Based on staff observations, it was apparent that unapproved impacts had been conducted within Zone 1 of the Catawba Riparian Buffer. Based on a review of our files, no approval has been issued by this Office for this impact. Impacts of this nature are not allowed per the Catawba Riparian Buffer Rule as set forth in 15A NCAC 02B .0243. Within Zone 1 of the Catawba Riparian Buffer, the clearing/grading (approximately 3,000 sq. ft) observed, as well as the construction of the wall, was not approved by the State. Zone 1 of the buffer extends 30 ft. landward from the full pond elevation of the lake. Within Zone 1 of the Catawba Riparian Buffer only trees less than three (3) inches in diameter can be removed within 30 feet of the full pond elevation of Lake Norman, which ' he 760 -foot elevation lin . To resolve this matter, twent�O)ative s es tr s, three (3) inc in di eter at breast height and eight (8) feet in height, at a minimum, s lanted by July 15, 2017. The trees shall be spaced and placed to return the natural canopy and tree spacing of those removed. The replacement trees must be monitored for two years to ensure survival. Should the trees fail to thrive, they shall be replaced with like trees and again monitored for survival. In addition, a written response to this Notice of Violation is requested within fifteen (15) days of receipt of this Notice indicating your actions and timeline to meet the above restoration requirement. Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a civil penalty assessment of up to a maximum of $25,000.00 per day for each violation.
