The buffer mitigation credit requested is based on previously constructed stream restoration as part of the Neu-Con Wetland and Stream Mitigation Bank. No buffer mitigation credit had been sought originally, since EBX was not certain at that time that such credit could be sought in association with stream restoration credit. Accordingly, EBX is requesting that mitigation credit be extended for the above Sites for sale per the conditions of the attached RBMBI. WHEREAS the purpose of this Agreement is to establish the EBX Neuse Riparian Buffer Umbrella Mitigation Bank (Bank) providing compensatory mitigation for unavoidable riparian buffer impacts separately authorized by Authorizations or Variances to impact Riparian Buffers in appropriate circumstances (15A NCAC 2B .0200); WHEREAS the Sponsor currently controls through the purchase and recording of a permanent conservation easement, certain parcels of land as described in the Neu-Con Wetland and Stream Umbrella Mitigation Banking Instrument (Neu-Con MBI), the RBMBI Prospectus and in the Neu-Con Wetland and Stream Umbrella Mitigation Bank Restoration Plans (Restoration Plans) that are located in the Neuse Basin in Johnston, Wayne, and Jones Counties, North Carolina (Appendix A), and as shown in Figures 1 through 4 of the RBMBI Prospectus; WHEREAS NCDWQ agrees that the Bank site is a suitable riparian buffer mitigation bank site, and that implementation of the plans as described in the Restoration Plans is likely to result in restored and protected riparian buffers at the Bank site; WHERAS the Sponsor may acquire additional buffer mitigation sites in the Neuse River Basin and submit each such site to NCDWQ for review and approval for inclusion in the Bank; THEREFORE, it is mutually agreed between the parties to this Agreement that the following provisions are adopted and will be implemented upon execution of this RBMBI. General Provisions 1. The goal of the Bank is to restore, enhance, and preserve stream systems with the adjacent riparian buffers and their functions and values to compensate in appropriate circumstances for unavoidable stream buffer impacts authorized by 15A NCAC 2B 0.233 in circumstances deemed appropriate by NCDWQ. 2. Use of credits from the Bank to offset riparian buffer impacts authorized by 15A NCAC 2B 0.233. Approvals must be in compliance with said Rules. 3. NCDWQ shall make final decisions concerning the amount and type of compensatory mitigation to be required for authorized riparian buffer impacts, and whether or not the use of credits from the Bank is appropriate to offset those impacts. (Version 1.0 September, 2008) 4. The initial Bank sites have previously been restored and are protected by permanent conservation easements. A more detailed description of the baseline conditions of the initial sites is contained in the Monitoring Plans in Appendix A. 5. A Restoration Plan for each proposed additional site shall be submitted to NCDWQ for review and approval prior to each such additional site being inclused in the Bank, and such submittals shall include a site-specific Monitoring Plan. 6. The Sponsor shall perform the work described in each site specific Monitoring Plan until success criteria have been met. 7. The Sponsor shall monitor the Bank sites as described in the Monitoring (or Restoration) Plans, until such time as the NCDWQ determines that the success criteria of a density of 320 trees per acre after five years have been met. The monitoring period shall be a minimum of five years. 8. The Sponsor is responsible for assuring the success of the restoration, enhancement and preservation activities at the Bank site, and for the overall operation and management of the Bank. 9. The Sponsor shall provide to NCDWQ the annual reports as described in the RBMBI Prospectus (Appendix A). 10. NCDWQ shall review said annual reports, and may, at any time, after consultation with the Sponsor, request the Sponsor to take remedial action at a Bank site designed to achieve the specified success criteria. 11. The Sponsor shall implement any remedial measures necessary to achieve the specified success criteria. In the event the Sponsor determines that remedial action may be necessary, it shall provide notice of such proposed remedial action to NCDWQ. No remedial actions shall be taken without the concurrence of NCDWQ. 12. NCDWQ shall be allowed reasonable access to the Bank sites for the purposes of inspection of the Sites and compliance monitoring activities. The Sponsor shall be notified 48 hours in advance of any such NCDWQ inspection. Use of Miti!ation Credits 13. The Geographical Service Area ( GSA ) is the designated area wherein a bank can reasonably be expected to provide appropriate compensation for impacts to wetland or other aquatic resources. The GSA for this Bank shall include the Neuse River Basin Hydrologic Units 03020201, 03020203, 03020204, provided however, that in addition to the GSA described above, credits from the Bank may be used to offset any buffer impacts in North Carolina where (Version 1.0 September, 2008) the location of the impacts are further from the estuary in the Neuse Basin than the location of the mitigation generating the credits. Use of credits from the Bank to compensate for impacts beyond the GSA may be considered by NCDWQ. 