TROGDON, III SECRETARY SUBJECT: Nationwide Permit #14 Bridge No. 280471 on SR 2416 (Old Highway 109) over West Branch Lick Creek, Class C, Davidson County, WBS Project No.: 17BP.9.R.62 Dear Mr. Lastinger, We are requesting a Nationwide 14 permit for the replacement of Bridge No. 280471 with a double barrel box culvert (2@ 11'x 7' RCBC) on SR 2416 (Old Highway 109) over West Branch Lick Creek (Class C) in Davidson County. I have attached the pre-construction notification application, vicinity map, soils map, topographical map, and permit drawings with the project area called out. Other attachments include a mitigation acceptance letter from Division of Mitigation Services (DMS), the stormwater management plan, the 'No Survey Required form for Historic Architecture', and the No Archaeological sites are present or Affected' for Archeology. The project will permanently impact 1261inear feet (58'-culvert, 68'-bank stabilization) and temporarily impact 341inear feet (dewatering) of West Branch Lick Creek. Low stream flow will be isolated into one barrel, with 1' sills, and the culvert will be buried 1' below the stream bed to ensure aquatic passage. The high flow barrel will have 2' sills and floodplain benches constructed at the inlet and outlet of the culvert. The low flow barrel will be backfilled with material that is excavated from the stream or floodplain and may be supplemented with rip rap if needed. The high flow barrel will be backflled with rip rap or native bed material of appropriate size to the sill elevation to expedite the establishment of a natural stream bed. The culvert site will be dewatered during construction in accordance with NCDOT's Best Management Practices. The US Fish and Wildlife Service (USFWS) lists Schweinitz's sunflower (Helianthus schweinitzii) as endangered and Northern Long-Eared bat (Myotis septentrionalis) as threatened for Davidson County. Habitat is present in the project area for Schweinitz's Sunflower; however, October 22, 2014 and November 12, 2014 surveys revealed no presence of Schweinitz's sunflower. Summer roosting habitat is present at the existing bridge for the Northern Long-Eared bat (NLEB). Anticipated tree clearing impacts for this project are estimated to be 0.27 acres. An October 22, 2014 survey of the existing bridge revealed no presence of the NLEB. The proj ect area falls within the range of the NLEB and there is likely tree cutting and/or percussive activities associated with the project. Consequently, it was determined that the project `May Affect, not likely to adversely affect' the NLEB. Thus, for the proposed action, NCDOT has committed to the conservation measures listed below: 1. No alterations of a known hibernaculum's entrance or interior environment if it impairs an essential behavioral pattern, including sheltering NLEB (January 1 through December 31); 2. No tree removal within a 0.25-mile radius of a known hibernacula (January 1 through December 31); and 3. No cutting or destroying a known, occupied maternity roost tree, or any other trees within a 150-foot radius from the known, occupied maternity tree during the period from June 1 through and including July 31. The final determination regarding the NLEB biological conclusion will be determined by the USFWS in consultation with the USACE in accordance with Standard Local Operating Procedures for Endangered Species Act Compliance for the Northern Long-Eared Bat in North Carolina, December 2016. Bald Eagles are protected under the Migratory Bird Treaty Act and the Bald and Golden Eagle Protection Act. It was detertnined on January 14, 2015 that habitat for the Bald eagle was not present in the project study area. Therefore, this species will not be impacted as a result of project construction. By copy of this letter, we also request 401 review and approval from the NC Division of Water Resources with one copy of the application package provided to Amy Chapman, Transportation Pernutting Unit Supervisor, and Dave Wanucha, DOT Project Coordinator. Water will be diverted around the construction area and the old bridge will be removed. The proposed structure will be replaced on its existing alignment and a new (2) 11' x 7' RCBC will be cast in place. The channel will then be excavated and realigned for low flow shaping and a floodplain bench with stabilization will be established on each bank. Water will be pumped around the work area during construction by installed impervious dikes upstream and downstream of the existing bridge. Pumped water between dikes will be directed in a stilling basin. Equipment to be used includes a track hoe, dump truck, paving equipment, pumps and various hand tools. 