This PCN is being submitted for unavoidable permanent impacts to streams associated with a proposed subdivision development. The completed Pre-Construction Notification Form is provided in Enclosure 1. Additional Project specific information is provided in this letter to augment the required information of the PCN Form. The Site consists of a 108-acre parcel of land situated south of Fleming Loop Road in Wake County, NC (see Enclosure 2: Vicinity Map). The site is largely farmland with forested and undisturbed areas. Land use at the site consists of farmland with residential single family homes in the surrounding areas. The Site is drained by Kenneth Creek, a tributary of the Cape Fear, and is located within the Upper Cape Fear watershed, Hydrologic Unit Code (HUC) 03030004 (see Enclosure 3: HUC Map). A wetland delineation for the Site was conducted by Timmons Group to identify the presence and location of jurisdictional wetlands and other waters of the U.S. in accordance with the guidance provided by the 1987 U.S. Army Corps of Engineers (COE) Wetland Delineation Manual and subsequently issued COE guidance. A field confirmation of the current proposed development was conducted by the COE in 2016. The location of confirmed jurisdictional wetlands and waters of the U.S. within the Site is shown on Enclosure 6: Preliminary Jurisdictional Waters of the U.S. Delineation Map. A desktop review of the onsite Federal Emergency Management Agency (FEMA) 100-year floodplain was completed and the site was found to be located in Zone A, the 1% Annual Flood Hazard zone. No disturbance is proposed within the limits of Zone A. A FEMA Map is enclosed for your review (see Enclosure 5: FEMA Flood Zone Map). 2 | P a g e To accomplish the goals of the project, impacts to jurisdictional areas are unavoidable due to the position of the Site in relation to existing road and utility infrastructure, and the need to traverse existing jurisdictional features between the proposed development and said existing infrastructure. Typical road profile and culvert details have been included in Enclosure 7: Design Details. Road placement was analyzed to determine potential impacts to Waters of the US . Estimated impacts totaled 0.06 acres of Palustrine Forested wetlands and 150 linear feet of intermittent stream (Enclosure 8: Jurisdictional Waters of the U.S. Impacts Map). In order to prevent the potential for secondary impacts, all erosion and sedimentation control practices, including the application of silt fences and erosion control matting, will be constructed and maintained according to the standards and specifications of the current North Carolina Erosion and Sediment Control Planning and Design Manual. An Endangered Species Project Review was conducted to gain insight regarding the potential presence of Endangered Species Act (ESA) listed species within or in the vicinity of the Project. The following agencies and associated databases were reviewed: • North Carolina Department of Natural and Cultural Resources (NCDNCR) – Natural Heritage Program (NHP) • U.S. Fish and Wildlife Service Threatened and Endangered Species for Wake County Information provided by the NC NHP indicated no presence of the species within a one- mile radius of the project area. Therefore, the proposed Project will have “No Affect” to ESA listed species. The Site is not within 330 feet of a bald eagle nest nor does it intersect with eagle concentration areas. Additionally, there is no Critical Habitat identified within the Site. The results of these database queries are included (see Enclosure 9: Threatened and Endangered Species Survey). Historical and cultural resource information for the proposed Site was obtained from the North Carolina State Historic Preservation Office (SHPO) (see Enclosure 10: NCSHPO Survey). A 0.25-mile radius search was performed from the center of the Site to determine the effect, if any, that the Project may have on cultural resources. Initial evaluation from SHPO indicated no potential for disturbing resources within the proposed Site area. Based on the above information and attached supporting documentation the Applicant requests approval of the proposed activity under the requirements of NWP 29 and General Water Quality Certification #4092. Phase 1 of the development will include 113 lots. Future public roadways are set at a width of 29’ (local) measured from back of curb to back of curb. Each public road will contain a 2.5’ curb and gutter section on each side. Upon completion of the project’s construction, the proposed public roads will be turned over to and maintained by the Town of Fuquay-Varina. The proposed subdivision will have connection to the Fleming Loop Road to the Northeast, and a second entrance to the Northwest will be added during future phasing and construction. Proposed built-upon area is approximately 