14. The buffer mitigation credits generated by the initial Bank sites shall be as specified in Table 1, below. It is anticipated by the parties to this Agreement that use of mitigation credits shall be "in-kind;" that is, that riparian buffer credits will be used to offset riparian buffer impacts. 16. Riparian buffer mitigation requirements and riparian buffer mitigation credits will be determined according to the procedures 15A NCAC 2B 0.233 and .0242. Buffer restoration and buffer enhancement shall be defined per the Memorandum titled "NCDWQ Buffer Interpretation/Clarification #2008-17, January 25, 2008". 17. Notwithstanding the above, all decisions concerning the appropriateness of using credits from the Bank to offset impacts to riparian buffers shall be made by NCDWQ. Any necessary notice to and consultation with NCDWQ for use of credits shall be through the riparian buffer impact review process. 18. Twenty percent (20%) of the restoration credits for each Bank site shall be available for sale immediately upon completion of all of the following: a. Execution of this RBMBI by the Sponsor and NCDWQ; b. Approval of the Restoration and Monitoring Plans by NCDWQ; c. Delivery to NCDWQ of the financial assurance described in paragraph 24 of this RBMBI; d. Recordation of the preservation mechanism described in paragraph 23 of this RBMBI; 19. The Sponsor must complete the initial physical and biological improvements to each Bank site pursuant to the Restoration Plans no later than the first full growing season following (Version 1.0 September, 2008) initial debiting of the Bank. The Sponsor shall provide a record drawing or as-built survey to provide a record of the amount and nature of buffer restoration and enhancement completed. 20. Monitoring of the riparian buffer restoration and enhancement shall be based on the CVS-EEP Protocol for Recording Vegetation Level 1-2 Plot Sampling Only Version 4.0, as indicated in the Restoration and/or Monitoring Plans based on a success criteria of 320 trees per acre after five years. 22. The Sponsor shall submit an annual ledger documenting buffer credit releases and debits to NCDWQ for maintaining accurate records of credit transactions made from the Bank. Accounting procedures shall include the generation of a report by the Sponsor showing credits used each time they are debited from the Bank, which the Sponsor shall provide within 30 days of the debit to NCDWQ. In addition, the Sponsor shall prepare an annual report, by the end of each calendar-year, showing all credits used, and the balance of credits remaining to NCDWQ, (Version 1.0 September, 2008) until such time as all of the credits have been utilized, or this Agreement is otherwise terminated. All reports shall identify credits debited and remaining by type of credit (e. g., riparian buffer), and shall include for each reported debit the NCDWQ ID number for the Authorization for which the credits were utilized. Property Disposition 23. The Sponsor has recorded a Permanent Conservation Easement for each initial Bank site in the County where each site is located. The Sponsor shall record similar easements for each additional site approved for inclusion in the Bank. Financial Assurances 24. The Sponsor will provide to NCDWQ financial assurances for the pre-construction release of credits in the form of performance bonds or letters of credit. Such financial assurances shall be in the amount of twenty percent of the credits anticipated to be generated for each site multiplied by the NCEEP price for riparian buffer mitigation in the Neuse River Basin. Such financial assurances shall be retired upon submittal of the as-built report for each site. For the initial Sites of the Bank (Marston, Westbrook, and Nahunta), no financial assurances are required as the Sties have completed or are in the monitoring period. Miscellaneous 25. Any delay or failure of Sponsor shall not constitute a default hereunder if and to the extent that such delay or failure is primarily caused by any act, event or conditions beyond the Sponsor's reasonable control and significantly adversely affects its ability to perform its obligations hereunder including: (i) acts of God, lightning, earthquake, fire, landslide, drought, hurricane, storm, flood, or interference by third parties; (ii) condemnation or other taking by any governmental body; (iii) change in applicable law, regulation, rule, ordinance or permit condition, or the interpretation or enforcement thereof, (iv) any order, judgment, action or determination of any federal, state or local court, administrative agency or government body; or (v) the suspension or interruption of any permit, license, consent, authorization or approval. If the performance of the Sponsor is affected by any such event, Sponsor shall give written notice thereof to the NCDWQ as soon as is reasonably practicable. If such event occurs before the final availability of all credits for sale, the Sponsor shall take remedial action to restore the property to its condition prior to such event, in a manner sufficient to provide adequate mitigation to cover credits that were sold prior to such delay. Such remedial action shall be taken by the Sponsor only to the extent necessary and appropriate, as determined by NCDWQ. 