4. The proposed project will remove and replace a structurally deficient bridge and replace it with a 2@ 11' x 7' RCBC. Roadway approach work is minimized to reduce the overall project footprint. An offsite detour will be employed to avoid the need for a temporary parallel structure. The native bed material shall be placed between sills in the culvert to provide a continuous low flow channel. Further justification is provided in the stormwater management plan. Bank stabilization will be minimized to those areas where deemed necessary. 1 b. (ESI) on 2/6/2015. The following description was submitted to the NCDOT by ESI in February 2015 and revised by NCDOT archaeologist Caleb Smith. Background Research Background research consisted of an examination of the listings of previously recorded sites, previous archaeological surveys, and previous environmental reviews at the Office of State Archaeology (OSA) in Raleigh. This review identified no previously recorded archaeological sites within the A.P.E., although previously recorded site 31DV382 is located approximately 300 meters (984 ft.) south of the project area. No previous archaeological surveys have been conducted within the project A.P.E. ESI conducted a search of the North Carolina State Historic Preservation Office online database (HPOWEB GIS Service). It revealed no previously recorded historic architectural resources within the A.P.E. An examination of historic maps does not show any historic features within the A.P.E., although there are two nearby. One is the existing railroad located at the north edge of the A.P.E., and the other is the Emmons Mine located approximately 1.2 kilometers (0.7 mile) to the west. The railroad is named the Thomasville and Denton on the 1980 topographic map. The Emmons Mine appears on the maps between 1890 and 1915. Basic research indicates the Emmons Mine began operation at some point before the Civil War and was sporadically operated into the first quarter of the twentieth century (Nitze and Hanna 1896; Stevens 1907; Pogue 1910; New England Railway Publishing Company [NERPC] 1922). Other than the existing railroad bed, the maps show no features related to either within the A.P.E. An 1890 map (Johnson 1890) of the project area is not drawn at an accurate enough scale to identify the specific locations of roads, structures, or other features. It shows a road crossing the West Branch Lick Creek in the general vicinity of the A.P.E. (Figure 4). Two structures (labeled "J. Metters" and "L. Beck") are shown in the vicinity of the A.P.E. The existing railroad is not depicted on the map. A mine ("Emmons G.M." [gold mine]) is depicted southwest of the A.P.E. A 1908 map (N.C. Geological and Economic Survey [NCGES] 1908) of the project area appears to have been drawn at a more accurate scale (Figure 5). It shows the road crossing West Branch Lick Creek in the vicinity of the A.P.E. The existing railroad is depicted on the map as "Central." Two structures are shown to the south of the A.P.E. "Emmons Mine" is depicted by several mining symbols to the north and west of the A.P.E. The main part of the mine operation is marked by a cluster of 13 structures. A 1910 map (Miller 1910) of the project area is drawn at a less accurate scale and is probably not accurate enough to identify the specific locations of roads, structures, or other features (Figure 6). It shows the road crossing West Branch Lick Creek in the vicinity of the A.P.E. One structure (labeled "T. Metters") is shown near the south end of the A.P.E. The existing railroad is depicted on the map as "Piedmont." The area around the A.P.E. is labeled "Emmons Sta" (Emmons Station). "Emmons Mine" is shown a short distance to the northwest of the A.P.E. It shows the road crossing West Branch Lick Creek in the vicinity of the A.P.E. One structure is shown near the south end of the A.P.E. The existing railroad is depicted on the inap as "Yadlcin" (probably the Carolina and Yczdkin River Railf�oad that ran from High Rock, N.C. to High Point, N.C. [NERPC 1922]). "Emmons Mine" was located a short distance to the west ofthe A.P.E. I�� addition to historic maps of the area, recent and historic aeiial photographs of the vicinity were examined for evidence of o1d roads, strucri.u-al remains, or pievious road alignments. The 2010 aerial photograph clearly shows bridge construction undei�vay (Figure 8). It appears that this portion of Old NC 109 was