In accordance with your application for discharge permit received on March 3, 1992, we
are forwarding herewith the subject state - NPDES permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North
Carolina 27611 -7447. Unless such demand is made, this decision shall be final and binding.
Please take notice this permit is not transferable. Part II, E.4. addresses the requirements
to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Environmental Management or permits required by the Division of
Land Resources, Coastal Area Management Act or any other Federal or Local governmental
permit that may be required.

In compliance with the provision of North Carolina General Statute 143-215.1,
other lawful standards and regulations promulgated and adopted by the North Carolina Environmental

is hereby authorized to discharge wastewater from a facility located at
Briarwood Subdivision
on NC Highway 66
southeast of Mount Olive
Stokes County
to receiving waters designated as an unnamed tributary to Brushy Fork Creek in the Roanoke River
Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I, II, and III hereof.
This permit shall become effective February 1, 1993
This permit and the authorization to discharge shall expire at midnight on January 31, 1997

Rayco Utilities, Incorporated
is hereby authorized to:
1. Continue to operate an existing 0.050 MGD activated sludge package -type wastewater treatment
facility consisting of an influent sedimentation chamber, aeration clarification, tablet chlorination
and contact chambers located at Briarwood Subdivision, on NC Highway 66, southeast of
Mount Olive, Stokes County (See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached map into an
unnamed tributary to Brushy Fork Creek which is classified Class C waters in the Roanoke
River Basin.

D. ENGINEERING ALTERNATIVES ANALYSIS CONDITION
The permittee shall continuously evaluate all wastewater disposal alternatives and pursue the most
environmentally sound alternative of the reasonably cost effective alternatives. If the facility is in
substantial non-compliance with the terms and conditions of the NPDES permit or governing rules,
regulations or laws, the permittee shall submit a report in such form and detail as required by the
Division evaluating these alternatives and a plan of action within sixty (60) days of notification by
the Division,

Dear Mr. Stogner:
As you are aware, our Division is currently processing
the NPDES permit renewal application for the Briarwood
facility. Since the WWTP discharges into a stream with a
7Q10=0, several revisions will be made to the new permit.
Attached you will find a preliminary wasteload
allocation form denoting the proposed changes in the
effluent limitations that will be incorporated into the new
permit. As proposed, the new permit will be issued with -a
chronic toxicity monitoring requirement. Please note,
however, that the wasteload approval form states that the
facility has the choice between chronic toxicity testing or
the stricter NH -N limits. If you agree to a more strict
NH -N limit (1.� mg/1 summer), the toxicity testing
requirement would be dropped.

PART IV - EVALUATION AND RECOMMENDATIONS
Operation and maintenance of this package plant are
marginal, at best. In the past, solids have left the plant due
to surge flows, as the timers cut return sludge off. Appreciable
head is created in the aeration basins due to the high rate of
sludge returned, and the flow equalizes thru the clarifiers when
the RAS is stopped.
The waste load for the facility indicates that the permittee
should be given a choice of Chronic Toxicity or NH3 @ N limit.
Conversation with the Permittee indicates that the facility can
meet neither. The Permittee states that he intends to dispute
the allocations' reported stream flow (1101'7Q10).
The Region recommends the Permit be handled in accordance
with current Division policy.