26. No third party shall be deemed a beneficiary hereof or shall be entitled to seek enforcement hereof. (Version 1.0 September, 2008) 27. In the event any one or more of the provisions contained in this RBMBI are held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceablility will not affect any other provisions hereof, and this RBMBI shall be construed as if such invalid, illegal or unenforceable provision had not been contained herein. 28. This RBMBI shall be governed by and construed in accordance with the laws of North Carolina and the United States as appropriate. 29. The terms and conditions of this RBMBI shall be binding upon, and inure to the benefit of the parties hereto and their respective successors. 30. The Neu-Con Stream and Wetland Mitigation Bank restored stream and wetlands to provide mitigation credits to NCDOT and other entities with mitigation credits needed to compensate for unavoidable impacts to jurisdictional streams within the Neuse River Basin (HUCs: Westbrook Site: 03020201, Marston Site: 03020204; and Nahunta Site: 03020203). The most recent monitoring reports included in Appendix A of this Prospectus describe the methods, monitoring and success criteria for the Neu-Con Wetland and Stream Umbrella Mitigation Bank. A significant amount of riparian buffer was restored as part of the stream restoration and enhancement at the Westbrook, Nahunta, and Marston sites of the Neu-Con Wetland and Stream Umbrella Mitigation Bank. The Sponsor intends to establish the EBX Neuse Riparian Buffer Umbrella Mitgiation Bank (Bank) to provide riparian buffer mitigation credits for sale to permittees that require Neuse riparian buffer mitigation credits. The rules for providing buffer mitigation in the Neuse basin are found in 15A NCAC 2B .0241. Part (9) describes the requirements for riparian buffer restoration or enhancement for use as mitigation credits. This document proposes to establish a method for establishing, accounting for and debiting buffer mitigation credits at the Bank. 2.0 Riparian Buffer Restoration and Available Credit As part of the site-specific stream restoration plans for the Westbrook, Nahaunta, and Marston sites of the Neu-Con Wetland and Stream Umbrella Mitigation Bank, buffer restoration plans were established and are described in the Monitoring Reports included in Appendix A. The location of the buffer restoration areas and the means of restoring them are described in Appendix A, and the detailed quantification of the credit yields are provided in Appendix B. Figures 1 through 4 show the buffer restoration areas that are proposed to be used to provide Neuse riparian buffer mitigation credits for the Bank. For the purposes of this document, buffer restoration is defined as the planting of areas within 50 of the stream banks that contain less than 100, 5-inch DBH trees per acre at the densities and species composition described in detail in the Monitoring Reports. The Zone 1 buffers have been quantified by determining the area between the stream bank to a line 30 feet from the bank and parallel to the bank as displayed in Figure 1. Zone 2 has been quantified by determining the area between the line 30 foot line described above and a line 50 feet and parallel to the stream bank. (As such, the Sponsor understands the total area within the easement boundary is larger than the amount of mitigation credit where the easement extends beyond Zone 2.) The buffer restoration areas were calculated based on the as-built drawings of the restored or enhanced EBX Neuse Riparian Buffer Umbrella Mitigation Bank, Johnston, IYlayne and Jones Countie North Carolina ' EBX NE USE 1 3 streams. Also, in order to conservatively determine the amount of buffer mitigation credit that was provided, 1998 aerial photography of pre-stream restoration conditions was used to determine the amount of existing, forested buffer. Buffers surrounding the pre-restoration reaches that appeared to have forest vegetation based on the aerial photography were considered to be fully forested. The area of these fully forested buffers was calculated and subtracted from ' the post restoration Zone 1 and Zone 2 areas to determine the final buffer mitigation credit amount requested for each reach. Additionally, all of the post-restoration areas that were considered for buffer mitigation had to have minimum 50 foot restored buffer width from each ' stream bank. The proposed buffer mitigation credit amounts are summarized in Table 1 below. Both the Marston and Westbrook sites have met the success criteria of 320 trees per acres after five years based on their fifth year of vegetation monitoring as required by 15A NCAC 2B .0241. The Nahunta site is currently meeting the success criteria based on the third year monitoring report. The most recent reports are contained in Appendix A. EBX Neuse Riparian Buffer Umbrella Mitigation Bank, Johnston, ilayne and Jones Counties, North Carolina ' EBX NE USE 1 4 ' In addition to the Westbrook, Nahunta, and Marston sites, the Sponsor may submit to NCDWQ other Neuse buffer mitigation sites at a later date for approval and inclusion into the Bank. 3.0 Service Area 1 The service