(S&ME) is submitting this Preconstruction Notification (PCN) for a U.S. Army Corps of Engineers (USACE) Nationwide Permit 12 (NWP 12, Utility Line Activities) and the North Carolina Division of Water Resources (NCDWR) Water Quality Certification 4086 (WQC 4086) for the above -referenced project. Written approval from NCDWR is sought as the project involves permanent fill in wetlands and will involve activities that impact regulated riparian buffers and may not be listed as exempt in these regulations. Notification to the USACE for this project is being provided for the record only, as written approval is not required because the project: 1) will not involve mechanized land clearing of a forested wetland for the utility line easement, 2) no section 10 waters are present, 3) the utility line does not exceed 500' in waters, 4) the project does not run parallel to a streambed, 5) losses to waters will be less than 0.10 acre, and 6) no permanent access roads will be constructed. ❖ BACKGROUND INFORMATION PSNC proposes to install 6,990 linear feet of 12 -inch diameter steel natural gas pipeline in the road right- of-way (ROW) along the east side of Lawrence road from Bruce Garner Road to an existing station along PSNC's T-30 pipeline located approximately 450 feet north of the bride over Smith Creek. The project also entails installation of approximately 1,210 linear feet of 2 -inch diameter plastic natural gas pipeline in the road ROW along Hardie Street, and construction of a new 50'X100' station site that will be cleared and graded level at the location where the proposed pipe ties in to the T-30 line, along an existing access road and adjacent to an existing station site. The impact to the stream (Smith Creek, a tributary of Falls Lake / Neuse River) will be temporary, consisting of a trenched pipeline crossing within the existing road ROW (see Figure 5). Stream banks will be returned to original contour and seeded with a native seed mix. It should be noted that this area has recently been impacted by the fall 2016 replacement of the Lawrence Road bridge. Though the workspace for installation of the pipeline will be completely contained within the existing road ROW, which extends approximately 29 feet from the edge of pavement, some clearing of forested vegetation will be required, as survey data indicates that the tree line encroaches up to 9' into the existing ROW. As such, we calculate that 201 ft2 of clearing will occur within the Zone 1 buffer and 71 ft2 of clearing will occur within the Zone 2 buffer. Becuase this is a is near perpendicular, non -electric utility crossing with a workspace less than 40' wide, these buffer impacts are at minimum considered allowable without mitigation, and may be considered exempt, as the additional cleared ROW width is less than 10 feet. Impacts to Wetland 2 will be limited to ground disturbance associated with pipe installation equipment and placement of temporary timber matting (see Figure 6). Most of the portion of Wetland 2 within the road ROW is wooded, and will therefore be cleared prior to pipe installation, though this clearing impact is temporary, and PSNC will not maintain the area. Impacts to Wetland 1 will involve trenched pipeline installation through the emergent portion of this wetland as well as placement of fill in a small (approximately 0.01 acre) wooded corner of the wetland associated with establishment of the new station site (see Figure 7). Equipment work areas will be largely limited to the existing permanent access road and will avoid additional impacts to the north end of Wetland 2. Appropriate sediment and erosion control practices equaling those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" will be used to minimize impacts to the wetlands. During construction, equipment operating near streams and wetlands will be limited to that necessary for excavation, pipe installation, and restoration activities. As proposed, the project will comply with applicable conditions of NWP 12 and WQC 4086. Following the pipeline installation work, the affected areas will be returned to its original grade and contour. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project will take place entirely within existing DOT roadside easement and in existing PSNC utility easements. Easements have been cleared and maintained though some wooded vegetation is present in areas at the edge of the easement. Surrounding land use is primarily wooded with some rural residential areas. The Lawrence Road bridge over Smith Creek had been replaced and expanded in the fall of 2016. 