Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Existing conditions consist of an assemblage of properties that are partially forested with some open field areas. An abandoned golf course exists on the parcels to the east. There are three large jurisdictional ponds as well as streams and wetlands throughout the property. Finally, there are some existing structures associated with the old golf course and paved paths throughout most of the site. The general land use in the vicinity of the project is residential. 3b. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S&EC completed a wetland delineation and Cape Fear River Buffer evaluation for the entire property in order to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable. Impact 1 is a proposed road crossing to a perennial stream and wetland system. Proposed impacts include permanent and temporary stream impacts, along with permanent and temporary wetland impacts. Headwalls and retaining walls have been utilized to minimize stream and wetland impacts in this location. This impact is necessary to access the eastern side of this property. Impact 2 is a proposed road crossing to a wetland. Proposed impacts include permanent and temporary wetland impacts. Headwalls and retaining walls have been utilized to minimize wetland impacts in this location. This impact is necessary to access the property. Impact 3 is a proposed road crossing to a perennial stream and wetland system. Proposed impacts include permanent and temporary stream impacts, along with permanent and temporary wetland impacts. These utility crossings have been minimized by crossing the stream at a perpendicular angle and are necessary to access the pump station with both gravity and force main lines. Impact 9 is a proposed utility crossing to a perennial stream and wetland. Proposed impacts include temporary stream impacts, along with permanent, no permanent loss wetland impacts. The permanent, no permanent loss impacts are for the permanent maintenance corridor and the change of wetland function. This utility crossing has been minimized by crossing the stream & wetland at a perpendicular angle. Impact 10 is proposed fill for utilities to an intermittent stream. Proposed impacts include permanent stream fill. Per the applicant, during the review process the Town of Fuquay Varina commented that the sewer depth in the public street to serve the development would be prohibitive for maintenance. Therefore the sewer in this area was routed at the rear of the lots across the stream channel that runs through the former golf course fairway. The elevation of the stream channel was too deep for the sewer to cross under the stream and too shallow for an aerial crossing. Retaining walls have been added to minimize the stream impact. Impact 11 is a proposed road crossing at the head of a pond. Proposed impacts include permanent open water impacts. Per the Town of Fuquay Varina's Street Classification and Geometric Standards, this design standard limited the flexibility for the Collector Street to completely avoid the existing pond. Additionally, the pond will be drained early in the construction schedule and re-evaluated at a later date to confirm the permanent footprint of jurisdictional waters of the US. . Impact 12 is a proposed utility crossing to a wetland. Proposed impacts include permanent, no permanent loss wetland impacts. The permanent, no permanent loss impacts are for the permanent maintenance corridor and the change of wetland function. All temporary stream impacts will be brought back to pre -construction elevations and stream banks will be stabilized. All temporary wetland impacts will be brought back to pre -construction contours and allowed to revegetate with the surrounding seed source. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 14 & 29. With respect to residential developments (NWP 29 -Regional Conditions section 4.0) there are no impact associated with stormwater facilities or single-family recreation facilities for this project, the permanent stream & wetland impacts required by impact #3 will utilize a NWP 14, the stream classification for this project is C (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters) and riprap stabilization below the OHWM will be avoided. The applicant is also aware of the regional conditions associated with the Nationwide Permit 14 (NWP 14 - Regional Conditions section 4.0) the applicant is not proposing stream relocations or impacts within tidal watersAvetlands, the proposed crossing is not in a trout watershed; the proposed stream crossings that include FEMA floodplain area are strictly an upland to upland crossings; Bankfull flows are being considered by engineering design; and any stream excavation necessary for culvert installation will be minimal. Contractor will follow the following construction sequence: Contractor shall install erosion & sedimentation control measures including, but not limited to, construction entrances, silt/tree protection fence, diversions/check dams, and sediment basins/traps in accordance with requirements set forth in the Wake County Land Disturbing Permit. Contractor shall notify the Town of Fuquay Varina Public Works 48-hours in advance of start of work during a period of time with no rain in the forecast. Prior to start of work, contractor shall have all materials and equipment on-site. For utility crossings with casings, the carrier pipe shall be installed within the casing pipe prior to any open cut activities. Contractor shall install a temporary cofferdam on the upstream side of the proposed crossing to pump water around the open cut area to the downstream side. Contractor may also install a temporary diversion channel lined with plastic to allow the stream to bypass the open cut area. Contractor shall place the culvert or utility casing with carrier pipe at elevations shown on the approved plans and backfill in accordance with Town of Fuquay Varina specifications. Contractor shall restore channel and stabilize any disturbance within 24-hours of start of work. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan: Per the project Stormwater Impact Analysis: Six wet detention basins have been proposed and designed to treat the requirements of 85% TSS removal, drawdown of the first inch of rainfall between 2-5 days and reduction of peak flow for the 1=24 hour storm event. In addition, the 100 -year event has been routed to ensure safe passage through the site. As the site drains to two common points, treatment is being accomplished at both these points. The applicant requests that a conditional 401 Approval be considered allowing the SMP and its Approval by the Town be submitted to the Division once received from the Town of Fuquay-Varina. ® Certified Local Government 2e. For utility crossings with casings, the carrier pipe shall be installed within the casing pipe prior to any open cut activities. • Contractor shall install a temporary coffer dam on the upstream side of the proposed crossing and pump water around the open cut area to the downstream side. • Contractor shall place the culvert or utility casing with carrier pipe at elevations shown on the approved plans and backfill in accordance with Town of Fuquay Varina specifications. • Contractor shall restore channel and stabilize any disturbance within 24 -hours of start of work.