area requested for the Bank is for unavoidable buffer impacts (that require mitigation) to protected Neuse riparian buffers within the Neuse River Basin, HUC 03020201, 03020203, and 03020204. These are the same service areas already approved for the existing Neu-Con Wetland and Stream Umbrella Mitigation Bank. USE 1 5 ' Currently, the Nahunta site is completing its fourth year of vegetation monitoring, the Marston and Westbrook sites have completed five years of monitoring. The monitoring reports in ' Appendix A include the as-built drawings that show the location of the restored buffers within the protection areas. As described above, any existing buffers have been subtracted from the restored buffer amounts on a reach by reach basis. The Sponsor requests that NCDWQ agree to ' the amount of credit provided as shown in Figures 1 through 4, summarized in Table 1. Once NCDWQ agrees to the amount of available credit, the Sponsor will develop a ledger that includes the initial amount of Zone 1 and Zone 2 buffer credit in units of square feet and provide a copy to NCDWQ. When a permittee requests to purchase available credit from the Bank to mitigate for unavoidable buffer impacts, the Sponsor will provide an acceptance letter to NCDWQ indicating the amount of available credit in the Bank, the amount of credit provided to ' the permittee, and the amount of credit that will remain after the transaction. The Sponsor will provide two copies of the letter for both the permittee's file and for the NCDWQ Bank file. Once the permittee has acquired the credit, the Sponsor will send a letter to NCDWQ indicating that ' the credits have been debited, the amount of credit debited, and the amount of credit remaining in the Bank. 1 5.0 Success Criteria and Monitoring ' The Success Criteria and Monitoring requirements are provided in Appendix A. It is assumed that the vegetation monitoring and success criteria applicable to the Neu-Con Wetland and Stream Umbrella Mitigation Bank are acceptable for buffer mitigation purposes. The Sponsor ' will submit a separate Buffer Monitoring Report to NCDWQ at the end of each remaining monitoring year for the Nahunta Site and for each of the five vegetation monitoring years for any future, additional Bank sites. The buffer mitigation will be considered successful if, five years ' after the original planting date, there is an average of 320 tree species per acre. Construction of the site, including planting of trees, was completed in February 2003. The 2007 data represents results from the fifth and final year of hydrology and vegetation monitoring for both the wetlands and stream areas. The design for the Westbrook Lowgrounds property involved the restoration of a Coastal Plain, small stream swamp and associated wet flats as described by Schafale and Weakley (1990). After construction, it was determined that 5,414 feet of stream and 66.2 acres of wetland hydrology were restored. The As-Built survey is included as Appendix A. This Annual Report presents the data from eight hydrologic monitoring stations, thirteen vegetation monitoring stations, and from stream monitoring, as specified by the approved Mitigation Plan for the site. Two of the hydrologic stations are equipped with manual groundwater gauges and six stations are equipped with automated gauges and a manual calibration gauge. Additionally, the gauges are used as points from which photographs are taken over time. Weather station data from the Smithfield Weather Station were used in conjunction with a manual rain gauge located on the site to document precipitation amounts. The manual gauge is used to validate observations made at the automated station. On-site rainfall measurements were well below normal limits for the growing season due to the severe drought that NC experienced in 2007 (see Section 3.3.2). In 2007, three of eight hydrology monitoring gauges met the hydrologic success criteria of a hydroperiod of 9 percent of the growing season. The gauges that did not meet success criteria exhibited hydroperiods ranging from 1 percent to 9 percent of the growing season. However, the gauges did correlate with data collected from gauges located on the reference site that also experienced conditions that were drier than normal during the 2007 growing season. Based on these results and the results of prior years, it is concluded that the site is performing as designed and that the site has achieved the wetland success criteria as specified in the Mitigation Plan for the site. This Annual Report documents vegetation survival on thirteen vegetation monitoring plots, as specified in the approved Mitigation Plan for this site. The final vegetative success criterion is the survival of 260 5-year old planted trees per acre at the end of Year 5 of the monitoring period. The vegetation monitoring documented survival rates between 350 and 610 stems per acre. Based on these results, it is concluded that the site has achieved the vegetative success criteria specified in the Mitigation Plan for the site. The restored stream channel has remained stable and is providing the intended habitat and hydrologic functions. As in prior years, all monitored cross sections for 2007 show very little adjustment in stream