15.18 acres. Total existing site area for Phase 1 is approximately 34.08 acres. Proposed built-upon area is 44.5%. Total Open Space to be dedicated for Phase 1 is 12.18 Acres, which is 35.7% of the total site area for Phase 1. This subdivision is proposed as an open-space development. SITE DESCRIPTION The existing site is approximately 93 acres of agricultural farmland and a mix of hardwood and softwood trees. The site lies within the Cape Fear River Basin and does not lie within any of Wake County’s Water Supply Watersheds. There is an intermittent stream located on the North of the site. The stream is an unnamed tributary to Kenneth Creek. The stream flows from west to east through the northern area of the site. The stream leaves the Northwest portion of the site, and continues onto the adjoining parcel located in the north center of the project. The stream then re-enters the project site to the Northeast and ultimately leaves the site at the Northeast corner of the subject parcel. There is a second intermittent stream that is located to the south-center of the project, and leaves a Jurisdictional Pond that is located in the same area of the site. Four jurisdictional wetland fingers are also found on the site. There is also a Non-jurisdictional pond located on the site, to the eastern central area of the site. Wetlands and stream were delineated by Soil and Environmental Consultants, PA in July 2016. A small portion of the intermittent stream located to the North east of the site will need to be impacted in order to provide a street crossing. There will also be a small impact to one of the wetlands areas near the jurisdictional pond, due to fill for lot areas. These impacts are below the allowed impact limits, and notification will be provided to US Corp of Engineers prior to construction. These areas of impacts have been delineated on the Construction Documents. The project site is located in Zone “X,” areas determined to be outside the 500-year flood area (see FEMA FIRM Panel 3720065600J located in the “MAPS” section of this document.) However, flood hazard soils do exist on the site per Wake County IMAPS. The drainage areas for these flood hazard soils areas are relatively small, and contained on site. The areas of flood hazard soils that are to be impacted with this development will be included in areas draining to storm water control ponds, and will be included in the attenuation calculations for the site. These calculations will act as the flood study for this project due to the small size of the areas, and the drainage being retained in the on-site ponds. These areas of impacts have been delineated on the Construction Documents. The proposed development follows the Town of Fuquay-Varina Flood Study Standards TP-02-01. A ridgeline running from the northwest property corner towards the central portion of the eastern property line generally divides the drainage for the site. The southern side of the site drains towards the southern property line, which collects in a stream south of the subject parcel, and then to Kenneth Creek. The northern side of the site drains towards the intermittent stream in the northeastern portion of the site, that then drains to Kenneth Creek. SOILS According to the Wake County Generalized Soil Survey, the majority of uplands within the site are classified as Wagram loamy sands, ranging from 0% to 10% slopes (WaA, WaB, WaC), Wagram-Troup sands, ranging from 0% to 4% slopes (WgA), Appling gravelly sandy loam, ranging from 2% to 10%, some moderately eroded (AgB2, AgC, AgC2), Appling sandy loam, from 2% to 10% slopes, some moderately eroded (ApB, ApB2, ApC, ApC2) and Norfolk loamy sands, ranging from 2% to 6% slopes (NoB). In the flood hazard soils areas, soils are classified as Wehadkee and Bibb soils, 0% to 2% slopes, frequently flooded (WoA), and Rains fine sandy loam, ranging from 0% to 2% (RaA). The following soil descriptions are associated with the soils found on the site: Wa(X) – Wagram loamy sand soils are often found in Coastal Plain uplands in the southern part of the county. Most of the uplands are cultivated farmland, but some areas are pasture or forest. Permeability is moderate and the soils are somewhat excessively drained. Soils have a low shrink/swell potential. The WaA soils are in the Hydrologic Soil Group (HSG) B per the Wake County Stormwater Design Manual. The WaB soils are in HSG A. No(X) – Norfolk loamy sand soils are often found in Coastal Plain uplands in the southern part of the county. Most of the uplands are cultivated farmland or in pasture, but some areas are in forest. Permeability is moderate and the soils are well drained. Soils have a low shrink/swell potential. The No(X) soils are in HSG A. Ap(X)/Ag(X) – Appling sandy loam soils are gently sloping to strongly sloping, deep, well-drained soils of the Piedmont uplands. These