3b. In addition, a new 50'X100' station site is proposed at the end of the new pipeline in order to manage natural gas flow through the pipe. Page 4 of 14 3e. Describe the overall project in detail, including the type of equipment to be used: The pipeline project will include installation of approximately 6,990 linear feet of 12 -inch -diameter steel natural gas pipeline in the road ROW along the east side of Lawrence road from Bruce Garner Road to a station along PSNC's T-30 pipeline located approximately 450 feet north of the Smith Creek crossing, as well as installation of approximately 1,210 linear feet of 2 -inch diameter plastic natural gas pipeline in the road ROW along Hardie Street. In addition, a new 50'X100' station site will be cleared and graded level at the location where the proposed pipe ties in to the T-30 line. Construction of the new pipeline will first involve demarcation existing ROW and easements and mechanized clearing of any existing vegetation in the proposed workspace. Along Lawrence Road, the pipe will be installed in the existing ROW approximately 10 feet off of the edge of pavement. The width of the ROW to the edge of pavement varies from 20 to 27 feet. In wetland areas, efforts will be made to remove surface vegetation in a manner that minimizes disturbance of the substrate and prevents excessive exposure of soil. If necessary, temporary timber mat equipment crossings will be installed to facilitate equipment passage, and prevent excessive rutting and ground disturbance in the wetland areas. Appropriate sediment and erosion control (S&EC) measures will be installed as clearing proceeds to prevent sedimentation of jurisdictional features. No grubbing or below -ground vegetation removal will occur within wetlands or along stream banks outside of the construction corridor. Where the pipe will be installed by conventional means (e.g. "open -trench" or "isolation"), grubbing will be limited, to the extent practicable, to the trench line. Select upland portions of the easement may require rough grading to facilitate safe passage of equipment, and to prepare a suitably -level work surface. Following preparation of the work area and installation of necessary S&EC measures, the trench for the pipeline will be excavated. Subsurface disturbance will only be conducted within the trench line at wetlands and the stream crossing. Stump removal or light grading may occur on the working side of the easement if required for safety reasons. The work will be performed either from the timber mats placed along the working side of the easement or from the road. Efforts will be made to segregate topsoil from the subsoil when excavating in wetlands. In general, lengths of pipe will be trucked to the site, strung along the easement and placed on skids (wooden pedestals). Specialized machines will be used to bend individual segments of pipe to fit the contours of the trench where necessary. The pipe segments will be welded together, x-rayed, the structural integrity and surface coating inspected, and then lowered into the trench. Segments of the trench may require dewatering or "padding" to prevent large rocks or other debris from coming in contact with the pipe. In areas where segregation of the subsoil and topsoil is required, the topsoil will be replaced last. Affected areas will then be "cleaned up" by rough -grading and temporary seeding (if necessary), followed by final grading, permanent seeding and mulching to restore the easement as closely as possible to pre - disturbance contours and conditions. All work within wetlands and the stream will be conducted in accordance with the applicable permits. Best Management Practices (BMP's) will be employed at all stream and wetland crossings to help prevent siltation or inadvertent discharges to a Waters of the U.S. Following completion of the pipeline installation, the area will continue to be maintained by DOT. Any vegetation within the ROW that was cleared for pipe installation will be permitted to regrow at the discretion of the DOT. Page 5 of 14 4. Jurisdictional Determinations 4a. The utility station easement shall be located as shown on Exhibit "A" and described in Exhibit "B", both of which are attached hereto and incorporated herein by reference. The Grantee shall have the right to assign this Easement in whole or part at any time. The Grantee shall have the right to remove all trees, undergrowth, and other obstructions which may be located within the easement area that may injure, endanger, or interfere with the construction, operation, maintenance, and repair of said utility station. Garner of record in the office of the Clerk of Court of Granville County in File 00-E-165) ("Grantor's Land'). The easement granted herein shall be fifty (50) feet wide and located as shown on Exhibit A attached hereto and incorporated herein and as described in Exhibit B attached hereto and incorporated herein (the "Easement Area"). All Facilities installed by Grantee shall be and remain the property of Grantee and may be removed or replaced by it at any time and from time to time. There is included in this grant the right of Grantee, at any time and from time to time to install, lay, construct, maintain, inspect, operate, repair, alter, replace, change the size of, and remove additional Facilities within the Easement Area, including one or more