dimension. Based on this stability being achieved while the stream experienced greater than two bankfull events during the five year monitoring period, it is concluded that the site has achieved the stream success criteria as specified in the Mitigation Plan for the site. Based on the results documented in the Year 1 through Year 5 Annual Reports, it is concluded that all success criteria for the site have been achieved in accordance with the approved Mitigation Plan for the site, and that no further monitoring is required. The Westbrook Lowgrounds site is designed to restore a Coastal Plain, small stream swamp and associated wet flats as described by Schafale and Weakley (1990). The Coastal Plain, small stream swamp communities exist as the floodplains of small, blackwater streams in which separate fluvial features and associated vegetation are too small or poorly developed to distinguish. Construction was completed in January 2003, and 66.2 acres were planted in February 2003. Groundwater, surface water, and rain gauges were functional beginning March 7, 2003. The 2007 monitoring season represents the fifth and final year of monitoring for the site. 2.2 PROJECT PURPOSE Monitoring of the Westbrook Lowgrounds Site is required to demonstrate successful mitigation based on the criteria found in the Mitigation Plan, the Neu-Con Umbrella Stream and Wetland Mitigation Bank Instrument, and through a comparison to reference site conditions. Hydrologic, vegetation, and stream monitoring are conducted on an annual basis. Success criteria must be met for five consecutive years. The growing season for Johnston County is 232 days long, beginning on March 17 and ending November 5, as calculated from National Weather S i W ' erv ce etlands Determination Tables (WETS) for Johnston County. Data are collected from six automated and two manual groundwater gauges. The Mitigation Plan further specified that in order for the hydrologic data to be considered successful it must demonstrate wetland conditions are present in normal or dryer than normal conditions. 4 November 2007 Westbrook Lowgrounds Mitigation Site Annual Monitoring Report for 2007 (Year 5) 3.2 DESCRIPTION OF HYDROLOGIC MONITORING EFFORTS Two manual groundwater gauges, six automated Infinities groundwater gauges, and one rain gauge were installed prior to the beginning of the 2007 growing season (Figure 3). Groundwater gauges, both manual and automated, were installed to a minimum depth of at least 32 inches below the ground surface. The monitoring protocol for the site specifies that automated monitoring stations will be downloaded and checked for malfunctions on a monthly basis. During monthly site visits, manual groundwater gauges are read and rainfall totals are collected from the on-site rain gauge. Automated Gauges Automatic groundwater gauges record water table elevations twice daily at 08:00 and 20:00. Infinities gauges employ pressure sensors that record water elevation above the bottom of the sensor (with atmospheric pressure compensation). Immediately adjacent to each automatic gauge is a manual calibration gauge. The calibration water table depth is recorded at monthly downloads. To determine wetland hydroperiods the automatically recorded data are compared to the calibration data to determine a standard correction factor between the calibration gauge and the automatic gauge for each location. The standard correction factor is applied to correct daily readings. The corrected daily readings are used to determine wetland hydroperiods. Manual Gauges Water table depths are recorded monthly in manual groundwater gauges. To calculate wetland hydroperiods interpolations are made between monthly readings by correlating twice daily automatic gauge readings. Each manual gauge is correlated to an automatic gauge based on proximity, landscape position, and the relationship of their groundwater depth readings (i.e. if their readings are separated by a consistent value). Once the appropriate automatic gauge has been selected, a correction factor is calculated for each monthly gauge reading. A daily rate of change between monthly correction factors is calculated to determine the daily correction factor. The daily correction factor is then applied to the automatic gauge readings to calculate an estimated daily water table depth for the manual gauge. These daily readings are used to determine wetland hydroperiods. Data Interpretation Wetland hydroperiods are calculated from twice daily water table depth elevations. A hydroperiod is calculated if the water table is equal to or less than -12 inches below ground surface for at least 24 hours. If a gauge falls below -12 inches for two consecutive readings (24 hours) then the hydroperiod ends at the last reading within -12 inches. If a gauge falls below -12 inches for only one reading then maintains a reading above -12 inches for a minimum of 24 hours then the hydroperiod is calculated continuously. This methodology accounts for minor technical malfunctions experienced by the automatic gauges. 