I'm in the process of updating the package based on Kyle's comments and should have that in within the next couple of days. I will copy you and Chad Coburn as well. Kyle did feel the proposed impacts will require a formal public notice. I do understand that it is unlikely that the public notice process can take place and the permit be issued prior to your 1 year threshold. I also understand because of this you would like to withdrawal the application now. I would only ask that you wait until we receive comments from Kyle and have the opportunity to modify the application based on those comments. In the event we are required to reduce impacts below a threshold that would eliminate the public notice it is possible the modification could be issued within the 1 yr threshold. To this point we have not had enough information to determine if Public Noticing will be required as it's a proposed permit modification. Hopefully this is helpful. Did I miss it or has this project been withdrawn?
