Dear Jennifer: Enclosed are copies of the required location map, soils map, boundary map, aerial photo, USGS Quad sheet, wetland delineation sketch, agent authorization form and supporting figures for the above mentioned tract. We met with on tract with DWQ and yourself last month. I believe you have all of the JD information, but I have included it below: Property Owner: Frank Horne P.O. Box 338 Fair Bluff, NC 28439 Applicant: Same as above S P L Physical site address: 1012 Causey Road. Subdivision Name and Lot #s: N/A Driving directions to the site: Highway 76 to Fair Bluff. Once through Fair Bluff, take right on Causey Road. Tracts on right at 1012 Causey Road. Name of nearest named water body to which the site is hydro logically connected and name of drainage basin: Property borders the Lumber River. The drainage basin is the Lumber River, HUC code 03040203 Decidegrees location of the site: Lat. 34.3088N, Long. 79.0582W Name of USGS quad in which the site is found: USGS Fair Bluff NC Quadrangle Total Area of the site and of jurisdictional wetlands on site: Total site is 27.48 ac. & approximate wetlands are 21.2 ac. This project is located on two individual tracts totaling 27.48 acres. An overall site map is attached (Proposed Restoration Plan). I did not delineate the area shown in pink, approximately 2.34 acres. This area is currently wooded with mature trees and is thickly vegetated. Based on the contours from the County GIS website, this area may contain small upland islands. In determining the total wetland impacts as regulated by Section 404 of the Clean Water Act I used a Thales MobileMapper CE GPS, with submeter accuracy to locate the edge of the road/home area filled. The total area filled is approximately 1.542 acres (See Frank Horne Impact Totals). The natural upland areas (Green), the existing bridge (Red), and the area of an historic 10' wide road were subtracted from the total impacts of the present road. This brings the impact total approximately 0.77 acres. The existing bridge is located at the road-crossing of the northern "blue-line stream" shown on the attached USGS Quad Sheet. In order to reduce recent fill impacts to 0.5 acres or less as allowed in Nationwide Permit 14 (Linear Transportation Projects), we are proposing additional minimization of the amount of existing impacts. 1. Remove the existing turn-around and additional lot fill around the home (White). 2. Install culverts in the area shown as Crossing #1 and Crossing #2 on the Proposed Restoration Plan. These culverts are being proposed to restore high water and normal flow patterns 3. The road will be narrowed approximately 4' for the total impacted length of 1784 linear feet. There are existing utilities located within the current road. The sewer line is located along the left side of the road, the water line is located along the right side of the road, and the electric and power are located in the center of the road until the existing bridge is reached. From the bridge to the home the electric and phone is located closer to the right side of the road. Due to these existing utilities, it seems that the easiest side to narrow the road will be along the left side when facing the home. The road will be narrowed along the left side as needed to bring the impacts under 0.5 acres. All of this work will be completed during dry conditions and standard erosion and sediment control "best management practices' will be utilized. To improve water quality on the tract and to restore natural flows we are proposing a 30" culvert in the area shown in white on the Proposed Restoration Plan at Crossing #1. The purpose of this culvert is to reestablish natural high water flow patterns across the road near the gate. This is an area that has indications of stagnant water. Additionally, 100' long native earthen plugs will be placed in the existing canal on both sides of the bridge locations. This will allow the surface water to filter through the natural wetlands before entering these "blue-line streams" that flow during significant rainfall events. I have not discussed the existing canal/excavation, because excavation is not regulated under the Clean Water Act. This canal was constructed solely as a borrow canal to provide some of the road fill material and does not outlet into the River. This canal totals approximately 0.908 acres (Blue). Onsite and photographic evidence indicated an existing borrow/drainage ditch which extended from Causey Road into the Horne property. Assuming this historic excavation was a 6' wide and used for the construction of the original road, the total adjusted impact is 0.494 acres. A six foot wide canal estimate was used, because this is the width of the existing canal in the upland area near Causey Road. The canal will be plugged where described above and any additional material from the proposed mitigation listed below will also be placed back into the canal. Portions of the canal will be left unfilled to add habitat and species diversity on the site. Appropriate sediment and erosion control measures will be used during any earth moving to lessen any impact to the adjacent open waters. To mitigate for the proposed 0.5 acres of total wetland fill impact, we are proposing to purchase riparian wetland credits from NCEEP at a 1:1 ratio and to record a conservation easement on the remaining wetlands. The NCEEP acceptance letter is attached. Over 16 acres of wetlands will remain onsite. This is a 32:1 ratio. Upland area U2 and any upland areas in the undelineated area (Pink) will also be included to add habitat and species diversity. In summary, we are proposing to reduce the total road crossing impacts to 0.5 acres and utilize a Nationwide 14 general permit. We are proposing purchasing 0.5 acres of NCEEP riparian wetland mitigation credits at a 1:1 ratio with a conservation easement on all remaining wetlands at a greater than 32:1 ratio and some small upland areas. We are proposing to add culverts, canal plugs, and filling portions of the canal to address any water quality issues. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than I1 by 17-inch format; however, DWQ may accept paperwork of any size. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. -Road has been narrowed as much as possible to adequately provide access. Due to low topography and landscape position the finished road surface grade needed to be elevated above high water levels. Road narrowed as much as possible to provide adequate stabilization. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 CerMcation/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S.