3.3 RESULTS OF HYDROLOGY MONITORING The following hydroperiod statistics were calculated for each monitoring station during the growing season: 1) most consecutive days that the water table was within twelve inches of the soil surface; 2) cumulative number of days that the water table was within twelve inches of the soil surface; and 3) number of times that the water table rose to within twelve inches of the soil surface. The results of these calculations are presented in Table 2. Figure 4 provides a chart of the water depth for each of the monitoring gauges on the site. The figure demonstrates the reaction at each monitoring location of the groundwater level to specific rainfall events. Raw gauge data collected from the monitoring gauges are provided in Appendix C. November 2007 1 1 1 Westbrook Lowgrounds Mitigation Site Annual Monitoring Report for 2007 (Year 5) The site was designed to function as a riparian wetland system with associated wet flats. Hydrology in the riparian areas is driven primarily by groundwater discharge and over-bank flooding, whereas precipitation is the primary hydrologic influence in the wet flat areas. Monitoring has demonstrated that the site is functioning as designed, with varying degrees of wetness and saturation across the site. During 2007, gauges AW5, MW1, and MW2 met or exceeded the required 9 percent hydrologic success criteria. The five remaining automatic gauges exhibited varying wetland hydroperiods and were, for the most part, within the range of conditions in the reference wetland. The reference wetland readings varied in that 2 of the 5 gauges exceeded the hydrologic success criteria of 9 percent of the growing season, while the other 3 were just below this requirement. The approved mitigation plan for the Westbrook Lowgrounds Site states in Section 3.5: "... [model] simulations indicate that, on average, the water table will be less than 30 cm [ 12 inches] deep continuously for approximately 9 percent of the growing season. This scenario can be assumed to represent average conditions across the site, with the majority of the restored acreage on the site being represented by this hydrologic scenario. It is probable that there will be areas slightly drier or slightly wetter than the modeled scenario within the restoration area. The modeled scenario provides a basis for estimating the average hydrologic condition over the restored site, based on the proposed restoration practices. However, it is important to note that the hydrology of the targeted restored wetland system (Coastal Plain, small stream swamp) is highly variable across a given site, supporting the ecological and functional diversity that makes these systems so valuable." The results of these calculations are presented in Table 3. Only two of five reference gauges exceed the 9 percent hydroperiod established as success criteria for the restoration site. The reference gauges exhibited a range of hydroperiods similar to the site data, including one gauge location (Ref MW5) with a minimal wetland hydroperiod. The reference gauges are located within a wetland adjacent to the stream reach upstream of the Westbrook Lowgrounds mitigation site. The first signs of drought began in February in the western part of the state. By early spring, abnormally dry 9 November 2007 Westbrook Lowgrounds Mitigation Site Annual Monitoring Report for 2007 (Year 5) conditions had spread across the state, and the western edge of the state began to see "moderate" drought conditions. From late spring through the summer, conditions steadily worsened. By August, 98% of North Carolina's land area was designated as being in either "severe", "extreme", or "exceptional" drought. Additionally, lowest-ever average stream flows were recorded at 13 monitoring stations in August, including 9 in central North Carolina, two in the mountains, and two on the coastal plain. Nearly the entire state was categorized as experiencing "extreme" drought in September, with the southwest portion of the state categorized as experiencing "exceptional" drought. Figure 5 depicts the increasing severity of the drought throughout the year. The Westbrook restoration site experienced drought conditions consistent with state-wide trends. At the Smithfield monitoring station, near the Westbrook site, monthly precipitation levels fluctuated around the lower end of the normal range from January through June (Figure 6 and Table 4B). The accumulated rainfall deficit- the difference between the long-term average and the observed monthly precipitation levels, aggregated monthly -grew steadily throughout the year to -11.49 inches through September. The high rainfalls in July and September were not sufficient to reverse the downward trend of the rainfall deficit. Persistent and worsening drought conditions severely impacted the wetland hydroperiods at the Westbrook restoration site. As presented in Table 4B, drought conditions have existed in 2005, 2006, and 2007, as measured by a deficit from average rainfall, and it can be expected that these persistent conditions will have a cumulative, negative impact on groundwater levels. Restoration of the site will involve restoring the stream through the site and increasing the amount of surface storage available to pond water. In this way, the respective amounts of drainage and runoff are decreased. The excess water storage will allow the water table to remain higher throughout the year, thus restoring