Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Avoidance of jurisdictional wetlands and streams has resulted in no impacts to these resources. Buffer impacts occur within a narrow area along the Neuse River. Impacts to these resources have been avoided and minimized to the maximum extent practicable by additional design revisions and special considerations. The project is located along the top terrace of the Neuse River. All impact areas were previously cleared of woody vegetation. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. The design of the project will require only minimal cut and fill amounts during construction and attempts to match existing concrete and/ or boardwalk sections. Construction access has been designed to require no additional wetland or stream impacts. Clearing of woody vegetation was avoided outside the footprint of the greenway. Mature trees within 100' of the River were avoided, which necessitated moving the trail within the buffer. Existing Veterans memorial and other monuments also dictated trail location within the buffer. Avoidance and minimization was practiced to the extent possible. 2. Greenway construction is an allowed use within the Neuse River riparian buffer areas, and avoidance/minimization measures were implemented to the extent possible. Portions of buffer impacts for Phase 1 are also exempt, as they are in areas where existing sidewalk will be removed and replaced. The project could not have been implemented without the minimal buffer impacts described in this submittal. Several alternatives were considered and the upgrade of the existing facility was preferred. The alignment utilizes the existing sidewalk where possible, deviating only to achieve the required safety radius and to create necessary connections. The minimum width allowable for multi-use path trails utilizing federal funding is 10 feet. Impacts occurred as a result. Photographs of the existing sidewalk prior to construction are included immediately following this notification. 3. Cumulative Impacts (DWQ Requirement) 3a.