soils are on side slope and on rounded divides that have a difference in elevation of about 50 feet between the highest and lowest points. Much of the acreage is cultivated and suited to all locally grown crops. Permeability is moderate and the soils are typically well drained. Soils have a moderate shrink/swell potential. The Ap(X) and Ag(X) are in HSG B. WoA – Wehadkee and Bibb soils are often found on flood plains in narrow upland draws and in depressions. These soils are mostly found in mixed hardwoods and pines. These soils are poorly drained and surface runoff is slow to ponded. The WoA soils are in HSG A/D. Ra(X) – Rains fine sandy loam soils are often found in depressions where the difference in elevation is about 5 feet between the highest and lowest points. These soils consists of nearly level, very deep, poorly drained soils on uplands of the Coastal Plains. These soils are in the southern part of the county, and have formed under forest in the Coastal Plain deposits. A seasonally high water table is typically at the surface. These soils are poorly drained, flooding is frequent, and the flood waters stay on the surface for a long time. The RaA soils are in HSG B/D. PLANNED EROSION AND SEDIMENTATION CONTROL PRACTICES 1. TEMPORARY CONSTRUCTION ENTRANCE Temporary gravel construction entrance will be installed at Fleming Loop Road to provide a buffer area for construction vehicles to drop mud and sediment to avoid transporting it onto public roads. 2. SILT FENCE Silt fence will be used in natural outfall areas to provide a barrier to any sediment leaving the site. 3. SILT FENCE OUTLET Silt fence outlets are to be used in low areas to allow a drainage point through silt fence areas in order to relieve pressure from water held behind silt fences. 5. TEMPORARY DIVERSION DITCH Temporary diversion ditches will be installed to direct water into skimmer sediment basins. Diversion ditches shall be fitted with liners per the calculations included in order to provide shear resistance until vegetation becomes established. They will be maintained by the contractor until approved to be removed. 6. WATTLES Straw wattles will be provided within temporary diversion ditches where velocities exceed established erosive velocities. 7. TEMPORARY SLOPE DRAINS Temporary slope drains will be installed where diversion ditches enter sediment basins to convey the water and to prevent erosion of the basins slopes. 8. SKIMMER SEDIMENT BASINS Temporary skimmer sediment basins will be installed at several locations on the project site to provide a sediment storage and settling mechanism that retains sediment on the construction site and prevents sedimentation in the surrounding area. 9. SEDIMENT BASIN BAFFLES Baffles will be installed in sediment basins in order to lengthen flow from the inlet point to the outlet point to allow for additional setting time and improve water quality at the outlet point. 10. RIPRAP OUTLET PROTECTION Riprap outlet protection will be used at the outlet of all stormwater discharges into natural ground and drainageways to dissipate the energy from concentrated runoff and reduce the scour potential in vegetated areas. 11. TEMPORARY AND PERMANENT SEEDING Temporary and permanent seeding will be used to form a dense ground cover and to reduce soil loss from exposed slopes. STORMWATER DESIGN STANDARDS Stormwater design for runoff treatment and volume reduction is per the standards set forth for projects in the Town of Fuquay-Varina Stormwater Ordinance, subsection 9- 9056 of the Unified Development Ordinance. The stormwater runoff volume requirements are reduction of the post-development flows to below pre-development flows for the 1-year, 2-year, and 10-year peak storm events. The stormwater runoff treatment requirements are to install control measures to remove 85% total suspended solids (TSS). A drawdown time of 2 to 5 days and on-site containment of the first inch of rainfall are required for the runoff volume in the stormwater control measures. Stormwater control measures are to be designed per the current NCDENR Stormwater Best Management Practices (BMP) Manual guidelines. STORMWATER CONTROL STRUCTURES Due to the existing topography of the project site and the size of the drainage area, two wet detention ponds were selected as the stormwater control measures to treat and store runoff from the proposed development. The wet detention pond BMPs are sized to treat runoff from the majority of the proposed built-upon area on the project site. MAINTENANCE CONSIDERATIONS The property owner shall be responsible for periodic inspection and maintenance of all temporary erosion control measures devices. Any measure that fails to function as intended shall be repaired immediately. CALCULATIONS Runoff calculations were made using Bentley HydroCAD 10.00, which utilizes the NRCS Peak Discharge method.