wetland hydrology." As demonstrated in by the rainfall in Table 4B, the Westbrook site has experienced a deficit in annual rainfall over the last three years. This lack of rainfall has the result of reducing the amount of surface water retained on the site and available to contribute to producing wetland hydrology. The monitoring gauge data in Table 2B reflects this condition for both the project site and the reference, with groundwater loads trending lower as drought conditions have persisted and, in 2007, significantly increased. The final vegetative success criteria will be the survival of 260 5-year-old planted trees per acre at the end of Year 5 of the monitoring period. Up to 20 percent of the site species composition may be comprised of woody volunteers. Remedial action may be required should these (i.e. loblolly pine, red maple, sweet gum, etc.) present a problem and exceed 20 percent composition. This site was planted in non-riverine hardwoods and coastal plain swamp species in March 2003. There were thirteen 1/10th acre vegetation monitoring plots established throughout the planting areas. All of the planted stems inside the plot were flagged with orange flagging to mark them as the planted stems (vs. volunteers) and to help locate them in the future. The following tree species were identified as volunteers within in the Wetland Restoration Area: Table 8 Volunteer Tree Suecies Scientific Name Common Name FAC Status Liquidambar styraciflua Sweetgum FAC+ Acer rubrum Red Maple FAC Diospyros virginiana Persimmon FAC 4.4 GENERAL VEGETATION OBSERVATIONS AND CONCLUSIONS Vegetation monitoring has documented the average number of stems per acre on site to be 485 at the end of Year 5, which is a survival rate of greater than 82% based on the initial planting count of 590 stems per acre. After construction of the mitigation site, a permanent ground cover seed mixture of Virginia wild rye (Elymus virginicus), switch grass (Panicum virgatum), and fox sedge (Carex vulpinoidea) was broadcast on the site at a rate of 10 pounds per acre. These species aided in the soil stabilization early in the development of the mitigation site and posed no threat to the survival or health of the planted or naturally occurring hydrophytic vegetation. Hydrophytic herbaceous vegetation including rush (Juncus effusus), spike-rush (Eleocharis obtusa), giant cane (Arundinaria gigantea), tearthumb (Polygonum sagittatum), boxseed (Ludwigia sp.), and sedge (Carex sp.) are frequently observed across the site particularly in areas of inundation. The presence of these herbaceous wetland plants helps to confirm the presence of wetland hydrology on the site. There are zones of weedy species occurring on the site, though none seem to be posing any survivability issues for the woody or herbaceous hydrophytic vegetation. The majorities of the weedy species are annuals and seem to pose very little threat to survivability in site. This growing season, most likely due to the drought conditions, the predominant weedy species observed this growing season was goldenrod (Solidago altissima) and horseweed (Conyza canadensis). Other commonly seen weedy vegetation includes ragweed (Ambrosia artemisiifolia), dill (Foeniclum vulgare), and morning glory (Ipomoea sp.) This site did not develop any threatening weedy ' vegetation throughout the five year monitoring period. The herbaceous layer of the site will continue to change as the planted stems develop into a mature forest canopy. In 2006, mowing between the rows of planted stems occurred to control the invasive softwood volunteer species such as red maple, sweet gum, and pine. Targeted back-pack herbicide application occurred on those species located within the rows of planted stems. The undesirable species have been stunted. The softwood volunteer species will likely return, but will not pose a ' threat to the survivability of the strong well established planted stems. Cross sections: There should be little change in as-built cross sections. Cross sections shall be classified using the Rosgen stream classification method and all monitored cross sections should fall within the quantitative parameters defined for "E" or "C" type channels. Longitudinal Profiles: The longitudinal profiles should show that the bedform features are remaining stable, e.g. they are not aggrading or degrading. Bedforms observed should be consistent with those observed in "E" and "C" type channels. Photo Reference Stations: Photographs will be used to subjectively evaluate channel aggradation or degradation, bank erosion, success of riparian vegetation and effectiveness of erosion control measures. Benthic Macroinvertebrate and Fish Sampling: Sampling of benthic macroinvertebrates and fish within the restored stream channel shall be conducted for the first three years of post-restoration monitoring. 