extension project has been satisfied. Enclosed you will find an updated Pre-Construction Notification Form (PCN), prior permit approvals, updated construction plans and photos of the areas discussed above.