additional lines of pipe and appurtenances thereto, without the payment of additional compensation, such rights being included in this Easement and the consideration paid hereunder. The Grantee shall have all rights necessary and convenient for installation, laying, constructing, maintaining, inspecting, operating, repairing, altering, replacing, changing the size of, and removing the Facilities within the Easement Area, including, but not limited to, the rights of ingress and egress over and across the Easement Area and Grantor's Land for the purpose of obtaining access to and from the Easement Area, and, subject to the provisions of this Easement, the right from time to time to cut all trees, shrubs, and undergrowth and to clear other obstructions that may be located within the Easement Area that Grantee determines, in its discretion, may injure, endanger, or interfere with the installation, laying, construction, maintenance, inspection, operation, repair, alteration, replacement, changing the size of, or removal of the Facilities. Grantee shall comply with all applicable federal, state, and local laws, ordinances, and regulations in exercising the rights granted hereunder. The Grantee shall have the right to assign this Easement and the rights granted herein in whole or in part at any time and from time to time. To have and to hold said Easement unto said Grantee, its successors, and assignees, in title forever, and Grantor, for itself, its heirs, executors, administrators, successors, and assigns, covenants to and with Grantee that Grantor is lawfully seized of Grantor's Land and the Easement Area in fee and has the right to convey said rights and Easement and that Grantor will forever warrant and forever defend the title to said rights and Easement against the lawful claims of all persons whomsoever. The individuals signing this Easement personally warrant that they have the right and power to enter into this Easement, to grant the rights granted under this Easement, and to undertake the obligations described in this Easement. Book: 1361 Page: 229 Seq: 1 Page 2 of 4 Grantor may make full use and enjoyment of the Easement Area in any manner not inconsistent or materially interfering with Grantee's use of the Easement Area or the rights granted hereunder; provided, however, that Grantor, its heirs, successors, and assigns, shall not construct nor permit to be constructed any house, building, or other structure, temporary or permanent, within the Easement Area (including, but not Iimited to, wells, tanks, septic systems, and other natural or man-made obstructions of any nature or kind whatsoever), nor plant trees, large shrubs, or orchards within the Easement Area, nor allow to be placed or installed any other obstruction, temporary or permanent, within the Easement Area that Grantee determines, in its discretion, could damage the Facilities or interfere with the operation, maintenance, or repair of the Facilities by Grantee (including, but not limited to, the accumulation of garbage, rubble, disabled vehicles, tires, or debris of any kind), nor impound nor permit to be impounded any water on or over the Easement Area. Grantor may do the following within the Easement Area. (i) plant, cultivate, and harvest crops (excluding plants whose root systems may interfere with the Facilities including, without limitation, timber and orchards), so long as such planting, cultivating, and harvesting is not otherwise inconsistent with the terms of this Easement; (ii) build roads, streets, or above- ground utilities that cross the Easement Area so long as the centerline of such road, street, or above -ground utility crosses the centerline of the Easement Area as close to perpendicular to as reasonably possible, as determined by Grantee; (iii) construct underground utilities that cross the Easement Area, but only upon advance written approval from Grantee as to the type, specifications, construction plans, and exact location of the proposed underground utilities, including clearance distances from the Facilities; (iv) install fences crossing the Easement Area, but only after obtaining advance written approval from Grantee, and such fences must meet specifications of Grantee for type and must provide accessibility to the Easement Area suitable to Grantee. The above provisions notwithstanding, Grantor, for itself, its heirs, successors, and assigns, further agrees not to construct or install any road, street, utilities, or fences, nor change the grade, within the Easement Area in any manner which will reduce or increase the groundcover over the Easement Area, unless approved in writing in advance by Grantee. Grantor shall notify Grantee in writing at least thirty (30) days prior to any construction or maintenance activity within the Easement Area to obtain such approval and to allow Grantee's representative to be present during such activity. Pipeline markers shall not be relocated or removed from the Easement Area.
