Hey Stephanie,
I have confirmed that the mitigation for the Old Liberty 401(2007-0464) has not been satisfied. In regards to any buffer
mitigation credits, there are no credits available by private mitigation banks in the Tar -Pamlico 03020101 service area. I
am not sure if there are any banks in that service area with available stream credit.

This permittee never paid their invoices. The last time I sent them an invoice was in 2009. It included fees for stream,
riparian and non -riparian wetlands and buffer- all at rates that have long since expired. Their current invoice would be
$192,850.71 at the 16-17 rates (which expire July 1) for DMS credits. At this point, I would have them seek bank credits
since so many banks now have credits available. I have a 2008 enforcement letter from the COE so it's been on the
unpaid list for a longtime.

Depending on who was keeping up with BIMS, it may or may not be reliable. I am pretty sure DMS was the provider the
permittee chose to satisfy their mitigation component. Therefore, I'm forwarding this over to Kelly Williams at DMS to

Hope you are doing great! I am conducting a Buffer determination at Olde Liberty Golf Course tomorrow and Danny
mentioned they might not have paid their mitigation for phase 1. 1 looked it up in BIMS and the Project # is 20070464
and in the mitigations tab for the last entry it reads: 9/8/09: $167,345.26 owed. Is this the correct place to find if the
mitigation has been paid and is this correct? There are many, many files on Laserfice for this site. Thanks for your help!
