The data collection locations must be shown on the project plans. Also. if there are any areas within the project area that meet the hydrophytic vegetation, wetland hydrology, and hydric soil criteria of the 1987 Corps of Engineers Wetland Delineation Manual, you must conduct and submit a wetland delineation. The Nationwide Permit General Conditions-number 27(bx4) states the delineation must be prepared in accordance with the current methods required by the Corps. The current method requires both wetland and upland data for each delineated wetland. 3. Please provide recent photographs of the proposed project area. 4. Your proposed project plans indicate you plan to use large boulders to create a series of step-pool structures. Based on the U.S. Army Corps of Engineers, Wilmington District's recent experience with similar projects, we believe the project can possibly be completed with less discharge into the aquatic resource(s) by using articulated concrete mats. Please provide a discussion of this possible avoidance and minimization technique. 5. Please provide a statement regarding how impacts to waters of the United States are to be Compensated for or a statement explaining why compensatory mitigation should not be required for the proposed impacts. This statement is a requirement of the April 10, 2008 Compensatory Mitigation Rules (325.1(d)(7). 6. Please indicate the location of the proposed access ramp along the stream bank on your plans. Based on our desktop review and numerous site visits near the proposed project, Reedy Fork Creek flows in an easterly direction. Your plans indicate it is flowing in a westerly direction. The Pre-Construction Notification Application Form has been amended to request permission to impact Waters of the U.S. under Nationwide Permit (NWP) 18. The total volume of fill to be discharged below the Ordinary High Water Mark (OHWM) of Waters of the U.S. is approximately 77.83 cubic yards (2101.6 cubic feet). This is necessary to provide adequate cover to the currently exposed gas pipelines at the site. No fill material will be discharged into special aquatic sites. 2. No wetland areas exist adjacent to the stream in question at the proposed project site. The erosion of the stream that has resulted in the exposure of the pipelines in question has also left any adjacent wetlands permanently drained. Upon completion of the project, the thalweg of the stream as well as the water surface elevation will be raised considerably. This will provide hydrology to areas adjacent to the stream, restore any previously drained wetlands as well as create new wetlands. Furthermore, only temporary disturbances due to placement of pump around equipment are proposed for areas south of the stream channel. The majority of the disturbed areas will be north of the channel within the manicured area of the right of way (ROW). ALC has proposed the use of large boulders to create a step pool structure in order to create a permanent solution to the exposed gas pipelines as well as stabilize and restore this reach of stream. The proposed step pool structure will raise the invert of the stream channel to an elevation that provides adequate cover to the currently exposed gas pipelines, minimize erosion in this reach of stream, as well as downstream areas by slowing the velocity of the flow, and reintroduce hydrology to adjacent areas that have been drained due to the deep head cut of the stream channel. Articulated concrete mats cannot provide an equal amount of ecologic value, and would hinder future access to the gas pipelines, should a problem arise. 5. Compensatory mitigation should not be required in this situation since the goal of the project is to stabilize and restore the stream channel in addition to providing adequate cover to the exposed gas pipelines. 6. No access ramp along the stream bank is proposed. 7. The plan has been modified to more accurately exhibit the onsite conditions. A copy of the plan is enclosed.