15 November 2007 1 i Westbrook Lowgrounds Mitigation Site Annual Monitoring Report for 2007 (Year 5) 5.2 STREAM MORPHOLOGY MONITORING PLAN To document the stated success criteria, the following monitoring program was instituted following construction completion on the Westbrook Site: Bankfull Events: A crest gauge was installed on the site to document bankfull events. The gauge is checked each month, and records the highest out-of-bank flow event that occurred during the past month. The gauge is located near stream station 43+50 (Figure 3). Cross sections: Two permanent cross sections were installed per 1,000 linear feet of stream restoration work, with one of the locations being a riffle cross section and one location being a ' pool cross section. A total of 11 permanent cross sections were established across the mitigation site. Each cross section was marked on both banks with permanent pins to establish the exact transect used. Permanent cross section pins were surveyed and located relative to a common benchmark to facilitate easy comparison of year-to-year data. The annual cross section surveys include points measured at all breaks in slope, including top of bank, bankfull, inner berm, edge of water, and thalweg. Riffle cross sections are classified using the Rosgen stream classification system. Permanent cross sections for 2006 (Year 4) were surveyed in August 2006. i h d ree, an Longitudinal Profiles: A complete longitudinal profile will be completed in Years one, t five. The profile will be conducted for a length of restored channel at least 3,000 feet in length. Measurements will include thalweg, water surface, inner berm, bankfull, and top of low bank. Each of these measurements will be taken at the head of each feature, e.g. riffle, run, pool, glide, and the max pool depth. A common benchmark will be used each year to facilitate comparison of year-to-year data. Longitudinal survey will be performed in 2007 (Year 5). Photo Reference Stations: Photographs are used to visually document restoration success. Nine reference photo stations have been established across the Westbrook Site. Reference stations are marked with wooden stakes and Global Positioning Satellite (GPS) coordinates have been determined for each location. Reference photos are taken at least once per year. Reference photos are taken at each permanent cross section from both stream banks. The survey tape is centered in ' the photographs of the bank, and the water line is located in the lower edge of the frame with as much of the bank as possible included in each photo. Structure photos of each grade control structure are also taken. ' 3 STREAM MORPHOLOGY MONITORING RESULTS 5 . During 2007, only one bankfull event on the site was documented through the use of the onsite crest gauge and visual evidence of out-of-bank flow. The stream flow event documented by the crest gauge on the site was a flow that occurred sometime between the months of September and February and was approximately 2.60 feet above the bankfull stage at the crest gauge. In-stream structures installed within the restored stream included rock cross-vanes, log vanes, log weirs, and root wads. Visual observations of structures throughout the past growing season have indicated that nearly all structures are functioning as designed. Two log vanes have been undercut ' by channel erosion, a beaver dam is present toward the central portion of the channel, and several boulders have shifted in the cross vanes at the downstream end of the site. During January 2006, eight log weirs were raised by a few tenths of a foot, and two new log weirs were installed between stations 0+00 and 10+00. This was done to improve the hydrology on the northwestern area of the site. All work was done with minimal disturbance to the site and stream. ' Table 10 provides a summary of potential problem areas observed. 16 November 2007 Westbrook Lowgrounds Mitigation Site Annual Monitoring Report for 2007 (Year S) All potential problem areas are minor and localized. No corrective actions are recommended at this time as the channel appears to be moving toward stability. The rock vane condition at station 52+00 is located between two other functional rock vanes at the downstream end of the project. Additionally, this portion of stream rarely experiences high flows due to its frequent inundation from the downstream Mill Creek. Photographs have been taken throughout the monitored season to document the evolution of the restored stream channel (Appendix B). Herbaceous vegetation is dense along the restored stream, making it difficult to take photographs of the stream channel itself. 5.3.1 Cross Sections Year 5 cross section monitoring data were collected during August 2007, and compared to baseline data collected in April of 2003 as well as surveyed data from 2006. Permanent cross sections document the stream dimension at eleven locations (six riffles and five pools). Cross section data is presented in Appendix A. The cross sections show that there has been very little adjustment to stream dimension since construction. Cross section 11 shows slight erosion along the bottom right bank, possibly caused by erosive forces from high velocities. All monitored cross sections fell within the quantitative parameters defined for "E" or "C" type channels. This stream flow event was documented during the February site visit. ' 5.3.4 Five Year Summary In order to meet the success criteria for stream restoration, the restored stream must experience ' two bankfull events over the five-year monitoring period. As demonstrated in Table 11 below, the site has achieved this requirement.