closed (road barriers are visible to the north and south of the bridge) while the bridge was rebuilt. Archaeological Survey The archaeological survey consisted of pedestrian survey in each quadrant. A line, or transect, of shovel tests was placed approximately 10 meters (30 ft.) from the pavement edge qtiadrant. Shovel tests were excavated at a 30-meter (98-ft.) interval along each transect. These tests measured at least 30 centinieters (12 in.) in diameter aild were excavated a miniinuin of 10 centimeters (4 in.) into sterile subsoil. All test iill was screened through 0.64 centimeter (0.25 in.) wire inesh. Each shovel test was backfilled upon completion. Shovel tests were not excavated at locations with slope of greater than 15 percent. Global Positioning System (GPS) readings using a sub-meter-accuracy Trimble GeoExplorer handheld GPS receiver were taken at each shovel test. In all areas, shovel testing was suppleinented by comprehensive exainination of exposed ground surface. The bridge is oriented approximately northwest-southeast, but is considered north-soutl� for tl�is review (Figlire 9). The majority of the APE is comprised of Oakboro silt loam, frequently flooded (OkA). This moderately well drained soil is encountered on floodplains, and typically consists of up to 15 centimeters of silt loam over silty clay loain. The northern and southern ends of tlle APE are n�apped as Kirkey silt loam (KyB), a moderately well drained soil series exhibiting a similar soil profile to Oakboro silt loam. The southern boundary of the APE lies adjacent to an area mapped as co��taining Badin channery silt loam (BaB). A typical soil profile for this well drained soil series consists of around 15 centimeters of chamleiy silt loam over silty clay. Table 2: Soils in the Project Area (NRCS 2013). The vegetation consists of a mature hardwood forest (Figure 10). There is a berm of soil and modern debris (tires and household refuse) along the edge of the road (Figure 11). Much of the A.P.E. was disturbed by refuse dunlping and road construction, and STs 144-146 were excavated along the western boundary of the APE. Shovel tests encountered 15 to 25 centimeters of olive yellow or light olive biown silt loam over olive brown silty clay loain. The landforn7 in the southeast quadrant is a level floodplain or ten-ace from the bridge south for approximately 30 meters (100 ft.), then a gradual slope up froin 30-90 meters (100-295 ft.) south. The vegetation consists of a mixed forest of pines and hardwoods (Figure 12). A large alnount of inodenl trash was noted within the southeastern quadrant of the APE, including plastic garbage bags of refiise, electronics, clothing, bedding, and other refuse (Figure 13). These materials do not appear to have been associated with any structural remains, and likely represent illegal dlimping rather than a habitation site. Given the temporary road clostire dliring bridge construction in 2010, it is likely that the materials were dumped here during this time. STs 147-149 were eXcavated along the easten� boundaries of the APE due to the modern disturbance. Soils in this area were similar to the southwestern quadrant, and consisted of 15 to 20 centiineters of olive yellow or light olive brown silt loam over clay loam. The landforn� in the lzoi�theast quadrant is a level floodplain from the bridge noi-th for approximately 85 meters (279 ft.), then a raised rail�oad bed along the north edge of the A.P.E. (Figure 14). The vegetation is a hardwood forest, with Linderstoiy plants indicative of a poorly-drained landform (Figure 15). Thr�e shovel tests (STs 150-152) were excavated in the APE. Shovel testing revealed nearly identical soils, with 20 centimeters of olive yellow silt loain over wet olive brown silty clay. The vegetation is a forest of small hardwoods (Figure 17). STs 153 and 154 were excavated in the northwestei-n portion of the APE. Soils in these shovel tests consisted of l5 centimeters of olive yellow silt loam over mottled yellowish bi-own and olive brown wet silty clay loam. Based on the results of the background research and field investigations, no archaeological resources are located witl�in the APE for Bridge No. 471 in Davidso�� County. It is recominended that this project be allowed to proceed without concei-n for impacts to signiticant culhual resouices. Should the boundary of the proposed APE be expanded or moved, additional archaeological investigations inay be necessary, as determined in consultation with the NC�DOT and/or SHPO per t11e Prograinmatic Agreement.
